Introduced by Councilman Seconded by Councilman Brian Sobel Lynn Woolsey AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND REZONING PHASE 1, ASSESSOR'S PARCEL NUMBERS 00?-421-07,08,12; 047-211-21, 22 AND PREZONING PHASE 2, ASSESSOR'S PARCEL. NUMBER 047-211-12, COLLECTIVELY KNOWN AS REDWOOD BUSINESS PARK II TO PLANNED COMMUNITY DISTRICT (PCD) BE IT ORDAINED by the Council of the City of 'Petaluma as follows: Section 1. The City Council finds that the .Planning Commission filed with the City Council on April 6, 198.7, its report as set forth in its minutes of March 10, 1987 (Item No. 3...354) , recommending the adoption of an amendment to Zoning Ordinance. No. 1072 N.C.S. , as amended, by reclassifying and rezoning certain lands being more particularly described as Assessor's Parcel Numbers 007-421-08, 12; 047-211-21 and 22 and prezoning Assessor's Parcel Numbers 00?-421-07 and 047-211-12 from Highway Commercial.., Light Industrial and Floodplan Combining to PCD (Planned Community District..) /F1oodPlain Combining (FP-C) . Section 2. .The City Council further finds that said Planning Commission :held public hearings on said proposed amendment to Zoning. Ordinance No. 1072 N . C . S . , as amended, culminating on March 10, 1987 after giving notice of said hearings in the manner, for the period , and in the, form required by said Ordinance No. 1072 N . C . S . , as amended,. and. has received written information ;from interested parties. 1pR.~.16~3NC~ Minutes of the.. public hearings as well as all' written .information have been received and reviewed by the Council. Section 3. Pursuant `to the provisions of Zoning Ordinance No. 1072 N.C.S. , as amended, the City Council .finds the proposed amendment in general conformity with the Petalurria General Plan, and. further, that the public interest, convenience and general welfare will be furthered by the proposed amendment. Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S. , as amended, and based upon the evidence it has received and in accordance with the findings made., the City Co uncil hereby adopts amendment to said Zoning Ordinance N o . 1072 N . C . S . so as to reclassify and rezone said property hereinbefo re referred to in accordance with the recommendation of the Planning Commission. Section 5. The City Council further finds the requirements of the California Environmental Quality Act Guidelines' Section 15091 are satisfied because changes or alterations have been required in or incorporated into the project which avoid or substantially -lessen the potentially significant environmental effects identified in the EIR and further identified in the following findings:' A. Traffic.. T.he City Council hereby finds that potentially significant impacts to traffic circulation will be substantially lessened by all of the following measures which have been incorporated into the. project: 1. On and off-site improvements to roadways, including pedestrian ways, signalization, road widening, signing and raised medians to control traffic. 2. Limitation of vehicular access on Old Redwood Highway and Denman Road. 3. Improvements for mass transit. 4. Accommodations for emergency vehicles. 2 ®~~: 16 ~ 3 N C S 5. Participation in widening of Willow Brook Bridge, Old Redwood Highway, Corona Road and Rainier Avenue US 101 overpasses. 6. Phasing of project bui ldout to coincide with road improvements to maintain at least current levels of service at critical intersections. 7. Renaming of road segments. 8. Provisions for directional signs to aid the free flow of traffic . B. Flood/.Drainage. The City Council hereby finds that potentially significant impacts to the site's water runoff and corresponding effects to areawide flooding due to installation of impervious surfaces and fill have been substantially lessened by all of the following measures which have been incorporated into the project: 1. Detention basin system that will contain all projected 100-year base flood waters identified with the site, increased runoff caused by soil compaction and new impervious surfaces, and displacement caused by development. 2. Reservation of easements for potential future flood mitigation projects, e. g. Willow Brook rechannelization or diversion channel. 3. Grading, to Sonoma County Water Agency design criteria. 4. Participation in all regional flood control projects affecting or affected by the project. C. Creeksde Protection. The City Council hereby finds that potential adverse effects to significant natural features of the site have been. substantially lessened by the following measures which have been incorporated into the project: 1. 1V1'aintenance access to the creek. 2 . Protection of all fir trees . 3. Replacement planting program in the event that the creek is widened as part of a regional. flood control measure. 3 ~R,.16 S 3 N C S 4. Review and conditional approval. by the Site Plan and Architectural Review Committee. D. Interface of Land Uses. Thee City Council hereby finds that potentially significant effects of creating intensive urban uses proximate to existing rural lands will be substantially lessened by the following mitigation measures which have been incorporated into the project: 1. Substantial landscape buffer zones. 2 . Protection of hilltop . 3. Noise mitigation and performance standards . 4. Zoning restrictions on more objectionable uses. 5. Eliiniriation of project veYicular access. to Denman Road. 6. Flood mitigation. measures as listed in 'subsection B, above. 7. Project. and individual building ,review by the Site Plan and Architectural: Review Committee: 8. Mitigation of pest problems associated with permanent ponds. E. Archaeological. The City Council hereby finds that the possibility of discovering and damag-ing subsurface prehistoric and/or historic archaeological materials within the project boundaries will. be avoided by the halting of construction in any area upon the finding of any artifacts of an archaeological nature and the hiring of a professional archaeologist to inspect the find to determine the nature and significance of the find and if full retrieval., partial retrieval, or preservation is warranted. Section 6. The City Council finds that the requirements of California Environmental.: Quality Act have been satisfied by Resolution No. ~~~- N.C.S. and hereby incorporates by reference the Environmental.. Impact Report prepared for the project site. Section 7. The City Clerk is hereby directed to post this ordinance for the period and in the manner required by the City Charter. 4 ORS. 16.8 3 N'C INTRODUCED and ordered posted this 13,th day of April, 1987.
