He would also like Council to revise 26 or redirect the Lafferty Access Committee on what their mission is, have the committee 27 establish the use of Lafferty, subirut that to the Council, and then hire consultants to develop a 28 Master Plan. 29 30 Matt Maguire as co-chair of the Lafferty Access Committee stated that the committee is 31 determining the areas where they will need the expertise of consultantso 32 33 Mark Mederi.os, 200 Jessie I.ane - Representing the Petaluma Progressive's handed out boolcs 34 to the Council titled "Take the Rich off Welfare". She would like to add another item to the Police Chie~s report to the Council for the January 21 meeting on Community Policing titled "Every 15 Minutes". She is grateful thaf Petaluma was not flooded by the latest storms. Mary Stompe welcomed the new Councilmembers. She would like to re-establish town meetings. She met with Assemblywoman Kerri Mazzoni about the fraud investigation. There is no new update on that investigation. In 1996 she also requested opening the doors of City Hall either before a meeting or on a weekend for the public to visit different offices and meet city employees and Council. She would like this adendized. She would also like to put on a future agenda an item regarding a citizen suggestion box plac~;d at the rear of the Council Chambers with a by-weekly report of the suggestions to the Council in their Council packets. She would like a date set for a goal setting session in February. She attended the National League of Cities conference in San Antonio last month and picked up the City of Fort Worth citizen's budget guide which is a school for citizens to understand the budget process, and also a City Budget Simulator. She also has the pictures from the San Antonio River Walk. She would like to place on an agenda for dliscussion and possible action the employee recognition event . Pamela Torliatt, thanked everyone that helped her on her campaign and for every vote she received. It was the most rewarding experience she has ever gone through. She also thanked her family for all their help during her campaign. She also would like a goal setting session, but prior to Council goal setting session she would like to meet with all the committee's and commission's as well as with the public to see what their goals would be. She would like to have this agendized. Jane Hamilton, before the Council has a goal setting session she would like the Council to do a team building session. Both could be scheduled for February. David Keller thanked everybody for coming this evening. He thanked everyone who supported him during his campaign and also thanked everyone else who ran. Matt Maguire welcomed the new Council. He took a hike at Shollenberger Park this past weekend. He reported there was some vandalism to the Rules sign which needs a new Plexiglas cover. On the 17th of January the Police Officers Association and the Fire Fighters Association are holding an annual fund raiser at the Veterans Building. As part of the event, Firefighter Nick Lucia and he are working on a fund raiser (auction) to benefit COTS which is to help raise money for a playground for the kids that use COTS services. ~-Ie would also like the issue of Mr. ~ettman's Agricultural lease put on an agenda for re- evaluation as well as 1VIr. There have 23 been ongoing meetings with surrounding facility managers as well as neighborhood meetings. 24 T'here have been no unusual occurrences at the Center or in the neighborhood. She is 25 requesting that the rnonthly status report be changed to a six-month report as required in the 26 Conditional LJse Permit. 27 28 STA1'iJS I~PORT 29 LAFFEgt'I'I' ItANCI~ IN'I'ERIlVI ACCESS POI.ICY 30 ~ssistant City Manager Warren Salmons reported that the city is in the process of completing 31 the background investigation of the circumstances of ownerslup and rights and responsibilities 32 of the various properties in the vicinity of Lafferty particularly at the entrance point of Sonoma 33 Mountain Road. He will also provide to the committee the traffic counts. ~Ie will also be 34 checking county records regarding language in the Sonoma Mountain Plan which is a sub- 35 component of the county general plan regarding use of the Lafferty property. 36 37 It was stated that the committee needs to move forward on the long range planning and the 38 Council needs to clarify the issue of access. Council would also like to see information 39 brought back on the question of the alignment of Mr. Pfendler's fence relative to the property 40 line. There is also concern about the actual location and also whether or not the city should file 41 a protest with the County over the lack of a permit for erecting the fence. 42 43 44 Mr. Salmons stated that with regards to the question of the fence relative to the property line, 45 he believes that could only be determined by a survey which is estimated to cost $8,000. 46 175 Page 176, VoL 30 January 6, 1997 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 l9 20 21 22 23 24 25 26 27 28 29 30 31 32 A Motion was made by Jane Hamilton and seconded by Matt Maguire to place this item on the agenda once a month to be titled, "Status Report and possible action - Lafferty Ranch" AYES: Read, Keller, Stompe, Torliatt, Maguire, Vice Mayor Hamilton, IVlayor Hilligoss NOES: None ABSENT: None Doug Daily, 320 Pleasant Street - spoke regarding the fence between Mr. Pfendler's property and Lafferty property. The fence alters the path the wild animals would normally take. He also stated that three (3) trees have been cut down on Lafferty property. He would like someone to look into that. As one of the plaintiff's in the Brown Act Case against the City concerning water issues, he would like to know if the City is going to hire Roos-Collins to make sure we maintain our water rights. Robert Ramirez, wants the Council to make a decision tonight on. allowing the public to go up to Lafferty. In the meantime valuable time is being lost and people are getting pretty tense around town. They are about ready to just go up. Matter of fact I think they are going up. I'm not encouraging that, but I think they are. I supported you guys in the election to do a job and I'm here tonight to support you in what your campaign issues said. That's not a threat, that's a supporting that we need to get on with this. And to the Councilmembers who said prior to being elected, the remaining Councilmembers, that said their pro access now. If it is 10 keys, 15 keys, whatever it is let's do it. If we get sued let's deal with that when it happens. Let's stop worrying about it, we'll just deal with it when it happens. The committee will continue with the Access Plan. We will do what we were ~harged to do, create a Final Management Plan that will be consistent as we were told by the R.esolution. Pat Cheda, has a bull on her property and feels with the poor fencing between Lafferty and her property their should not be public access at this time. Tod Manning, addressed Mrs. Cheda comments regarding her bull. ~ When you have a wild animal on your property you are responsible for the containment of that wild animaL With regard to the removal of the trees on Lafferty, a criminal report should be filed and the proper authority is the County. 176 ~ , . ~ rx.;~,r~}r'',-.~• • January 6, 1997 Vol. 30 Page 1'7'7 1 2 Matt Maguire, stated that he would like to see access to the property also and he understands 3 the fiustration. The City Attorney has said that if you implement an interim plan you may 4 trigger CEQA. One of the things we are working on is the access issue, the water rights, the 5 historx of the access etc., and I think when that information comes, it will have an influence on 6 my personal decision as to saying how soon we implement what policy. In the meantime if 7 people want to go up to I.afferty they need to come to the Council, express their desire to do 8 so and we will address it on that issue. We are starting to lay the ground work with the 9 committee and I believe we are making progress. 10 11 Warren Salmons advised he would file a complaint with the County Sherif~s office regarding 12 the vandalism to the three trees on Lafferty property. 13 14 Councilmember Keller suggested that the city put locks on the three gates that access 15 Pfendler's property to Lafferty. 16 17 Jerry Price feels it is unfair for this community to have to pay money to defend themselves for 18 using their own property. He would like to have a CEQA expert working with them. 19 20 dince Landof is angry about not being allowed to go up to Lafferty. He feels the City 21 Attorney should get more aggressive in looking out for the public interest instead of worrying 22 about offending some people on the mountain that do not want the public up there. 23 24 City Attorney Richard Rudnansky stated that he has done the research on the issue, and he has 25 talked to a CEQA Attorney. I3e is being cautious in laying the foundation. He would caution 26 Council to proceed in haste because some people have misperceptions of the law or can't wait 27 to have the foundation built. 28 29 Pat Cheda, feels all the property owners should learn to get along and that includes the 30 Lafferty Committee. She has not threatened anybody. She is just trying to protect herself. 31 T'he fence that is in place now between her property and Lafferty is half hers and half the 32 City's. The City needs to take responsibility for their half. 33 34 Jane Hamilton stated that the Council does want to work with Mrs. Cheda. Council has heard 35 what she has said and appreciates her input and the point was well taken about the fence. She 36 agrees with Councilmember Maguire and the City Attorney to proceed cautiously and do it 3 7 right. 38 39 David Keller supports that as well. People should come and ask under the existing history of 40 access for access to the property rather than formalize a new policy. ~Ie would like Mr. 41 Salmons to check with Mrs. Cheda about the condition of the fence, how much fence is not in 42 good condition, and how much of the fence is missing. January 6, 1997 Vol. 30 Page 179 1 2 ~EAIDWA~RS 3 CALPERS ~1V~STIVIEN7'S 4 It was brought to the attention of the Council by Councilmember Maguire that CALPERS 5 (Califorrua Public Employees Retirement System) is a large investor of Ma~cam Corporation, 6 the holding company for Pacific Lumber which is the company embroiled in the Headwaters 7 controversy. He would like Council to write a letter to Dr. Crist who is head of CALPERS 8 opposing public funds being invested in Ma~am Corporation. We need to write letters to 9 President Clinton, regarding the supposed swap of federal and state assets for the protection of 10 what belongs to all of us. He would also like to see us copy Tom Tuckman - United States 11 Forestry Service, Diane Feinstein, Matt Fong - State Treasurer, Office of Thrift Supervision, 12 Jim Harberson, Lynn Woolsey, Steve Burton, Kem Mazzoru etc. The future of our ancient 13 forest is hanging in the balance. We are being asked not only to allow the destruction of what 14 is irreplaceable, but to give up tremendous assets of our own at the same time. 15 16 Beth Grimes, opposed to Ma~cam, and supports Council writing a letter. 17 18 Mark Medeiros supports a resolution. 19 20 Tod Manrung, feels that the Council was not elected to make decisions on special interest 21 issues such as the Headwaters. He would also like Council to stick to the finance part of the 22 issue. 23 24 Victor Chechanover, this issue is a matter of concern to the people of Petaluma because we 25 live on the coast of California. He supports any influence the Council may have to persuade 26 PERS and the Public Teachers Retirement System concerning their investment in Ma.~am. 27 28 Ned Orrett, believes this is an important issue to consider. 29 30 Rick Coates, supports the resolution. 31 32 L,ynn Smith, supports the resolution. 33 34 T'he City's contribution to PERS on an annual basis is approximately $600,000. The employees 35 portion is appro~mately the same amount. 36 37 Councilmember Maguire made a Motion to bring a draft Resolution back at the next meeting 38 and have staff compose a letter to the various people mentioned. Planning Director Pamela Tuft to gather more information and 4 bring this back to Council. 5 6 7 LIAISON I~EPORTS 8 It was reported that our cable vendor TCI is in court regarding right-of-way. In Michigan and 9 Tennessee it seems that TCI wants to provide telephone service under its cable franchise and 10 that it need not pay a franchise fee.
