AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S., AS
AMENDED, BY RECLASSIFYING AND PREZONING
AP No. 048-134-16. METCALFE.
BE IT ORDAINED by the Council of the City of Petaluma as follows:
Section 1. The City Council finds that the Planning Commission filed
with the City Council on June 20, 1988, its report as set forth in its
minutes of April 12, 1988, recommending the adoption of amendments to
Zoning Ordinance No. 1072 N.C.S., as amended, by reclassifying and
rezoning certain lands being more particularly described as Assessor's
Parcel Number 048-134-16 (known as 731 Paula Lane) to R-1, 10,000
and R-1, 20,000 square feet.
Section 2.
The City
Council further finds that
said Planning
Commission
held public
hearings on said proposed
amendments to
Zoning Ordinance No.
1072 N.C.S., as amended, on
April 12, 1988
after giving
notice of said hearing in the manner, for
the period and
in the form
required by
said Ordinance No. 1072 N.C.S.,
as amended.
Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072
N.C.S., as amended, the City Council finds the proposed prezoning to
be in general conformity with the Petaluma General Plan and further
finds the following:
1. The prezoning is in the best interest of the City of Petaluma.
2. The prezoning shall not constitute an expansion of the existing
Sphere of Influence or water service boundary line.
3. That the proposed prezoning is in general conformity with the
Petaluma General Plan.
4. That the public necessity, convenience and general welfare
require or clearly permit the adoption of the proposed prezoning.
Section 4.
Pursuant to the provisions
of Zoning
Ordinance No. 1072
N.C.S. , as
amended, and based upon the evidence
it has received and
in accordance with the findings made,
the City Council
hereby adopts
amendment
to said Zoning Ordinance
No. 1072
N.C.S. so as to
reclassify
and rezone said property
hereinbefore referred to in
accordance
with the recommendation of the Planning
Commission.
Section 5. The City Council finds that the requirements of California
Environmental Quality Act Guidelines, Section 15083 have been satisfied
and hereby incorporates by reference the Negative Declaration
prepared and approved for the proposed prezoning.
Section 6. The City Clerk is hereby directed to post this Ordinance
for the period and in the manner required by the City Charter.
