Introduced by Councilman Seconded by Councilman John Balshaw Larry Tencer AN ORDINANCE ADDING SECTIONS 13.2$.185 TO THE PETALUMA MUNICIPAL CODE TO BAN THE SALE OF ALCOHOLIC BEVERAGES IN DESIGNATED AREAS OF MCNEAR PARK AND TO DESIGNATE AREAS WHERE POSSESSION AND CONSUMPTION ARE ALSO BANNED WHEREAS, on April 17, 1989 the City Council of the City of Petaluma adopted Resolution No. 89-102 N.C.S. wherein the City Council requested the preparation of an Ordinance banning the sale of alcoholic beverages in designated areas of McNear Park and further banning possession and or consumption of such beverages in the park between the restrooms at the west side of the baseball field and the end of the field where the Petaluma Boys & Girls Club site is located. NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. Section 13.28.185 of the Petaluma Municipal is hereby added to read as follows: Section 13.28.185. Alcoholic Beverages at McNear Park A. It shall be unlawful for any person to sell, consume or possess alcoholic beverages in that area of McNear Park between the restrooms at the west side of the baseball field and the end of the field where the Petaluma Boys and Girls Club site is located. B. In those areas where the consumption and possession of alcoholic beverages is banned there will be posted a notice of said ban. The signs posting the said notice shall be in conformance with the signs posting closing hours as specified in the Petaluma Municipal Code Section 13.28.200 B, and C. Ord. 1767 N.C.S. r Section 2. If any section, sub-section, sentence, clause or phrase of this chapter is, for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decisions shall not affect the validity of the remaining portions of the chapter. Section 3. This Ordinance shall take effect 30 days after the date of adoption. Section 4. The City Clerk is hereby directed to post this Ordinance for the period and in the manner required by the Petaluma City Charter. INTRODUCED and ordered posted/published this 17th day of July , 1989.
