FOR T~IE Pi1RC~IASE OF A PETALi11VIA POLICE I)EPARTM~NT 1VIOBILE COMIV~ANI) VEHICILE USING U.S. GENERAL SERVICES ADIVIINIS'T~ZA`TION CONTRAC'I' NO. GS-30F-0009L, WHEI~EAS, the City of Petaluma Police Department identified a need to purchase a. Mobile Command Vehicle (MCV) for use during critical incidents and as part of the county-wide Office of Traffic Safety Avoid the 13 grant administered by the Police Department; and, W~IEI~AS, the City of Petaluma has previously received a grant from the Office of Traffic Safety in the amount of $224,000 to assist in the purchase of a MCV for use in the Avoid the 13 anti-DUI campaign and the City of Petaluma has agreed to utilize these funds for a MCV; and, W~IEItEAS, the City of Petaluma has available $139, 327.52 in matching funds from the Asset Seizure account to purchase a MCV; and, W~I~REAS, the City of Petaluma, based on cost, specific vehicle features needed to comply with Office of Traffic Safety Avoid the 13 grant, the City of Petaluma's needs, and exte~nsive outreach to potential vendors and evaluation of vendor~ capabilities and MCV models; has identified LDV Inc., Burlington, Wisconsin to be a reputable and reliable vendor of a MCV; and, W~IEREAS, Petaluma Municipal Code section 4.04.100 provides an exemption from the formal contract procedures required by Chapter 4.04 when purchases of supplies or equipment are made under a cooperative purchasing program with anothex public agency using competitive process; and, WI~EREAS, Petaluma Police Department staff has obtained from LDV Inc., documentation contirming that LDV, Inc. possesses a competitively-awarded contract, t1.5. General Services Administration Contract No. GS-30F-0009L ("GSA Contract"); and, W~-IER~AS, LDV Inc., provided a list of MCVs sold to Police Departments throughout the United States utilizing the GSA pricing schedule; and W~IEREAS, the Petaluma Police Department selected LDV, Inc. model MCC302221- 09, as best serving the City's needs, pursuant to those certain "Specifications for Petaluma Police Department (CA) DUI Command Vehicle OTS Project AL0982 Avoid the 13 Sonoma County, LDV Model #MCC30~221-09" dated August 19, 2009, ("MCV Specifications"), a copy of which is attached as Exhibit A and made a part of this resolution, at a cost not to exceed $363,327.52; and, WHEREAS, Petaluma Police Department staff has confirmed that NICV model MCC302221-09 is furnished pursuant to and consistent with pricing established by the GSA Contract.
