HomeMy WebLinkAboutResolution 2005-017 N.C.S. 01/24/2005 Resolution No.2oos-o~7~,C,~. of the City of Petaluma, California MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION (LAFCO) SUPPORTING PROCEEDINGS FOR ANNEXATION OF PARCELS 068-010-033, AND 068-010-034 TO THE CITY OF PETALUMA. THE OXIDATION POND SITE (ASSESSOR'S PARCEL 068-010-026, 025, 024 & 023) ARE CURRENTLY WITHIN THE CITY LIMITS AND URBAN GROWTH BOUNDARIES (UGB) 4104 LAKEVILLE HIGHWAY 068-010-033, 068-010-034, 068-010-026, 025, 024 & 023 PURSUANT TO THE CORTESE/KNOX LOCAL GOVERNMENT REORGANIZATION ACT OF 1985 WHEREAS, after public review and input, the City Council of the City of Petaluma adopted under Resolution No.2002-135 N.C.S., the Environmental Impact Report for the Ellis Creek Water Recycling Facility; and, WHEREAS, in order to implement the project it is necessary to annex property known as Assessor's Parcel Number 068-010-033, AND 068-010-034. NOW, THEREFORE, BE IT RESOLVED that pursuant to the Municipal Organization Act (Government Code 35000 et. Seq.) the Petaluma City Council hereby supports application to the LocaLAgency Formation Commission of Sonoma County for a proposed reorganization as follows: An annexation of Parcels 068-010-033, 068-010-034 to the City of Petaluma. The oxidation pond site is currently within the city limits and Urban Growth Boundaries (LTGB) 4104 Lakeville Highway APN 068-010-026, 025, 024 & 023 to the corporate boundaries of the City of Petaluma. Resolution No. 2005-017 N.C.S. Said territory at 4104 Lakeville Highway is developed with an existing single-family residence and oxidation ponds as described on the Ellis Creek Water Recycling Facility plans. BE IT FURTHER RESOLVED that the reasons for the requested organization are: 1. The property is contiguous to the City and/or is within the adopted Sphere of Influence and General Plan Urban Limit Line of the City of Petaluma. 2. The City has completed an environmental review process for the area, which culminated in the certification of an E.I.R. bythe City Council in August of 2002. 3. By Ordinance No. 2199 N.C.S., the City of Petaluma has pre-zoned/rezoned the affected parcels to PCD-Planned Community District. 4. The annexation will enable several provisions of the General Plan to be achieved including: orderly improvement of City infrastructure, preservation of County land use including agricultural uses. 5. The annexation is consistent with the objectives of the Land Use Element of the General Plan (m) Ensure that the water and sewer systems keep pace with growth and (n) plan long-range for needed roads and infrastructure. The project proposal will meetlexceed the cities needs. 6. The owner of said properties (City of Petaluma) has initiated said annexation. 7. The City Council may extend the UGB under specified and limited circumstances. The relevant provision is on p. 3 of the initiative, under section 2.2, Policy 3, which reads as follows: Policy 3: It is the policy of the City to build within the agreed upon Urban Growth Boundary. No urban development shall be Resolution No. 2005-01'7 N.C.S. Page 2 permitted beyond the Urban Growth Boundary. "Urban development" shall mean development requiring one or more basic municipal services including, but not limited to, water service, sewer, improved storm drainage facilities, fire hydrants and other physical public facilities and services; but shall not mean providing municipal or public services to open space uses, public or quasi- public uses such as schools or public safety facilities. Said municipal or public services or facilities can be developed beyond the UGB to provide services within the UGB. BE IT FURTHER RESOLVED that the requirements of the California Environmental Quality Act (CEQA) and its Guidelines have been satisfied and thoroughly addressed in the certification of an E.LR. by the Petaluma City Council in August 2002, and herein incorporated by reference. The City Clerk is hereby authorized and directed to file a certified copy of this Resolution with the Executive Officer of the Sonoma County Local Agency Formation Commission. Under the power and authority conferred upon this Council by the Charter of said City.
