RESOLUTION AUTHORIZING THE AWARD OF CONTRACT FOR THE LUCCHESI
SKATEPARK (PHASE ONE) PROJECT (C14402215) TO BAUMAN LANDSCAPE AND
CONSTRUCTION COMPANY, INC. AND CONSENT TO SUBCONTRACTOR SUBSTITUTION
(GRINDLINE TO CALIFORNIA SKATEPARKS) PURSUANT TO PUBLIC CONTRACT CODE
SECTION 4107
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section
20162, and other applicable laws, City staff prepared construction bid documents and solicited bids for the Lucchesi Skatepark
(Phase One) Project (C14402215) (“Project”); and
WHEREAS, the Project was bid on December 12, 2025, and five (5) bids were received and opened on January 21, 2026,
in accordance with applicable law; and
WHEREAS, the lowest responsible and responsive bid for the Project was submitted b y Bauman Landscape and
Construction Company, Inc., of San Rafael, California, for a base bid amount of $2,709,016; and
WHEREAS, City staff has confirmed that Bauman Landscape and Construction Company, Inc. satisfies all bidding
requirements for the Project and possesses a valid California Contractor’s License (#372478) qualifying them to perform the
required work; and
WHEREAS, Public Contract Code section 4107 authorizes a prime contractor, upon proper grounds and with the consent
of the awarding authority, to substitute a listed subcontractor; and
WHEREAS, Bauman Landscape and Construction Company, Inc. has requested, pursuant to Public Contract Code section
4107, consent to substitute California Skateparks in place of Grindline as a listed subcontractor; and
WHEREAS, City staff has reviewed Bauman Landscape and Construction Company, Inc.’s request and supporting
information and has determined that sufficient grounds exist under Public Contract Code section 4107 to approve the requested
substitution, and that the substitution will not increase the contract price; and
WHEREAS, no protests to the bid were received, and the deadline to file a protest has lapsed; and
WHEREAS, the Lucchesi Skatepark Project has been evaluated in accordance with the California Environmental Quality
Act (“CEQA”) and qualifies for a categorical exemption pursuant to CEQA Guidelines Section 15332 (Class 32 – In-Fill
Development); and
WHEREAS, a Notice of Exemption was filed with the Sonoma County Clerk on January 15, 2025, and the statute of
limitations under CEQA has expired; and
WHEREAS, in accordance with Government Code Section 830.6, Petaluma Municipal Code Section 3.04.065, and the
February 4, 2026 memorandum signed by the Director of Public Works, the City has the authority and discretion to approve
plans, specifications, and designs for public works projects; and the City’s authorized designee has reviewed the plans,
specifications, and designs for the Lucchesi Skatepark Project (C14402215), as well as the Reasonableness Memorandum
attached hereto as Exhibit A, and finds the designs to be reasonable based on the designee’s education, experience, and training;
the preparation of the plans by licensed landscape architects and civil engineers specializing in skatepark design; consisten cy
with applicable civil engineering and skatepark industry standards; the reputation and qualifications of the design team;
consultation with other engineers and knowledgeable staff; and review of site conditions and available data; and

WHEREAS, the location, type, and amount of warning devices were considered as part of the reasonableness of the design
and believe the location, type, and amount of warning devices are reasonable because the skatepark will include appropriate
regulatory signage and safety messaging, including reference to Petaluma Municipal Code Section 11.76.050; and
WHEREAS, the Project involves construction of a skate park facility within Lucchesi Park that will be operated as a City
of Petaluma skate park facility subject to the safety requirements set forth in Petaluma Municipal Code Section 11.76.050,
which requires the use of protective equipment including helmets, knee pads, and elbow pads while using a City skate park
facility; and
WHEREAS, sufficient funding is available within the Lucchesi Skatepark project budget (C14402215) to award the Phase
One construction contract.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows:
1. Finds the above recitals to be true and correct and incorporates them as findings of this Resolution.
2. Finds that the Project is categorically exempt from CEQA pursuant to CEQA Guidelines Section 15332.
3. The City Council finds that sufficient grounds exist under Public Contract Code section 4107 to approve Bauman
Landscape and Construction Company, Inc.’s request to substitute California Skateparks in place of Grindline as
a listed subcontractor for the Project.
4. Pursuant to Public Contract Code section 4107, the City Council hereby consents to the substitution of California
Skateparks in place of Grindline as a listed subcontractor under the contract awarded to Bauman Landscape and
Construction Company, Inc. for the Project.
5. Awards the contract for Phase One of the Lucchesi Skatepark Project (C14402215) to Bauman Landscape and
Construction Company, Inc., in the amount of $2,709,016, conditioned on Bauman Landscape and Construction
Company, Inc.’s timely execution of the project contract and submission of all required documents, including but
not limited to executed bonds, certificates of insurance, and endorsements, in accordance with the project bid
documents.
6. Directs staff to issue a Notice of Award to Bauman Landscape and Construction Company, Inc.
7. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon
timely submission by Bauman Landscape and Construction Company, Inc. of all required documentation in
accordance with the bid specifications.

Under the power and authority conferred upon this Council by the Charter of said City.
REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by the
Council of the City of Petaluma at a Regular meeting on the 6th day of April 2026,

In accordance with Government Code Section 830.6, Petaluma Municipal Code Section
3.04.065, and the February 4, 2026, memorandum authored by Director of Public Works,
Paul Kaushal, P.E., I have the authority and discretion to approve plans, specifications, and
designs for Public Works projects. I have reviewed the plans, specifications, and designs
for the above-referenced project and find them to be reasonable based on the following:
a. Based on my education, experience, and training.
b. The plans and specifications have been developed by licensed landscape
architects who specialize in skatepark design as well as licensed civil engineers.
c. The designs meet current civil engineering and skatepark industry standards.
d. The plans were developed by a reputable firm that specializes in these types of
projects.
e. Discussions, reviews, and opinions of other engineers and knowledgeable staA.
f. My review of the site location and available data regarding the site.
g. The skatepark is subject to Municipal Code Section 11.76.050.
h. Skateboard park use is recognized by the state of California as a Hazardous
Recreational Activity. Additionally, some other wheeled devices are also
categorized as Hazardous Recreational Activities.
i. Signage for the new skatepark facility will include applicable regulatory notices,
such as reference to Municipal Code Section 11.76.050, as well as industry
standard safety and code of conduct messaging.
