AN ORDINANCE AMENDING SECTIONS
11.52.040 AND .1.1.'.52.070
OF THE PETALUMA MUNICIPAL CODE
TO ADD A PROHIBITION~bN
TENTH AND FAIR STREETS
WITHIN THE CITY OF PETALUMA
TO CERTAIN T-RUCK TRAFFIC
(EXCEPTING TRUCKS MAKING LOCAL DELIVERIES)
WHEREAS, both the Traffic Committee and the City Council
have met with local residents, and representatives of several
trucking firms to discuss the impact of truck traffic on
Tenth and Fair Streets; .and,
WHEREAS, the Traffic Committee has recommended to the City
Council the prohibition of truck traffic on Tenth and Fair
Streets for trucks over three (3)tons - except for local
deliveries as defined by the California Vehicle Code and
only to the locations specified herein; and,
WHEREAS, the purpose of the ordinance is to regulate the use
of Tenth and Fair Streets as a~route for trucks over three
3) tons ONLY providing local. deliveries, as defined by the
California vehicle Code, to the resident`s along those
streets, Petaluma High School, the Hagstrom's Shopping
Ord 1765 N.C.S.
Center and the California Cooperative Creamery.. The
regulations stated herein reflect a mutual agreement among
the residents, the Creamery, the Hagstrom's Center and the
City to minimize the impact of truck traffic on Tenth and
Fair Streets without adversely affecting the ability of
those businesses to carry out normal operations. To that
end, the Creamery and the Hagstrom's Center have voluntarily
limited the number of trucks and the times when they will
use Tenth and Fair Streets; and the City, by adoption of
this ordinance, shall prohibit all trucks over three (3)
tons from using Tenth and Fair Streets unless they are
providing local deliveries to the residents or businesses
specified herein.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
PETALUMR RS FOLLOWS:
Section 1. Section 1.1.52.040 is hereby amended in its
entirety to read as follows:
11.52.040 Trucks over three tons to use truck
routes.
When any such truck route or routes are
established and designated by
appropriate signs, the operator of any
vehicle exceeding a maximum gross weight
limit of three tons shall drive on such
route or routes and none other, except
that nothing in Sections 11.52.030

through 11,.,5.2.070 shall prohibit the
operator o'f. any vehicle exceeding a
maximum gross weight of three tons
coming from a "Truck Route" having
ingress and egress by direct route to
and from restricted streets when
necessary for the purpose of making
pickups or deliveries of goods, wares
and merchandise from or to any building
or structure located on such restricted
streets or for the purpose of delivering
materials to be used in the actual and
- bona fide repair, alteration, remodeling
or construction of any building or
structure upon such restricted streets
for which a building permit has
previously been obtained therefor.
Section 2. Section 11.52.070 of the Petaluma Municipal
Code is hereby amended in its entirety to read as follows:
11.52.070 Prohibition of Trucks on Certain
Streets..
A. Those vehicles exceeding a maximum
gross weight of three (3) tons are
hereby prohibited from using the
following streets at any time:

2. East D Street between Payran
Street and Lakeville Highway.
3. Tenth Street between B and D
Streets.
4. Fair Street between Western
Ave. and B Street
B. Any vehicle exceeding a maximum
gross weight of three (3) tons is
hereby prohibited from using the
following streets during the times
of day as indicated:
1. Payran Street from Jefferson
Street to Washington Street between
the hours of 7:00 p.m. and. 7:00
a.m.
C. The Director of Public Works shall
erect and maintain appropriate

these ,prohibitions.
Section 3. The City Clerk is hereby directed to post
this ordinance for the period and in the manner specified by
law.
