The Commission expressed support for saving the 44 Magnolia site. The Ogen Space District' has indicaterl there is no dme table for the 45 1Vlatching Grant Program. They will be establishing a time frame in the fall when they 46 will accept applications from all the cit~es and a11 cities will be notified. If ~ developer should try to develop the site and it is in the county, typically the County Planning staff will direct the applicant to work with the local jurisdiction which would be the Cnty of Petaluma. If the developer desires to develop the area and it is within the city because of an annexation, Commissioner Arago strongly suggests that a constraints analysis be performed. 'The commissions recommendat~on is that if the property should be annexed to the City, that the city work with the developer or owner to secure a maximum amount of the property as open space and that there would be no expenditure of funds on the part of the city. The Cornmission did ask that the Council consider the fact that with our long term commitment to the Capital Improvement budget we have right now, is that no monies from the Capital Park Development Funds would be used for the project. 1Vlurray Rockowitz, 11 Eddie Court, ~he land is still there. Without spending any money eucalyptus trees grow back. He would like Council to stay diligent on this issue. If it is not annexed, if it is not city property make sure that somehow there is some vehicle in place so that the City of Petaluma is aware af what is going on with that property so something doesn't slide in the back doore Rob Schneider, 196 Jesse Lane, He is asking Council to direct staff to get involved in the runoff and erosion control now that the trees down. The McNear family and Petaluma go back many years. There is a lot of history there and I think without them and their involvement Petaluma wouldn't be what it is today.. The city had a hand in destroying some of that history at the south end of t~~e boulevard where the McNear Mansion used to be. Looking at our history and what Petaluma is all about, he wants to keep the same feel to Petaluma and not create another Santa I2osa. ~en Goldman, 820 Elm Dr., The agricultural de~elopment an Magnolia has been working hard today. Seven a. m. and their sdll going strong. He feels it is a mean spirited disregard for neighbors, environment, animals and local, state, and federal authorit~es. He suggests everyone who hasn't been there this week go see how it really is. I,ast week the Mayor made a statement to the effect tfiat the Open Space District can't purchase the land without the willingness of the seller to sell it. I would like to say that is why you all are elected because you are th~ leaders and it requires leadership to go to the seller and convince the seller that the best situation for everyone is that they sell the property to a party that benefits everyone. 'Theresa Nelson, Jesse Lane, She attended the Parks and Recreation Commission. She is hopeful because of the oak trees that are just starting to grow on the property. She stated that there is an erosion plan in place, but it has never been tested on eucalyptus tre~s, 'There is some seepage coming off the Samuel develo~ment. 446 June 22, 199~ Vol. 31, Page 447 1 Guy Gullion, 9 Eddie Court, He is concerned about what the county has the ability to 2 put on that site right now without the surrounding residents having any input. I have 3 heard that they have 8 two acre lots available to them and that we don't have any 4 control over. 5 6 Pamela Tuft advised Council that there is a maximum yield potential of 8, however 7 that would be a major subdivision which is subject to CEQA, which would afford a ~ public participat~on process through the county. 9 10 NR: The only recourse is to continue to dialogue with the county and that we get on 11 the mailing list plus provide the mailing list of everybody who appeared at the Open 12 Space meet~ng and at today's meeting and give that to the Permit Resource 13 Management, Public Works and the Sonoma County Water Agency so this piece of 14 property can be looked at. She doesn't feel that the matching grant is the only option 15 the city has. 16 17 PT: She agrees with the suggestion of a constraints analysis. We need to work with 18 the county if they go forward in developing this property. This is a major subdivision 19 and needs careful planning. She would like to keep the line of communication open 20 between the county and interested parkies and hopefully have enough support from the 21 Board of Supervisors to keep as much open space and we car~. 22 23 MM: This issue has been before the Council for two consecutive years with the 24 applicant requesting housing allocations first for 68 units and the second year 48 units 25 for property that is outside the city limits. It was suggested that the applicant apply 26 for a General Plan Amendment for that parcel to be brought into the city limits. In so 27 doing the applicant would have had to say where exactly the park site would be. At 28 this point I would have to say that if were going to look at this with any development 29 potent~al I think it is incumbent upon the applicant and their agent to make a 30 significant offer to the city to show that they are trying to negotiate with us in good 31 faith. In the past, judging by the actions and the results I would say that has not been 32 the case. Therefore since the ma~cimum is currently 8 units under the county plan I 33 am loathe to give one more unit in our take on this unless there is a significant offer 34 of open space permanently at no cost to the city. 35 36 A motion was made by I~K and seconded by JH for Council to authorize a request to 37 the Open Space Authority, and Open Space District to examine the possibility of a 38 50/50 purchase of all or a portion of the site with the possibility of us looking into 39 other ways of fulfilling our obligation beyond cash payments which are obviously not 40 available to this city. Our planning department should contact the County Planning 41 Department to find out what the development potential is under county regulation, 42 what the ma~cimum yield that could come off of that site and to sit down with the 43 property owners and agent in the light of what has been recommended by the Parks & 44 ltecreat~on Commission and see if there is some agreement that can be arranged that 447 ~` i 1 2 3 4 S 6 7 ~ 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 Page 448, Vol. 31 June 22, 1998 would afford the city long term protection over open space on all or part of the property. AYES: Keller, Torliatt, Hamilton, Maguire, Hilligoss, Read NOES: None ABSENT: None Abstain: Stompe DK: He has asked our Fire IVlarshal to take a look at the site closure which is scheduled to be covered with 12" to 18" of eucalyptus slash which is to prevent erosion and installing a series of bars across the roadway. VVhen that dries out that will be a very significant fuel load on that property and I would like to make sure that both our Fire Marshal and other agencies have signed off in writing that this is an acceptable closure with eucalyptus for that site. We need to follow up with the county to insure that in fact if there is no development activity on this site or no development application on this property during this year, that any erosion and runoff from this site is monitored by the county so that if there are any problems it doesn't slip through the cracks. Public Comment Peter DeKramer 515 Western Avenue, he would like to agendize for discussion and possible action a resolution from the City to the County requesting a trail segment for considerat~on be placed on the Outdoor Itecreation Plan between the Old Adobe and Jack L,ondon State Park. Geoff Cartwright, 56 Rocca Dr. is fed up with the stall t~ctics regarding the flood situation in the Payran Area. Council Comment IVR stated that the State is going to take $2 million in Vehicle Y.icense fees away from the city. She would like a resolution on the June 29 meet~ng opposing this act~on by Yhe State. JH: There is algae in the lake at Lucchesi Park. This needs to be cleaned out. MS: She would like to agendize establishing a Citizens Fire Academy similar to the Police Academy. VVhat is the pump for that council approved at their last meeting? 7 A. '~'he pump was purchased from sewer funds. The intent being a pump that ~ would be used in the Payran area. It would also be available for uses within 9 other departments other than the winter time. 10 Q. What new construction projects are in place at Redwood Industrial Park, Old 11 Redwood Road behind Denney's and Corona @ McDowell. 12 Ae ~Iictory Chevrolet is going in behind Denney's off of Industrial Avenue. 13 Grading in Redwood Business Park was started last fall for a development that 14 was stopped because of rain. 15 Corona and McDowell behind the Fire Department is a project approved last 16 year through the EIR and is zoned industrial park. 17 Q. ~Nhy is the city losing money on the Marina. Sell it. 18 A. Attend the Marina Workplan on July 6. 19 20 DK: Wanted to know if on the McNulty site at Corona and McDowell were there any 21 storm water flow requirements that were imposed on the condit~ons of approval? 22 23 Pamela Tuft, Planning Director will come back with that answer. 24 25 Scott Hess, 100 Union Street, Rainier site is a significant area. It should be saved 26 because of the oak trees and made into a park. 27 28 Patricia Delzell, 56 Cordelia Dr. She lives in the flood zone and does not think 29 Council compensation should be on the ballot. 30 31 Ron Staudenraus, opposes the Rainier overpass and interchange. 32 33 John Cheney, 55 Rocca Dr. opposes the Rainier project because of the flooding it 34 would cause upstream of the Payran area. 35 36 Leon Beck, 19 Rocca Dr., opposes the Rainier project because the information in the 37 EIR is not valid and because of the potential flooding upstream of the Payran area. 3~ 39 Richard Brawn, 141 Grevilia, opposes the Rainier project because of the potential 40 flooding upstream of the Payran area and there is no proof it was ease the congestion 41 on E. She hasn't heard from any of the public who approves of this project. There is no data availabl~ on how much time the Rainier project would save people from sitting in traffic. Sl~e opposes the project. Steven Charlip, he would like to see a regional park in this location. Opposes the ltainier project. L,inda Cheney, 55 12occa Dr., opposes the Rainier project because of potential flooding. Hank Flum, public sold on the idea that Rainier will eleviate the traffic problem. ~Ie opposes the project because of potent~al flooding upstream of the Payran area. i.inda Scott, she would like to see less stop signs across th~ span of the interchange. I3ow could Rainier be built and not have it affect the flooding in the Payran area. Matt Connolly, Chelsea Group, supports the Rainier project. The Chelsea Group who developed the Factory Outlet has already contributed $1.2 million towards the construction of Rainier. Felix Weyle, 124 Prince Albert opposes the Rainier project ~ecause he doesn't believe it would increase the level of service at E. Washington and McDowell. Lisa Erwin, Bicycle Committee, she would like to see bike paths under or over the freeway. ~here should be bike and pedestrian access on all overcrossing's and interchanges. . Scott Devian, Bicycle Committee, Make Petaluma more bike path friendly. I3e opposes the Rainier project. Patricia Brown, we need to look at the flooding and thir~k of alternatives to cars. 'I'here should be a visionary plan, Vince Landof, 12 Cordelia Dr., opposes the Rainier project. Look at Corona for the interchange/overcrossing. Revisit E. Washington and McDowell and do it correctly. 'Tom Pattalochi, opposes the Rainier project until the flooding issue is fixed. Claudia Cleaver, this is a huge amount of money to create a huge structure. We have time to look at other options. I.ook at pedestrian, transit and bike cross town connectors. Spend a little money on the flood problems and creating a river park. Gary Johnson, Corona Reach Committee member, supports the Rainier project. 450 June 22, 1998 Vol. 31, Page 477 1 DK: If I might, something else to make sure is included in Yhis in loolang at the 2 expansion of the Corona Reach turf as it were if a UGB is passed, ....... vote is 3 passed the UGB and the acreage west of Petaluma Boulevard North which is cunendy 4 within the urban limit line, but not within the city limits. If that's where the UGB 5 line is included there's a lot of acreage, commercial development, redevelopment ~ 6 potential along north boulevard that has not been incorporated within the Corona ~ 7 lteach Committee, that area should be as well. And finally, stepping back a moment. 8 The value of having Rainier in front of us, is that it actually offers us the opportunity 9 to take on these issues because so much of this comes together around the Rainier 10 issues. ltainier as it was approved in the EIR was just a structure, just a series of 11 roadways. It didn't include discussion of the development, didn't include how to deal 12 with Floodplain Management, it didn't include how to deal with overall city 13 circulation. So we really have an opportunity here and I think it's a golden 14 opportunity, there is obviously a tremendous amount of interest in pressure in appeal 15 city wide from a number of different standpoints to look at Rainier as a project and I 16 think this Council has the opportunity to find out what that means and to put into 17 place a lot of things that will help us out in the long term in the future. It really is an 18 opportunity let's not waste it. 19 20 JH: I just want to point out tonight is the first time this council has had a chance to 21 have any discussion of substance about Rainier even though it's been on the agenda 22 and we've been struggling through it, we have just skated over the top of it or spent 23 rnost of our time just listening to the public and had a perfunctory conversation 24 decided that we didn't have any more time and this is a good initial discussion, but we 25 need more to process it, and through us the community is processing it and I want 26 everybody to understand that.
