Introduced by Seconded by Brian Sobel Lynn Woolsey AN ORDINANCE AMENDING SECTION 1.04.060 OF THE PETALUMA MUNICIPAL CODE REGARDING VIOLATIONS AND PENALTIES THEREOF. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1: Section 1.04.060 of Chapter 1.04 of the Petaluma Municipal Code is hereby amended in its entirety to read as follows: "1.04.060 Violations-Penalty. A. Unless otherwise specified, any person, firm or corporation, whether as principal, agent, employee or otherwise violating or causing the violation of any provision of this code shall be guilty of an infraction, and upon conviction thereof shall be punished by a fine of not less than ten dollars nor more than one hundred dollars; upon a second conviction of a violation committed within one year, the fine shall be not less than twenty-five dollars nor more than two hundred fifty dollars; upon a third conviction of a violation of this code committed within one year, the fine shall be not less than fifty dollars nor more than five hundred dollars. Such person, firm or corporation shall be deemed guilty of a separate offense for each and every day during which said violation is committed or continued. 1 Ord. 1757 N.C.S. B. Unless otherwise specified, upon a fourth or subsequent conviction of a violation of this code committed within a period of one year, said violation shall constitute a misdemeanor, punishable by a fine of not more than one thousand dollars or by imprisonment in the county jail for a period of not more than six months, or by both such fine and imprisonment. C. Whenever a violation of any provision of this code is specified as a misdemeanor, said violation shall be punishable by a fine of not more than one thousand dollars or by imprisonment in the county jail for a period of not more than six months, or by both such fine and imprisonment. Section 2: If any section, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional. Section 3: The City Clerk be, and she is hereby, directed to post/publish this ordinance for the period and in the manner required by the City Charter.
