Copies will be made available for the Council each i4 month. is Bryant Moynihan, Nexus Realty Group -had some questions and suggested wording changes 16 in the PCD resolution for the .Petaluma Cinemas expansion, which is listed on the Consent i~ Calendar. After some discussion, the Council agreed to remove the Petaluma Cinemas actions is .from the Consent Calendar. i9 COUNCIL COMMENT zo Jane Hamilton -requested that the subject of Kenilworth School use be placed on the Council zi agenda. zz Lori Shea -requested that the subject of using Kenilworth Recreation Center for a Teen z3 Center be on the agenda next time. Introduced by Ross Parkerson and seconded by Nancy Read. s AYES: Parkerson, Read, Hamilton, Barlas, Shea, Mayor Hilligoss 6 NOES: None ~ ABSENT: Vice Mayor Sobel s PETALiTMA CINEMAS PCID 9 The resolution approving the Planned Community Program for the Petaluma Cinema to expansion on a 16.35 acre site at 1363 McDowell Blvd. North was discussed at some length. 11 The discussion centered on wording changes requested by Mr. Bryant Moynihan on behalf of lz Mr. Clegg, owner of a piece of adjoining property. The proposed wording changes included a 13 request to allow "free-flow of vehicular trafl"ic with no parking being allowed directly on the la access easements" and a request that Pacific Theatres be compensated by the benefited is property owners for dedication of right-of--way for the access street at "the current fair 16 market value" of the property now but be paid.at a later date. Mr. Moynihan is requesting 17 that Mr. Clegg pay about the time of issuance of a Certificate of Occupancy on Mr. Clegg's is property." This item was continued to the next meeting to allow time for the interested 19 parties to resolve their differences. Zo TEEN PROGRAMS zl Recreation Director Jim Carr advised the Council of the status of building a skateboard park 22 at the Fairgrounds. The current preferred -site is immediately behind the Municipal Swim 23 Center. There has been a meeting with a committee of the Fair Board and City 2a representatives. The Fair Board appears to be looking upon the project favorably. There are Zs still several items of concern to the Fair Board such as park design, traffic mitigation 26 measures, a multiplier to determine loss of revenues (from Fair parking), and a rental 2~ agreement to cover those lost revenues. There is also the cost of lighting the skateboard area Za and the potential for vandalism. 29 It is staffs intent to resolve the remaining issues prior to the Fair Board meeting in December. 3o The Council will receive a report after that meeting has taken place. 31 ORI). 1970 NCS 3s TREE REGiJI.ATION5 33 Adopt Ordinance 1970 NCS repealing the current section of the Municipal Code on trees and 34 replacing it with new regulations. Sections included in the ordinance are 13.08 -Trees and 3s Other Vegetation, 13.10 -Duty of Property Owner to Maintain Sidewalks and Public Street 36 Landscape Planters and 13.12 -Excavations. Victor Chechanover asked if the contractor would be obligated to oversee the landscaping for three years as recommended by the Budget Committee, rather than one year as has been. the practice of the City. Central Business District, in accordance with amendments to the Health and Safety Code Section 33333. Recent legislation mandated that redevelopment areas shall not. incur debt and shall not commence errunent domain actions beyond " 20 years from adoption.. ofthe plan or January 1, 2004, whichever is later". Redevelopment activities shall not occur "40 years from adoption of the :redevelopment plan or January 1, 2009, whichever is later". The time now allowed for receipt of the tax increments is 10 years after `the limit on redevelopment activities. 376 ,~~ .. S. Highway 101 from the i~ southern end of town to the northern end. The width of the redevelopment area is varied. On is the easterly side of town from south to north the boundary follows the Petaluma River, t9 Lakeville Highway, U. S. 101 Highway, to East Washington then McDowell Blvd. to the zo .Railroad tracks then the railroad tracks across Ely Road to Denman Road. It follows the Zi westerly city limits and comes back into town along Petaluma Blvd. North. taking in some 22 properties along that stretch of road. Close to downtown, the boundary goes around the 23 Central Business District redevelopment area and follows Lakeville Highway to Hopper za Street, then follows along the railroad for a bit. Then it heads to the Petaluma River, goes Zs around McNear Hill and up McNear for a few blocks then goes back to U. S. Highway 101. z6 For the Petaluma Community Development Project area the guidelines are now: z~ 1. These funds are available through the ai State Resources Agency. The required mitigation measures for Lakeville Highway include a2 landscaping of the soundwall and creation of approximately one acre of marsh in Adobe Creek a3 near the new Shollenberger Park site. The grant program will provide an opportunity to a4 install large canopy trees along Lakeville Highway and at major intersections and transit stops. 377 P3~8 ,Vol. 28 November 7, 1994 The grant project would also provide additional fiinds to augment the restoration of Adobe Creek channel south of the Lakeville High .way bridge. There. is a trail connection and pedestrian bridge proposed which would link the existing trail along, the Adobe Creek channel through the industrial park to the Shollenberger Park trail at the City's dredge disposal site.
