zo This lot creation question, by way of extension of a County Interim Ordinance, is to be acted
zi upon by the County Board of Supervisors tomorrow (Tuesday). This ordinance prohibits the
zz use of lot line adjustments to create additional developable parcels
z3 A Certificate of Compliance is the mechanism used by local governments to formally
za recognize that a lot has been created in conformance with the state Subdivision Map Act and
zs the local subdivision ordinance regulations. Administrative Certificates of Compliance, as
z6 they are called by the County Planners, result in densities, which are not required to conform
. z~ to General Plan densities. Therefore, lot patterns can develop which are inconsistent with a
zs level of planned growth. These Administrative Certificates of Compliance are not subject to
z9 environmental review under the California. Environmental Quality Act. Cities will have
3o adopted Urban Growth Boundaries in vain unless. t_he loophole is closed. In order to resolve
31 this issue of somewhat uncontrolled lot creation, the advice given by the County Planning
3z staff is the State Legislature should revise their Subdivision Map Act provisions. Napa
33 County is also dealing with the issue and is in the process of developing an ordinance, which
3a may help to resolve this issue.
3s Supervisor Kerns-told the City Council he was present to hear what the Council had to say
36 on the issue. The Councilmembers expressed. their appreciation that Supervisor Kerns had
37 taken the time to attend the meeting.

The Council agreed that the interim ordinance ten-month .extension, as proposed for adoption
by the Board of Supervisors Tuesday .meeting, was a good idE:a and. hould be supported by
the City Council., A letter outlining the. Gity''s position. will. be submitted. to all County
Supervisors'. In addition, the City Council asked that. communication be directed: to the
League of California Cities as well as to the State Legislators representing. this. area

la Management and Flood Hazard Identification. Part 65, Section 65.3 Requirements to Submit
is New Technical Data. A community's base flood elevation increase or decrease resulting
is from physical changes affecting flooding conditions as soon as practicable but not later than
17 six months after the date such information becomes available. A community shall notify the
is Administrator of the Changes by submitting technical or scientific data in accordance with
19 this part. Such a submission is necessary so that upon confirmation of those physical changes

34 lately,. how about the City's Zoning Ordinance, the '`no net fill,' is this residential or
3s commercial? I think that you better look into this matter and do it quick.

s us a response on the Willowbrook situation and we will be happy to share that with you. Pat

io type of fence will keep trespassers out. That is not an environmental issue and will not cover

iz Councilmember Jane Hamilton -I've been getting a lot of calls on Y2K, and people are
13 concerned about their water, their electricity and things that; are within the City's jurisdiction..
is I'd like to have this scheduled on an evening. agenda by April just to answer some basic
is questions for citizens, so people can be assured that we do have manual overrides that will
i6 make everything work on our computers, or how we are going to resolve these issues:

zo Vice. Mayor David Keller -Wants to bring to staffs attention a series of complaints on
zi construction activities on Sunnyslope. We have a note that came in on the Primo Subdivision
zz regarding construction hours, which- according to the writer, is supposed to be limited to the
z3 hours between 8 to 5, Monday through Friday only. Those are being exceeded, as are the
za days being exceeded, and Sunnyslope Road is not being kept clean. It appears to be in
zs violation of agreements. He would like that to be responded to, and he would like
z6 enforcement of the limit in working hours in the residential neighborhood. The final meeting
z~ of the Central Petaluma Specific Plan is scheduled for Thursday, January 28, 6 p.m., at the
zs Senior Center in Lucchesi.

i~ guidance in planning renovations in this historic district. There have been occasions when
is building has occurred, store front modifications, signs have been put in place without
19 approval and what staff is trying to do is get a cooperate relationship with the Downtown
zo Association. We want to be kept in contact with the property owners and renters and want
si to be kept aware of what is going on. There is a meeting scheduled to be held at the Masonic
zz Hall on March 20 to discuss the guidelines.
z3 Vice Mayor David Keller there is a tremendous amount of work that has gone into this over
za the years. His overall sense is this is a living town,. a living city center, it covers a range of
zs buildings going back 130 or 140 years. There is everything from brand new to quite unique
z6 and old for California standards. One of the things that having grown up in New York,
z~ where buildings are two or three hundred years old and get transformed every day of the
zs year, and they are still in use. It is very important to me that the architectural heritage be
z9 preserved, BUT the economic utility of the buildings is essential.
so If the buildings cannot be used for economic activity, they will be abandoned, whether it
31 takes ten or twenty years to abandon them or abandon overnight; and so, it is very important
3z to me that we do not set up a program of the `design police,' as it were, that there be
33 significant flexibility within the overall feeling and context of the downtown but. that building
3a owners, business owners be allowed to reuse buildings creatively, that they not be stuck with
3s trying to conform to something that doesn't now but I don't ever want to see it become
3s Disneyland. Disneyland is not an economic activity where each storefront on Disneyland's
37 Main Street has to survive. We do.
3s We .have different property owners with different resources and different intentions and
39 encouraging them to work as part of this whole that is the gift of this. But I don't want to
ao see it put in the standpoint of where we are going to have `design police,' where we wind up
ai with such a closely or tightly constrained uniformity of.design, and colors of signing that the
az area loses it interest, loses its vitality, loses the individual creative touch from each business,
a3 and ultimately loses its economic reason for being, which is a business center. If we don't
as have a business center we don't have a downtown, regardless what the buildings look like.
as So, that said, I'm very pleased so far with what we have and urge you to go forward.
