AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S.
BY AMENDING THE ZONING MAP FOR LANDS OF PERRY
(A.P. NOS. 137-060-41 and 42,
LOCATED NORTHERLY OF CAPRI CREEK CHANNEL)
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
Section 1. The Council finds that the General Plan Environmental Design
Plan land use configuration was duly amended by the City Council in 1984
for the two subject properties, A.P. Nos. 137-060-41 and 42 to increase the
area of R-1 6500/FP-C (Single-Family Residential/Flood Plain) and decrease
the area of C-O/FP-C (Office Commercial/Flood Plain) in order to achieve a
more coherent development pattern with adjacent properties.
Section 2. The City Council finds that the Department of Community
Development and Planning initiated a rezone action to achieve conformity
between the zoning map and amended General Plan/EDP land use and
circulation map .
Section 3. The City Council further finds that Planning Commission held a
public hearing on said proposed amendment to Zoning Ordinance No.
1072 N.C.S. on November 26, 1985 after giving notice of said hearing in the
manner, for the period and in the form required by said Ordinance No.
1072 N.C.S.
Section 4. The City Council further finds that said Planning Commission filed
with the City Council ~on December 16, 1985 its report as set forth in its
minutes of November 26, 1985 regarding the proposed Zoning Map
amendment .
Section 5. The City Council finds that the requirements of the California
Environmental Quality Act have been satisfied inasmuch as the proposed
amendment is exempt pursuant to CEQA Guidelines Section 15301, Class 5.

Section 6. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S. ,
and based upon the evidence it has received and in accordance with the
findings made, the City Council hereby adopts an amendment to said Zoning
Ordinance so as to amend the zoning pattern on said property hereinbefore
referred to and located between the Capri Creek channel, Capri Creek
subdivision, Maria Drive (proposed) , and McDowell Boulevard North as
shown in attached Exhibit "A" , referred to and made a part hereof , in
accordance with the recommendation of the Planning Commission.

Section 7. The City Clerk is hereby directed to post/publish this ordinance
for the period and in the manner required by the City Charter.
