Seconded by BRIAN SOBEL AN ORDINANCE AMENDING TITLE 11, CHAPTER 11.76 OF THE PETALUMA MUNICIPAL CODE PERTAINING TO THE USE OF SKATEBOARDS IN THE CITY OF PETALUMA BE IT ORDAINED by the Council of the City of Petaluma as follows: SECTION 1. Chapter 11.76 entitled "Skateboards" is hereby amended in its entirety to read as follows "CHAPTER 11.76 SKATEBOARDS 11.76.010 Restrictions on Use of Skateboards 11.76.020 Prohibition on Use of Skateboards 11.76.030 Penalty for Violations 11.76.010 Restrictions on Use of Skateboards. It is unlawful for any person to skate, or use, or ride any skateboard or other similar device on or over any public streets, bridge, underpass, sidewalk, sidewalk space, park, public pedestrian walkway or publicly owned parking facility within the city limits, in violation of the following restrictions: A. Such use shall not occur after sunset of one day and before sunrise of the following day, unless the user is wearing reflective material. B. Persons riding skateboards on streets shall ride as near to the right side of the street as practicable. C. No 'person riding a skateboard shall attach the same or ORDINANCE NO. himself or herself to any other vehicle . ,. - ., D . Persons riding skateboards shall yield the right-of-way to all motor vehicles and pedestrians. E. No person shall ride a skateboard when approaching or upon the crest of a grade or a curve in a street, where the view of such person is obstructed within such distance as to create a hazard from an approaching motor vehicle. F. Except as hereinabove provided, any person riding a skateboard shall be subject to all of the duties applicable to a rider of a bicycle, as provided by California Vehicle Code Section, 21200. 11.76.020 Prohibitions on the Use of Skateboards It is unlawful for any person to skate, or use, or ride any skateboard or similar device upon or over any public street, bridge, underpass, sidewalk, sidewalk space, park, public pedestrian walkway, or publicly owned parking facility in the central business district, or in those shopping centers within the city limits as defined and listed herein. The term "central business district" shall mean that area within the following described boundaries: The intersection of Washington Street and Water Street, south on Water Street to Western Avenue (north side of Petaluma Mill) ; west on Western Avenue to Petaluma Boulevard; south on Petaluma Boulevard to "D" Street; west on "D" Street to Fourth Street; north on Fourth Street to the center of "B" Street; west along the centerline of "B" Street to the center of Keller Street; north along the centerline of Keller Street to the center of Washington Street; east along the centerline of Washington Street to Water Street. Ord. 1652 NCS 2 ~. ~ ~ Those "shopping centers" included herein shall have the meaning given to "shopping centers" as described in Section 1-203 of Petaluma Zoning Ordinance No. 1072 N.C.S. , which is "Shopping Center." Any combination of five (5) or more separately owned and operated retail businesses on a single or commonly owned or leased parcel of land, or a commercial use or commercial complex occupying a site of at least two (2 ) acres." Those shopping centers are listed as follows Great Mill Payless Golden Eagle Hagstroms Petaluma Plaza Petaluma Plaza North Washington Square Town and Country 11.76.030 Penalty for Violation Any violation of any of the provisions of this chapter shall be punishable as provided in Section 1.04..060 of the Petaluma Municipal Code." SECTION 2. The City Clerk is hereby directed to post/publish this ordinance for the period and in the manner required by the City Charter.
