ORDINANCE NO. 1740 N.C.S.

AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S., AS
AMENDED, BY RECLASSIFYING. AND PREZONING
AP NO. 019-070-41 -LAND OF MARCELLUS
BE IT ORDAINED by the Council of the City of Petaluma as follows:
Section 1. The City Council finds that the Planning Commission filed
with the City Council on September 19, 1988, its report as set forth in
its minutes of August 23, 1988, recommending the approval of an
amendment to Zoning Ordinance No. 1072 N.C.S. , to reclassify and
rezone certain land being more particularly described as Assessor's
Parcel Number 019-070-41 to R-1 20, 000 square feet.
Section 2. The City Council further finds that said Planning
Commission held a public hearing on August 23, 1988 to consider said
proposed amendments to Zoning Ordinance No. 1072 N.C.S., as
amended, after giving notice of said hearing in the manner, for the
period and in the form required by said Ordinance No. 1072 N . C. S. ,
as amended.

Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072
N.C.S. , as amended, the City Council finds the proposed prezoning to
be in general conformity with the Petaluma General Plan and further
finds the following
1. The prezoning is in the best interest of the City of Petaluma.
2. The prezoning shall not constitute an expansion of the existing
Sphere of Influence or water service boundary line.
3. That the proposed prezoning is in general conformity with the
Petaluma General Plan.
4. That the public necessity, convenience and general welfare
require or clearly permit the adoption of the proposed prezoning .
5. That the incorporation of mitigation measures to address identified
environmental impacts will insure that the prezoning and
subsequent annexation occurs consistent with City Standards.
6. That the requirement of a property agreement prohibiting division
of the land into lots less than 20, 000 square feet in area will
address neighborhood concerns of increased density potential.
Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072
N.C.S. , as amended, and based upon the evidence it has received at a
public hearing held on September 19, 1988, and in accordance with the
findings made, the City Council hereby adopts amendment to said
Zoning Ordinance No. 1072 N.C.S. so as to reclassify and rezone said
property hereinbefore referred to.
Section 5. The City Council finds that the requirements of California
Environmental Quality Act Guidelines, Section 15083 have been satisfied
and hereby incorporates by reference the Negative Declarations
prepared and approved for the proposed prezoning.

Section 6. The City Clerk is hereby directed to post this Ordinance
for the period and in the manner required by the City Charter.
