Seconded by Lynn Woolsey [, C AN ORDINANCE DISESTABLISHING THE PARKING AND BUSINESS IMPROVEMENT AREA AND REPEALING ORDINANCE NO. 1705 N.C.S. IN ITS ENTIRETY AND DECLARING THE URGENCY THEREOF BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS IaL�77flf[�LbY� Whereas, the City Council adopted the Resolution 88-319 on September 6, 1988, entitled "Resolution of Intention to Disestablish the Parking and Business Improvement Area Previously Formed Pursuant to Ordinance No. 1705 N.C.S.", and Whereas, a public hearing was held on October 3, 1988, at the Petaluma City Hall, Petaluma, California, concerning the disestablishment of the Parking and Business Improvement Area; Section 1. The Parking and Business Improvement Area previously established pursuant to Ordinance No. 1705 N.C.S. is hereby disestablished in its entirety. Section 2. Ordinance No. 1705 N.C.S. previously adopted on November 30, 1987, is hereby repealed in its entirety. Section 3. If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason held to be invalid or unconstitutional by a decision of any court ,of competent jurisdiction, such decision shall not Ord. 1739 NCS 1 of 2 affect the validity of the remaining portions of the chapter. Section 4. This ordinance is declared to be an urgency ordinance on behalf of the public health and welfare due to the need to insure that no further fees are required or collected from the businesses within the existing Parking and Business Improvement Area. Section 5. The City Clerk is hereby directed to post/publish this ordinance for the period and in the manner specified by law. Introduced and ordered posted/published this 3rd day of October . 1988.
