The authorities for this fee are Velucle Code Sections 22651 (h), s (i), (o), and (p), Vehicle Code Section ~22850.5 and Government Code Section 54990. 6 The Police Department is involved in towing and storage of many vehicles. ~ "Administrative Cost Recovery. Fees" would not be :charged for 1. Recovered stolen s vehicles; 2. Collisions where the driver is not arrested; and 3. Vehicles which are towed 9 for a parking violation. Staff concurred with the request. There are currently building i9 modifications being done in accordance with the conditions of the use permit. The .owner 2o has advised staff the revisions to the roof vents has been completed, the vestibule Zi improvements will be done at a slower pace. The e~cisting soundwall has been found to be Za a suitable substitute for that vestibule. Together with the treatment to the roof top vents 23 and the soundwall there are in fact sufficient acoustical steps that have been taken. The 2a monthly meetings between Mr. Vieler of Kodiak Jacks', the Police and Planning zs Departments have begun to take place. 26 27 28 29 30 31 32 33 ~SO. 95-89 NCS 34 MOBILE HOIVIE REN'T STABII.IZATION 3s Assistant City Manager Gene Beatty reviewed the first year of the mobile home rent 36 ordinance and its impacts and costs. The ordinance covers space rentals with less than s~ twelve month leases. sa There have been three arbitration hearings since the ordinance was adopted. The mobile 39 home park, the issue and the arbitration findings follow: For Littlewood Mobile Home ao Park there was a 1.9% rent increase plus $4/month capital improvement charge for road ai repairs. The rent increase was approved, but the capital improvement was denied. For az Petaluma Estates there was a$3.28 capital improvements charge for pool house costs. 43 $3.11 per month pass-through was the settlement. For Leisure Lake Mobile Home Park, aa there was a$6.62 assessment for street improvements which was added to the base rent. as The $6.62 was removed from the base rent and billed separately. 73 Page 74, Vol. 29 Apri13,1995 i Currently the administrative fee is $48 per space annually. One half or $24 is paid by the a mobile home space renter and the other $24 is paid by the park owner. During this past 3 year the costs were $8,136.37. That cost was the sum of attorneys, both~ city and outside a counsel, and Sonoma County, who charged $4,146.20: The County has advised the City s they are increasing the County charge to $102 per hour, up from $85 per hour. 6 There are 870 mobile home park spaces, and only 131 spac ~s are covered under the city's ~ ordinance, because they do not have the 12 month or longer lease. Staff recommended ~ increasing the administrative fee to $75 per' space annually to cover the esfimated cost for 9 1995-96 fee. Some of the long terni leases will expire this year enabling more ia tenants to be covered by the ordinance. is Coleman Persily, 206 Yosemife Road. Wants to keep the annual administrative fee at $48. ia Cathy Stewardson, Leisure Lake. She has gone door to door, and mailed out flyers trying is to get those tenants with long term leases not to renew, but to allow themselves to be i6 covered under the ordinance. She would like the owners to use a'Tenant To Be' form i~ compiled by another city which would notify the tenant to be what their options are if they is signed a short term lease or long term lease. i9 Fern Vincent, Leisure Lake. Suggested that the annual f~e of $48 be retained and the Zo April 30 collection date be moved to July 30. This street alignment would not allow 3z direct access of Riesling Road extension from Riesling Road as it exists between the 33 Sonoma Mountain Townhomes and Glenbrook.. 34 Sonoma Mountain Parkway should have a long median strip to prevent through traffic and ss looking down at the two portions of Riesling Road, they would not exactly meet at 36 Sonoma Mountain Parkway. They would be somewhat offset. This plan received s~ majority approval from a eommunity meettng where the neighbors expressed their fear of a 3s 4-way stop at Riesling and Sonoma Mountain Parkway. They said it would introduce 39 substantial non-resident traffic into their neighborhood. This will shift the .intersection of ao the new collector road with Sonoma Mountain Parkway about five hundred feet to the ai west.
