SECONDED BY COUNCILMAN Cavanagh AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S. BY PREZONING A.P. #17-050-04, 17-050-05, 17-150-11, AND 17-030-17. LAKEVILLE HOMES AND GOLF COURSE ANNEXATION aka DUFFEL AND OLD LAKEVIL.LE ANNEXATIONS. located in the vicinitv of Frates Road and Ely Blvd. So. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section I.The City Council finds that the Planning Commission filed with the City Council on January 7, 1985 its report as set forth in its minutes of November 13, 1984 (Item No. 3.301 and 3.314) , recommending the adoption of an amendment to Zoning Ordinance No. 1072 N.C.S., by prezoning Assessor's Parcel Numbers 17-050-04, 17-050-05, 17-150-11(portion), 17-030-17 as follows: A. AP 17-050-04 and. 17-050-05: R1-40,000 (one dwelling unit per 40,000 square feet of land area) for area above the 60 foot contour line and R1-8,000 for the area below the 60 foot contour line, Exhibits A & B . B . AP 17-150-11(portion) and AP 17-030-17 to STUDY, Exhibit C . Section 2. The City Council further finds that said Planning Commission held a public hearing on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., on November 13, 1984, after giving notice of said hearing in the manner, for the period and in the form required by said Ordinance No. 1072 N.C.S. Section 3 . Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., the City Council finds that the proposed amendment is in general conformity with the Petaluma General Plan and its Environmental Design Plan Element, and further, that the public interest, convenience and general welfare will be furthered by the proposed amendment. The City Council finds that the requirements of California Environmental Quality Act Guidelines have been satisfied and hereby incorporates by reference the Final Environmental Impact Report certified by Resolution No. 85-7 NCS N.C.S. Section 5 . Pursuant to the provisions of Zoning Ordinance No. 1072 N . C . S . , and based upon the evidence it has received and in accordance with the findings made, the City Council hereby adopts an amendment to said Zoning Ordinance No. 1072 N . C . S . , so as to reclassify and prezone said property hereinbefore referred to and. as depicted in the attached Exhibit D in accordance with the recommendation of the Planning Commission. Section 6. The City Clerk is hereby directed to post this ordinance for the period and in the manner required by the City Charter. INTRODUCED and ordered posted this 7th day of January , 1985.
