ORDINANCE NO. 1711 N.C.S.

AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 NCS
BY RECLASSIFYING AND REZONING CERTAIN LANDS KNOWN AS
VILLAGE EAST III RESIDENTIAL .PROJECT
FROM P.C.D. (PLANNED COMMUNITY DISTRICT)
TO P.U.D.. (PLANNED UNIT DEVELOPMENT)
LOCATED ON THE EAST SIDE OF GARFIELD DRIVE
AT VILLAGE EAST AND WREN DRIVES
BE IT ORDAINED B;Y THE COUNCIL .OF THE CITY OF PETALUMA AS
FOLLOWS:
Section 1. The City Council. finds that the P~~ning Commission fiI"ed with
the City Council: on December 21, 1987, its report as set forth in its
minutes of December 8, 1987, recommending the adoption of an amendment
to Zoning Ordinance No. 1D72 N.C.S., by reclassifying the rezoning certain
lands being more partcuFarly described below from P.C.D. (Planned
Community District) to P . U . D . (Planned Unit Development) : A . P . No's .
017-260-44 and 017-270.-60.
Section 2. The City Council further finds that .said Planning Commission
held a public hearing on said proposed amendment to Zoning Ordinance No.
1072 N.C.S.:, on December $, 1987 after giving notice of said hearings in
the manner, for the period and in the form required by said Ordinance No.
1072 N.C.S.
Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072
N.C.S. , the City Council finds that the. proposed. amendment is in general
conformity with the Petaluma General Plan by providing density in
conformance with designation; and further, that the public interest,

convenience and general welfare will be . furthered by the proposed
amendment.
Section 4. The City Council .finds that the requirements of the California
Environmental Quality Act Guidelines have been satisfied and hereby
incorporates by refer-ence the Subsequent Environmental Impact Report
certified by the City Council on December 1, 1986.
Section 5. Thee :City. Council further finds that the'. requirements of the
California Environmental Quality 'Act Guidelines Section 15091 are hereby
satisfied by the incorporation of the following .:findings:
A. Traffic/Transportation/Circulation - Potential impacts were
identified as follows
1. Increase in traffic volumes both in the general vicinity and
on adjacent arterial roadways.. .
2. Increase in traffic safety problems for bike riders and
pedestrians. crossing local streets.
3. Cumulative increases in intersection traffic volumes.
The City Council hereby finds that the above impacts will be
substantially lessened by the following measures which have been
incorporated into 'the project::
1. All streets entering. Garfield- Drive shall be provided with
stop-sign controls (SEIR) .
2. Pr-ior to the issuance of the first building permit, the
developer shall contribute a fair-share contribution to
signalization improvements at the Ely boulevard/East
Washington Street and Ely Boulevard/Caulfield Lane
intersection. Fair share contribution .amount shall be based
on the project's prorated share . of the traffic using said
intersection, subject to review and determination of the City
Engineer .

3. Trucks and other heavy construction equipment traffic to
and from the. project -site shall be confined to East
Washington Street, Ely Boulevard, Casa Grande Road,
Caulfield Lane and Village East Drive.
B . Noise -Potential impacts were .identified as follows
1.. Subjection o'f re,sidents in~ proposed units to noises associated
.with operation of airport.
2. Subjection of existing residents to noises associated with
construction activity.
The City Council hereby finds that the above impacts will be
substantially lessened by the following requirements and restrictions
which have been incorporated into the project:
1. Noise mitigation measures shall be incorporated in home
construction per the SEIR (East of Ely) .
2. An Avigation Easement with buyers acknowledgement shall be
executed and. recorded for each lot in the project.
3. Hours of construction activity on the Village East III project `
shall be limited to the hours of 7 AM to 6 PM, Monday
through .Friday (non-holiday) .
C. Schools - A potential impact was identified as follows:
1. Cumulative impact to Old Adobe. School District enrollment
capacities.
The City Council hereby finds that the above impact will be
avoided by the following requirement which has been incorporated into
the project:
1. T:he developer shall be required to pay school facilities
impact fees to the Old Adobe School District subject to

Section 17.2.8 of the Petaluma .Municipal Code and approved
by the City Council. ~,
D . Drainage - .Potential impacts were identified as follows
1. Increase- in volume .and rate of surface runoff due to
coverage of ~ permeable soils with paved surfaces and
build. ings .
2. Temporary increase to soil. erosion rates and alteration to
existing drainage patterns during. site grading activities
associated with construction.
The City Council hereby finds that the above impact will be
substantially lessened by the following .requirements which have been
incorporated into the ,project:
1,. The developer shall comply with the amended Petaluma
.Municipal Code Sections 20.36-.010 and 20.36.020 which
require' the developer to pay storm drainage impact fees. (as
calculated in. Chapter 17.30) on construction in all sections
of the City of. Petaluma.
2. The storm drain in Garfield Drive shall be extended to the
easterly property boundary.
3. No off-si.te grading shall be permitted without express
written consent of adjacent property owners .
4. The cut-off ditch located on the: adjacent property along the
north. easterly boundary is not acceptable as shown. It shall
be designed and installed as a permanent system . This
drainage control shall consist of an underground pipe system
with surface concrete "v' ditch and inlets . A berm shall
also be provided between the ditch and adjacent to the
backyard .fence. This berm. is required so as to avoid any
filling of the ditch . An equivalent alternative solution to
this drainage problem, may at the discretion of the City
Engineer, be substituted for the recommendation above.

5. Off-site storm drainage facilities shall be developed to
accommodate. drainage from this area in conformance with and
to thapproval of, the Sonoma County Water Agency.
6. Prior to the issuance of any foundation permit, lot pad
elevations shall be certified by a registered Civil Engineer or
Land Surveyor.
E. Municipal Services - The potential impacts were identified as
follows
1. Water pressure availability.
2. Fire Hazard; -increase fire hazard in dry summer months due
to proximity to adjacent open space areas.
3. Parks and recreation = increase demand for neighborhood
and, comm:uriitypark facilities.
4. Energy
The City

lessened by the incorporation of the following
1. All houses. constructed above elevation . sixty feet may require
a water pressure system installed for eaoh unit to maintain
adequate. house pressure. Water pressure calculations must
be submitted with the final rnap to verify that adequate
domestic pressure can be obtained.
2. Fire hydrants shall be located as required by the Fire
Marshal.
3. Prior to approval of a final map, the developer shall submit
a plan for energy conservation. measures to be incorporated
into the project, subject to review and approval of City
staff.
4. The project sponsor shall develop a plan for installation of
fences to help deter trespass by project residents into
adjacent agricultural areas, subject to review and approval
of SPARC.
F. Archaeological - A potential impact was identified as follows:

1. Possibility of discovering and damaging.; subsurface
.prehistoric and/br historic archaeological materials within the
project boundaries.
The City Council hereby finds that the .above impact will be
avoided by the halting of construction. in any area upon the findings
of artifacts of an archaeological' nature and ,the hiring. of a qualified
archaeologist to evaluate the finds. Mitigation measures prescribed by
t'he: arehaeo,logist~-and' required~~ b;y the: City ~~should be undertaken prior
to resumption of construction activities .

G. ~ Geology/Soils - A potental° impact was identified as follows
1. Potential of differential movement of foundation material and
cracking of pavements and. foundations from movement of
expansive clay soils.
The City Council hereby finds that the above impact will be
substantially lessened by the preparation. .of soil investigation reports,
subject to review and approval of the City Engineer, and the
following;
1. Any retaining walls constructed on property lines over 2 feet
(measured from. bottom of footing.) shall be of concrete or
masonry material.
2. Soils with expansion index greater than 20, requires special
design foundation , U . B . C . 2904.(b) .
Section 6. Pursuant. to the provisions of Zoning Ordinance No. 1072
N.C.S., and based upon the evidence it has received and in accordance
with the findings made,. the City Counci`1 hereby adopts an amendment to
said Zoning. Ordi-Hance No. 1072 N. C. S . , so as to reclassify and rezone said
property hereinbefore referred to in accordance. with the recommendation of.
the Planning Commission.

Section 7. The City Clerk is hereby directed to post this Ordinance
for the period and in the manner required by the City Charter.
