ORDINANCE NO. 1731 N.C.S.

AN ORDINANCE AUTHORIZING THE TRANSFER OF
CERTAIN PORTIONS OF REAL PROPERTY, KNOWN AS
AMBER WAY IN PETALUMA,
TO HAROLD M. MATZEN AND ANN J. GREGORY,
AND TO WILLIAM AND EMMA BASSO
AND DECLARING ITS URGENCY
TO TAKE EFFECT IMMEDIATELY
BE IT ORDAINED by the Council of the City of Petaluma as follows:
Section 1. The real property described in Exhibits A and B hereto is
hereby authorized to be transferred, by Quitclaim Deed, to Harold M.
Matzen and Ann J. Gregory and to William and Emma Basso, respectively,
reserving therefrom those public storm drain easements, public utility
easements and public sanitary sewer easements as described in said Exhibits
A and B hereto.
Section 2. This ordinance is hereby declared to be necessary for the
immediate preservation of the public, health and safety and shall take effect
and be enforced upon its passage by a unanimous vote by the members of
the City Council present at the time of its adoption. The reason for the
urgency of this ordinance is that approval of Bodega Vista Unit 1 Final Map
is contingent upon a storm drainage easement, that will be granted by
Harold Matzen and Ann J. Gregory and William and Emma Basso.

the unused portion of
Amber Way cul-de-sac is declared surplus and title transferred to the
adjacent property owners, the storm drainage easement will be transferred
to the City.
Section 3. That the Mayor or City Manager is hereby authorized to
execute the quitclaim deeds as described in said Exhibits A and B .
Section 4. The City Clerk be, and she is hereby directed to publish
this ordinance.

FOR A VALUABLE CONSIDERATION, receipt of which is hereby
acknowledged, the City of Petaluma, a Charter City, organized under the
laws of the State of California, hereby remises, releases and quitclaims to
HAROLD M. MATZEN and ANN J. GREGORY that property in the City of
Petaluma, County of Sonoma, State of California, described as follows:
Being a portion of that certain parcel of land as conveyed to the CITY
OF PETALUMA as said lands are described by deed recorded in Book
3272 of Official Records, at Page 471, Sonoma County Records and as
further shown on City of Petaluma Parcel Map No. 119 in Book 256 of
Maps, at Page 37, Sonoma County Records, Sonoma County, California
and more particularly described as follows:
Beginning at the common corner of Parcels 1 and 2 and the
right-of-way for Amber Way, said corner being marked by a 1/2 inch
iron pipe tagged L.S. 3803 and being the TRUE POINT OF
BEGINNING; thence along the common line between Parcel 2 and the
right-of-way and along the arc of a 57.00 foot radius curve to the

5.82 feet to the TRUE POINT OF BEGINNING; thence North
24054119" West a distance of 32.11 feet to a point of
non -tangential curvature; thence along the arc of a 47.00 foot
radius curve to the left through the central angle of 8004119" an
arc length of 6.62 feet (the long chord of which bears South
73059145" East a distance of 6.62 feet) to a point; thence South
24054119" East a distance of 23.36 feet; thence South 23038117"
West a distance of 6.67 feet to the TRUE POINT OF BEGINNING.
