Zoos-o~6I~.C.S. of the City of Petaluma, California A RESOLUTION OF THE CITY OF COUNCIL OF THE CITY OF PETALUMA APPROVING AN AMENDMENT TO THE GENERAL PLAN LAND USE MAP FOR THE ELLIS CREEK WATER RECYCLING FACILITY FOR PARCELS 068-010-.033, 068-010-034 TO THE LAND USE DESIGNATION OF PUBLIC/INSTITUTIONAL. THE LAND USE DESIGNATION FOR THE OXIDATION POND SITE (ASSESSOR'S PARCEL 068-010-026, 025, 024 & 023) IS CURRENTLY PUBLIC/INSTITUTIONAL AND WILL BE UNCHANGED AT 4104 LAKEVILLE HIGHWAY WHEREAS, an application was filed by the City of Petaluma for an amendment to the General Plan Land Use Map to redesignate the subject parcels PublicJInstitutional to allow the development of new Ellis Creek. Water Recycling Facility; and WHEREAS, the Planning Commission held a duly noticed published hearing on December 14, 2004 and considered all written and verbal. communications before rendering its decision for recommending approval to the City Council; and WHEREAS, all reports and recommendations from the Planning Commission were forwarded to the City Council; and WHEREAS, the City Council held a duly noticed public hearing to consider this amendment on January 24, 2005, and considered all written and verbal communications before rendering its decision; and WHEREAS, the potential environmental impacts of the project were considered and proper action has been taken by the City Council with the certification of an E.LR. in August of 2002. NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council hereby approves the requested amendment to the General Plan Land Use Map to change the designations as outlined above based upon the following findings: 1. That the proposed amendment is deemed to be in the public interest. The amendment to the General Plan map would ensure that the water and sewer systems keep pace with growth and plan long-range for needed roads and infrastructure. 2. That the proposed amendment is consistent with the initiative for the UGB and the City Council may extend the UGB under specified. and limited 2005-016 Resolution No. N.C.S. circumstances. The relevant provision is on p. 3 of the initiative, under section 2.2, Policy 3, which reads as follows.. . Policy 3: It is the policy of the City to build within the agreed upon Urban Growth Boundary. No urban development shall be permitted beyond the Urban Growth Boundary. "Urban development" shall mean development requiring one or more basic municipal services including, but not limited to, water service, sewer, improved storm drainage facilities, fire hydrants and other physical public facilities and services; but shall not mean providing municipal or public services to open space uses, public or quasi-public uses such as schools or public safety facilities. Said municipal or public services or facilities can be developed beyond the UGB to provide services within the UGB. 3. That the proposed project is consistent with the General Plan Land Use Element; Objectives (m) and (n). 4. That the proposed project, as conditioned and designed, will not be detrimental to the public welfare, will be in the best interests of the City, and will be in keeping with the general intent and spirit of the zoning regulations of the City and with the General Plan. 5. The proposed project has complied with the requirements of CEQA through the preparation and adoption of an Environmental Impact Report prepared for this project, and adopted in August 2002 by the City of Petaluma City Council, which addresses the potential environmental impacts associated with its development, and no further environmental analysis is necessary. Under the power and authority conferred upon this Council by the Charter of said City.
