Hamilton, Keller, Maguire joined the Council during Closed Session PUBLIC COMMENTS Vasco Brazil, 4551 Lakeville Highway, voiced concerns about the City's potential acquisition of the Gray Property. CLOSED SESSION City Attorney Richard Rudnansky announced the following items to be heard in Closed Session: CONFERENCE WITH LABOR NEGOTIATOR, Pursuant to Government Code Section 54957.6, Unit 7, Fire. Agency Negotiator: Acorne/Beatty/Krout. CONFERENCE WITH REAL PROPERTY NEGOTIATOR Pursuant to Government Code Section.54956.8. Property: 4104.Lakeville Highway, APN's 017-170-002 and 068=010-026. Vol. 34, Page 50 November 1, 1999 1 2' 3 RECONVENE 4 5 The meeting reconvened at 3:20 P.M. in the Council Chambers. 6 7 Mayor Thompson' announced there was no reportable action taken on Closed' Session 8 items. 9 10 ROLL CALL 11 12 Present: Cader-Thompson, Hamilton, Healy, Keller, Maguire, Thompson, Torliatt 13 14 Absent: None 15 16 Mayor Thompson thanked the'public for their patience as the meeting didn't begin on time. 17 18 PUBLIC COMMENTS 19 20 Robyn McCorkle Weinstock, 101' Post Street, spoke regarding asphalt patches on concrete 21 sidewalks on behalf of .Post, Upham, `B' Street, Bassett, and 6th Street residents. She 22 presented a petition, pictures, and some Fetters from residents who wanted to know when 23 the sidewalks were to be fixed,. She was in favor of a long-term solution. 24 25 Geoff Cartwright; 56 Rocca 'Drive, spoke regarding fill in the floodplain/floodway. 2:6 2.7 .Diane Reilly -Torres, 1657 Rainier Avenue, expressed gratitude. for the efforts of Officer 28 Mike Vail towards the community. 29 30 COUNCIL COMMENTS 31 32 Council Member Matt Maguire spoke with Chris Sampson regarding Bryant Moynihan's 33 recent article in Argus -Courier Mike Ban had responded to seven issues; he preferred 34 staff send a response to the Argus: 35 36 Vice Mayor- Keller supported that and agreed for help staff draft the response. 37 38 Council Member Healy announced that members of the Planning Commission received 39 information about a'half-day planning seminar in December at'Sonoma State University. 40 Topics included Affordable Housing in the Bay Area and ^issues surrounding SMART 41 growth actions. He asked the copies bedistributed to Council Members. 42 43 44 Council Member Cade r-T,ho.mpson had learned that SPARC had approvedlandscaping on 45 Corona Road by the PG&E substation and in the Corona Creek area. Council Member Maguire noted concern that Supervisor Tim Smith had announced he wanted'to have Jean Kapolchok appointed`Open Space Land Use Commission;. she was a Planning Consultant Who had worked for Peter Pfendler over the years. He spoke with Mike Kerns and had not heard back. Vice Mayor Keller wanted a letter written to Supervisor'S`mith and copied to the rest of'the Board in opposition to the appointment. City Manager Stouder asked Council Member Cader-Thompson, regarding her remarks about the landscaping on Corona road, if the Council wanted to bring this back for review before any work was done. Council Member Cader=Thompson replied yes. Council Member Torliatt asked City management to respond to Robyn McCorkle. Weinstock's concerns. Council Member Cader Thompson received a letter of the opinion that the City Manager had too much control on the'Lok proposal_and assured the community that the Council was, aware of what was going on. PRESENTATIONS/PROCLAMATIONS Mayor Thompson read a Proclamation for National Animal Shelter Appreciation Week. to Animal Shelter Manager, and presented it to Animal Shelter'Manager, Nancee Tavares. Nancee Tavares brought a.dog availablefor adoption at the�Animal Shelter and announced the Shelter's Open House .on November 14. Mayor Thompson read a Proclamation to IKON in Appreciation of IKON's Donation of Office Furniture to't'he City of.Petaluma and presented -it to:.Marketplace President, Mark J. Le Blank, and Branch Manager Dennis 'Krassig,, BranchManager. Mayor Thompson read a Proclamation recognizing Po9ice Officer Mike Vail for Exemplary Performance and read a letter of .recognition :naming Officer Mike Vail as Employee of the Quarter. He presented the proclamation, letter, and presented Officer Vail with a check in the amount of $100.00 as aIcash award for being selected Employee of the Quarter. COUNCIL LIAISON AND CITY MANAGEMENT REPORTS: Council Member Healy commented about the Planning Commission's discussion re signs. Council asked that the Planning ,Commi;ssion prepare a report stating the problem and recommending ,solutions for Council to review: Council Member Torliatt, announced recent and upcoming Association. of Bay Area Governments (ABAG) and Bay Area Air Quality Management District (BAAQMD) meetings. Council concurred to move the meeting scheduled for November 10 to November 8. City Manager Fred jSto.uder assured Council that announcements would be mailed to. interested parties to that effect. Council Member Cader-Thompson wanted consideration given to expand the scope of the committee's mission. MOTION: Council Member Keller moved, seconded by Hamilton to adopt Resolution 99=211 N.C.S. Accepting the Resignation of.Ann,Amyesr from the Tree Advisory Committee. MOTION PASSED: 7/0/0 4. Resolution Authorizing Street Closures in the Downtown Area for the Purpose of Facilitating the Annual Veterans Day Parade. Council Member Torliatt wanted City management to make sure the names of the streets along the parade route were, included in future accompanying staff reports. Vice Mayor Keller wanted City management to make sure the City was getting its fair share of taxes from vendors set up for special functions such as this parade.. MOTION: Council Member Torliatt moved, seconded by Cader- Thompson to adopt Resolution 99-2112 N.C.S. Authorizing Street Closures in the Downtown Area for the Purpose of Facilitating the Annual Veterans Day Parade. MOTION PASSED: 7/0/0 5. Resolution Declaring 1979 Fire Department Pick -Up Truck Surplus-. Council Member Torliatt wanted a report back on how the situation was going to be handled, a solution, sooner rather than later. PUBLIC- COMMENTS Reggie The Butcher (Reginald Leipsic), 855 South McDowell Boulevard, spoke in opposition to prohibiting gifts to City employees. Kelly Beck, 872 Holly Lane (Twin_.Creeks Subdivision), spoke regarding the landscape assessment district care and presented Council with a petition. Kim Johnstone,:423 King Road (Youth Sports);, spoke in favor of leaving the McNear lights where they are for the youth of the community. Geoff Cartwright, 56 Rocca Drive, spoke regarding the serious flooding problem in Petaluma, the out of date FEMA Flood control maps. and landfill located in the area of Petaluma Boulevard North. Terence Garvey, 83 Maria Drive, spoke in opposition to. the City's Domestic Partners Ordinance. Vince Landof, 12 Cordelia-Drive, spoke regarding the plaque located at.Payran and not yet located at Lakeville bridges to read that it had been bought and paid for by the people of Petaluma. Hank Flum, 172.1 Stonehenge Way, spoke regarding the climbing Animal Shelter budget. He gavea presentation based on a letter and drawings submitted to Council with this week's packet. Bryant Moynihan, Box C, presented Council with a:copy of the petition to'widen Hwy 101, a Measure on the November ballot. :He,also addressed items that City Management wrote.a rebuttal to from a guest commentary that he had been a participant. Troy Unger, 104 Vista View Place, spoke regarding Sunnyslope Road stop signs. Mayor Thompson requested that Mr. Unger be contacted and noticed of any upcoming meetings regarding Sunnyslope. Bob Green, who lives on the west side of Petaluma, spoke in support of Mr. Johnstone's earlier comments and in general of preserving sports on the west side of town. COUNCIL COMMENTS Council Member Keller: Vol. 34, Page 56 November 1, 1999 1 • Referred to Kelly Beck's comments regarding"Twin Creeks and asked'for an answer 2 from City Management to satisfy legaf requirements and then process. . 3 • Regarding sustainability; he had :a brief meeting with the Natural Step (TNS) and 4 they had expressed interest to participate is a community forum. He was pleased 5 that the Chamber was on the same track and noted an article in the Chamber's 6 newsletter. 7 Noted that he had distributed a paper on floodplain management websites to the 8 Council and named specifically a DOE site: Hsustainable.doe. gov / amrivers.org. 9 10 Council Member Cader-Thompson: 11 • Noted that Thompson Luke Broxmeyer wo-rked at. Mattei's for 50 years.. 12 • Referring to land fill concerns raised by.Geoff;Cartwright, she wanted thle address 13 and ownership of the location of the property to which he referred. 14 • Announced -that Petaluma Community Access (PCA) was featuring Women's. 15 History and she had been asked to participate: 16 • Announced that°films would be shown at City -Hall on Fridays at 7:00 P.M., -and that 17 Beth Meredith had asked her to, announce•scheduled programming. 18 19 Council Member Torliatt: 20 • Asked the City Manager to provide 'a brief explanation about why City employees 21 cannot receive: gifts. 22 • Noted, that. she hada discussion with Ed Anchordoguy regarding the money 23 received from Twin Creek-residents1hat,had .been collected through.an.assessment 24 and reserved. She understood .it was time for the, developer to move forward and 25 wanted to know if the .City had performance bonds. 26 27 28 29 • Announced that- the lighting at Prince Park had been approved by the.- Federal 30 Aviation Administration (FAA) for_lighting.. 31 • Regarding Sunnyslope, she understood that the item was scheduled to go back to 32 the Traffic Committee. 33 34 City Manager Fred Stouder clarified that the subject would come to Council first and then 35 go to the Traffic Committee. 36 37 Council concurred. 38 39 Council Member Healy: 40 • Wanted .City Management to provide a report to the `Council regarding Twin Creeks 41 Landscape_ Assessment District. 42 • Wanted the Council, to revisit the issue, of taking the. lights down at,McNear`Park in 43 order to preserve lighted ball fields for the west side ,of Petaluma. 44 • He noted as letter from Council Member Keller he had received in the packet; and 45 noted it was timely. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 November 1, 1999 Vol. 34, Page 57 • He had prepared a draft document and submitted it to Council for review and comment. Council Member Maguire: • Noted there had been discussion at the Park and Recreation Commission about revisiting the lights at McNear. He would ask Jim Carr to address it. Mayor Thompson: • Asked City Management to improve the lighting at Rainier and McDowell. • He asked City Management to notify Mr. Unger of any, discussions and meetings regarding Sunnyslope. PRESENTATIONS Director of Engineering Tom Hargis commended the efforts of PCA and presented a video they had produced that made a public service announcement for the residential toilet giveaway. Mayor Clark Thompson read a Certificate of Appreciation and presented it to Darren Hansen, Videographer, who had made the film. 9. Presentation From Family Action of Sonoma County Regarding Childcare Study Report. Patricia Souza from Family Action of Sonoma County made the presentation. Council concurred to have City Management move forward with finding a way to implement some of the ideas presented by Ms. Souza. No Action Taken. Recess: 8:15 P.M. Reconvened: 8:25 P.M. UNFINISHED BUSINESS 10. Presentation and Discussion on Interim Wastewater Rate Study and Proposed Increase to Wastewater Rates and Fees. It is Proposed That Residential Wastewater User Rates Increase From $15.75/Month/Account to $20_.75/Month in January 2000; to $25.75/Month in January 2001; and to $30.75/Month in January 2002. Increases in Commercial and Industrial User Rates and Connection Fees Are Also Proposed. The Increases are Necessary to Support Improvements to the Wastewater System, Including Development of the New Wastewater Treatment Vol. 34, Page. 58 November 1., 1999 Facility. (Ban/Stouder) Engineer., Mike Ban reviewed his memorandum dated October 19, 1999 and introduced Mary Winer, of Brown and Caldwell. Chief Economist Mary Winer made a slide' presentation providing Council with background information and proposals. (Draft document dated November 1, 1999 on file in the Office of .the City Clerk) Council.Member Maguire asked if the charges proposed couldbe' rounded .up to an even number. Mr. Ban agreed to check with the Finance Department. Vice,'Mayor Keller wanted information about a third revenue source for example, sale of the: resource, to cover the City's expenses and be the responsibility of the rnanagement.at Rooster Run. Council Member Torliatt replied that City had paid for the wells and the electricity to irrigate the facility: Vice Mayor Keller did not want that an agreement like that with Rooster Run extended to ball fields near the. airport. Council Member Healy was in favor of passing' a one-year rate increase based on this kind of,a.structure and asked whether the Council could come back in one year and revisit the issue. Mr. Ban replied that it was the Council's decision Mr. Stouder mentioned that he was seeking information from Bond Counsel about the level -of comfort of underwriters in this area. Council Member Healy asked for clarification whether staff's proposal was tied to any one design or if ,it was independent. Mr.. Stouder replied, _yes and no; there was no "final design project. Until that happened the true cost was not known. Council Member -Healy asked whether the proposed rates -would get the City where it Wanted 'to be. Mr.. Mr. Winer stated the arbitrage rules state that an entity cannot make money by investing money they -are paying less interest on. Vice Mayor Keller asked if that was during or beyond the proposed three-year program. Mr. Winer replied he thought it was beyond the three- year program. Mayor Thompson noted dates for future public hearings as November 15 and December 6. PUBLIC COMMENT Hank Flum, 1721 Stonehenge Way, asked how one would determine what the connection fee would be if they were a new user connecting with the system. Mr. Ban explained that a table of typical loading values would be established and a refund based on actual figures could be issued if applicable. Bryant Moynihan spoke regarding pretreatment, that businesses should be given a rebate, and that the capital improvements did not include design cost. He wanted to see a more economic approach.
