OF THE PETALUMA MUNICIPAL CODE BY .AMENDING SECTIONS 17.14.020A, 17.14.0`2002, 17,14.0.30 and 17.14.040 THEREOF AND BY ADDING SECTION 17.14.045 BE IT .ORDAINED BY THE CITY, OF PETALUMA .AS FOLLOWS: Section 1. Section 17.1.4.. 02QA is hereby, amended, as follows A. "Development" means: ...construction ~:of a new structure or addition to a_ non-residential structure, addition of one or more residential dwelling units on a developed parcel, except an accessory dwelling as defined by the Zoning Ordinance., or division of land. Section 2. Section 17.14.02.002 is hereby amended as follows: 2. All other developments, except those defined in subsections 3 and 4. Section 3. 17.14.030 is hereby amended. as follows: Every person constructing or causing to be. constructed any project within the City shall. pay to the City a fee computed as set out in this chapter. These fees shall be in addition to all other development fees required by City .Ordinance. Section 4 . 17.14.040 is hereby amended as follows A. In the case of residential development, the fee to be charged shall be One thousand. One Hundred fifty-five dollars ($1,155) per dwelling unit or Five thousand seven hundred seventy-five dollars ., . ($5,775) per acre whchever•`s more: The charge per acre shall be computed. to _the nearest tenth of an acre including streets and 4 lands ,to b:e dedicated' to the public or held in common ownership and shall be 'calculated on the basis of each dwelling unit constructed,, with the per-unit fee being determined by dividing the total number of dwelling units within the project into the total amount due from the project. B . In the case of nonresidential development, the fee for new development shall be Sixteen Thousand one hundred seventy dollars (:$16.,170) .per acre and for building additions shall be $1.2.4 per square. foot of building floor area including all floors of a multi-story building and including mezzanine areas. Section 5 . 17.14.045 is hereby added as follows 17.14.041. Adjustment. of Fees. The fees specified herein shall be adjusted . annually based upon the upward or downward movement of the Consumer's Price Index for all. Urban Wage Consumers, San Francisco. - Oakland, California, all items - Series A. (1967=100) (index) publsYied by the U.S. Department. of Labor, Bureau of Labor Statistics for any change above or below the January 1, .1.980 figure: In the event the foregoing index is no longer puljlished, a comparable index will be used. Section 6. This ordinance is hereby declared to be necessary for the immediate preservatn of the public peace, .health., welfare and safety and shall take effect; and be in force upon its passage 'by a unanimous vote of the members of the City Council present at the: time of its adoption . "; .' .; , Imposition of said increased fees shall take effect on March .17, 1987 at 8:00 AM. Fees for building permits filed prior to March 17, 1987 at 8:00 AM shall b:e calculated at the old rate. The reason for the emergency is that any delay in passage will mean the probable loss of thousands of dollars in fees necessary to secure needed community facilities in quantities specified by the: City General Plan and declared to be necessary to insure the public peace, health, welfare and safety.
