RESOLUTION APPROVING THE PROJECT BUDGET, APPROPRIATING
REIMBURSABLE FUNDS AND AWARDING THE CONSTRUCTION
CONTRACT FOR THE RIVERWALK AND STREETSCAPE IMPROVEMENTS
AT THE DOWNTOWN RIVER APARTMENTS PROJECT LOCATED AT
35 EAST WASHINGTON STREET
WHEREAS the Petaluma City Council approved the application for Federal
Surface Transportation Funds through the Metropolitan Transportation Commission's
(MTC) Transportation for Livable Communities program for the Downtown River
Apartment (Resolution 2002-029); and,
WHEREAS the City was successful in receiving two separate funding allocations
in the amounts of $267,000 to be administered through the California Department of
Transportation (Caltrans) and $358,000 to be administered through MTC; and,
WHEREAS the City will conform with the fenders' requirement to advance the
project costs from the City's Low=Mod Housing Fund and receive reimbursement upon
project completion; and,
WHEREAS the appropriate budget adjustments will be made to .accommodate a
temporary interfund loan for that purpose; and,
WHEREAS the funds will be utilized to complete projects which are consistent
with the City's development review process of the Downtown River Apartments project
and the plans and specif cations to complete the work have been publicly noticed and bid;
and,
WHEREAS the project bids were received on December 2, 2004 and two bids
were received and opened in accordance with applicable law; and,
WHEREAS the lowest bid for the project was by North Bay Construction, Inc. in
the amount of $595,011.50; and,
WHEREAS staff has determined that North Bay Construction, Inc.'s bid satisfies
the bidding requirements for the project; and,
WHEREAS the Certificate of Occupancy for the Apartments must be issued in a
timeline determined by the lenders to the project.
Resolution No. 2005-008 N.C.S.
NOW, TIIERFORE, BE IT RESOLVED that the City Council of Petaluma:
• Approves the project budget and interfund loan from the Low-Mod
Housing Fund.
• Appropriates the funds to be reimbursed upon completion of construction.
• Awards the contract in the amount of $595,011.50 to North Bay
Construction, Inc.
• Directs staff to issue a notice of award to North Bay Construction, Inc.
• Modifies resolution 2002-019 N.C.S., condition 23, to allow a Certificate
of Occupancy to be issued if the required improvements are underway;
and authorizes the City Manager to execute the contract, subject to review
and approval of all contract documents, insurance certificates.
