HomeMy WebLinkAboutResolution 2008-132 N.C.S. 07/07/2008Resolution No. 2008-132 N.C.S. of the City of Petaluma, California AUTHORIZING THE AWARD OF CONTRACT FOR THE POND INFLUENT PUMP STATION IMPROVEMENTS PROJECT PROJECT NO.000500808-30600-54151 WHEREAS, City staff has worked diligently to prepare construction bid documents and advertise for construction of this Project; and, WHEREAS, in accordance with California Public Contract Code Section 20688.2. and other applicable law, City staff solicited bids for the Project; and, WHEREAS, the project was bid on May 28, 2008, and three (3) bids were received and opened in accordance with applicable law; and, WHEREAS, the lowest bid for the Project was submitted by Pacific Mechanical Corporation ("Pacific Mechanical") for $537,300; and, WHEREAS, staff has verified that Pacific Mechanical possesses a valid California Contractor's License, Class A, license number 138920, that qualifies Pacific Mechanical to perform the Project. NOW, THEREFORE, DE IT RESOLVED that the Petaluma City Council hereby: 1. In accordance with California Public Contact Code Section 20688.2 and other applicable law, waives any and all non-conformance in the bid of Pacific Mechanical for the Pond Influent Pump Station Improvements Project, and finds the bid of $537,300 to be the lowest, responsible bid. 2. Awards the contract for the Pond Influent Pump Station Improvements Project to Pacific Mechanical, in the amount of $537,300, the amount of the lowest responsible bid, conditioned on Pacific Mechanical timely executing the project Resolution No. 2008-132 N.C.S. Page I contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 3. The City Manager and/or his designee is hereby authorized to execute on behalf of the City of Petaluma amendments to the contract, so long as such amendments in the aggregate do not increase the original contract not-to-exceed amount by more than $54,000. 4. Directs staff to issue a Notice of Award to Pacific Mechanical. 5. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Pacific Mechanical the signed project contract and all other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. Under the power and authority conferred upon this Council by the Charter of said City.
