AN ORDINANCE AUTHORIZING TRANSFER OF PROPERTIES
IN CONNECTION WITH MADISON MANOR
FLOOD RELOCATION PROJECT AND
DECLARING THE URGENCY THEREOF
TO TAKE EFFECT IMMEDIATELY.
BE IT ORDAINED by the Council of the City of Petaluma as follows:
Section 1. The real property located at 2 Rio Vista Way, known as
Lot 12 (A.P. 007-650-12), formerly owned by Mark and Connie Peabody is
hereby transferred to and accepted by the City of Petaluma in accordance
with the terms of that certain agreement, dated April 25, 1985, by and
between the City of Petaluma and the aforesaid Mark and Connie Peabody.
Section 2. The real property located at 6 Rio Vista Way, known
as Lot 6 (A.P, 006-019-24), formerly owned by Virginia Gibbs is hereby
transferred to and accepted by the City of Petaluma in accordance with the
terms of that certain agreement, dated April 22, 1985, by and between the
City of Petaluma and the aforesaid Virginia Gibbs.
Section 3. The real property located at 6 Vallejo Street, known as
A.P, No. 7-042-16, formerly owned by Ellen L. Swenson and Wayne T.
Farris, is hereby transferred to and accepted by the City of Petaluma in
accordance with the terms of that certain agreement, dated April 29 , 1985 ,
by and between the City of Petaluma and the aforesaid Ellen L. Swenson
and Wayne T . Farris .
Section 4. If any section, subsection, sentence, clause or phrase
or word of this ordinance is for any reason held to be unconstitutional by a
court of competent jurisdiction, such decision shall not affect the validity of
the remaining portions of this ordinance. The City Council of the City of

Petaluma would have passed and adopted this ordinance and each and all
provisions thereof irrespective of the fact that any one or more of said
provisions be declared unconstitutional.
Section ~. This ordinance is hereby declared to be necessary for
the immediate preservation of the public peace, health and safety and shall
take effect and be in force upon its passage by a unanimous vote of the
members of the City Council present at the time of its adoption. The
reason for its urgency is the necessity for the authority for the City to
accept the property.
Section 5. The City Clerk be, and she is hereby directed to
publish/ post this ordinance for the period and in the manner required by
the City Charter.
