Resolution No. 2009-151 N.C.S. of the City of Petaluma, California AUTHORIZING THE CITY MANAGER TO EXECUTE A PURCHASE ORDER WITH LDV, INC. FOR THE PURCHASE OF A PETALUMA POLICE DEPARTMENT MOBILE COMMAND VEHICLE USING U.S. GENERAL SERVICES ADMINISTRATION CONTRACT NO. GS-30E-0009L WHEREAS, the City of Petaluma Police Department identified a need to purchase a . Mobile Command Vehicle (MCV) for use during critical incidents and as part of the county -wide Office of Traffic Safety Avoid the 13 grant administered by the Police Department; and, WHEREAS, the City of Petaluma has previously received a grant from the Office of Traffic Safety in the amount of $224,000 to assist in the purchase of a MCV for use in the Avoid the 13 anti -DUI campaign and the City of Petaluma has agreed to utilize these funds for a MCV; and, WHEREAS, the City of Petaluma has available $139, 327.52 in matching funds from the Asset Seizure account to purchase a MCV; and, WHEREAS, the City of Petaluma, based on cost, specific vehicle features needed to comply with Office of Traffic Safety Avoid the 13 grant, the City of Petaluma's needs, and extensive outreach to potential vendors and evaluation of vendor capabilities and MCV models; has identified LDV Inc., Burlington, Wisconsin to be a reputable and reliable vendor of a MCV; and, WHEREAS, Petaluma Municipal Code section 4.04.100 provides an exemption from the formal contract procedures required by Chapter 4.04 when purchases of supplies or equipment are made under a cooperative purchasing program with another public agency using competitive process; and, WHEREAS, Petaluma Police Department staff has obtained from LDV Inc., documentation confirming that LDV, Inc. possesses a competitively -awarded contract, U.S. General Services Administration Contract No. GS-30E-0009L ("GSA Contract"); and, WHEREAS, LDV Inc., provided a list of MCVs sold to Police Departments throughout the United States utilizing the GSA pricing schedule; and WHEREAS, the Petaluma Police Department selected LDV, Inc. model MCC302221- 09, as best serving the City's needs, pursuant to those certain "Specifications for Petaluma Police Department (CA) DUI Command Vehicle OTS Project AL0982 Avoid the 13 Sonoma County, LDV Model #MCC302221-09" dated August 19, 2009, ("MCV Specifications"), a copy of which is attached as Exhibit A and made a part of this resolution, at a cost not to exceed $363,327.52; and, WHEREAS, Petaluma Police Department staff has confirmed that MCV model MCC302221-09 is furnished pursuant to and consistent with pricing established by the GSA Contract. The manufacturer's specifications detail the primary uses for which this vehicle Is Intended. The components added by LDV allow the vehicle to be used for special services but are not intended to permit passenger occupancy except in designated seating while the vehicle is in motion cross- country travel or unimproved roads or for hauling or towing of loads in excess of the manufacturer's specifications. THIS WARRANTY DOES NOT APPLY TO: A. Items warranted separately by the manufacturer, thereof, including but not limited to: the chassis, engine, body, tires, cast aluminum wheels, air conditioning, furnaces, radios, lighting fixtures, generators, computers, telephones, and other electronic equipment. B. Damage resulting from tire failure. C. Additions, alterations or installations made by individuals, including dealers, other than LDV or defects arising out of attribution to such addltions, alterations or installations. D. Damages resulting from down time or lost income attributed to service, regular maintenance, repair or warranty work. E. Defects attributable to abuse, misuse, negligence, accident or other casualty damage. F. Damage resulting from failure to promptly notify and comply with the instructions of LDV about the defects when noted. : G. Minor imperfections which do not effect the suitability of the vehicle for its intended use. H. Exterior paint which is covered by the body manufacturer. 1.
