22 BACKGROUND:

24 The contractor, Nelson Construction, 192.Jessie Lane, Petaluma, CA.94952, has completed the
25 above-mentioned project. The final cost of construction was $138,077.25. The ten (10%)
26 percent retention payment of$13,807.73 is due and payable;to the contractor thirty-five (35) days
27 after the City Clerk records the Notice of Completion with,the Sonoma County Recorder.

27 Bids were opened on April 8, 1997, for the 1996 - 1997 Storm Drain Improvement
28 Project (Project No 9746). The project involves installing new storm drain pipes,
29 valley gutter and inlets, on E Street between Second and First Streets; First Street
30 between E and F Streets; ,and Fifth Street at J Street to alleviate local flooding (see
' 31 Exhibit "A" for location.niap).
