Regarding the use of Rocky the Police Dog to determine 13 whether or not there are drubs on the local school campuses; this is a good way to is determine whether or not the DARE program has worked. If it has not, we should know is that also. 16 Don Canardo, Carl's Market - he thought this was over, how long does this go on. If you i~ allow time for Mr. Hooper to speak on Food 4 Less, then we wish to have equal time. is Karen Greene, 311. Olympic Court -spoke about their opposition of Rainier. She is opposed i9 to being assessed for it. She opposed the comments about their position that she read in the zo Press Democrat. Zi COUNCIL COMMENTS 22 Lori Shea -She is happy there are $195,000 coming to Petaluma for schools and she looks z3 forward to talking with the se#esl~ vJow~-k. ~ ,~h. .d -}c a o..~$ w ~ sck~ ~ « ~9 za Mayor Hilligoss -She noted that the City can't asses developed property for ainier.~o~.cro zs LETTER FROM FOOD 4 LESS i6 Mr. Michael Hooper of Food 4 Less had written a letter requesting an opportunity to a~ respond to statements made during the public hearing about the project, because he did not 2a have an opportunity to do so at the Council meeting. He noted that he did not jump up to 29 ask for an opportunity at the time. After a great deal of discussion among the Council 3o members, it was established that one person from each side would be able to speak for 15 3t minutes each at the next Council meeting. The Mayor will determine who goes first by 3z drawing straws. Carole Barlas abstained from this discussion due to a potential conflict of 33 interest. 34 COUNCIL VACANCY 3s It was agreed to invite letters of application from interested registered voters of the City for 36 the Council vacancy. Speakers included Matthew McLaughlin of Lohrman Lane was 37 shocked that there was not a full Council; Terry Kosewic, utilize the Council candidate Page 210, Vol. 28 May 9, 1994 appointment night like any other candidates' night; Lee Heinz from the Chamber of Commerce supported making the appointment soon; William Brotman suggested not to ask questions about specific projects. Each Councilmember will submit questions to the City Manager who will prepare a questionnaire for interested parties. The questions are not to be project specific. The questionnaire will be forwarded to each applicant. All applications .and questionnaires are due at City Hall no later than May 24. It is the Council's intent to interview and appoint at the June 6 meeting. ORD. 1956 NCS , SMOKING ORDINANCE The Council discussed provisions of the smoking ordinance. ;Speakers included Mike Lippitt, S:151 Montero Way, Sonoma Joe's Casino and New York Deli (one of the owners) - although he is not a smoker, the cardrooms do have 4 walls and a supplemental air system. He suggested the cardrooms be allowed to have smoking. Richard Goldberg, Sonoma County Health Department -The Sonoma. County ,ordinance urges the Council not to allow exceptions to the smoking ordinance prohibitions. Regarding the bingo games, Rohnert Park has 1 bingo game. which allows smoking, the. others do not allow it. Cloverdale and Windsor are the cities that have not yet considered this issue. Martha Saly, 240 Liberty Street, representing the American Lung Association. -urged the Council not to allow smoking. Every card parlor in Marin and Napa counties is no smoking. Waitresses and bartenders suffer. Louis McCarthy, 539 Midvale Way, Mill. Valley - a lot of food is served at Sonoma Joes. He talked about a Garden City lawsuits regarding smoking. Michael Rosenthal, 1216 E1 Cide Court, Mill Valley - is an employee of Sonoma Joes who urges the Council to ban smoking at card rooms. John Rumsey, 33 Marquard Avenue, San Rafael - is a customer of Sonoma Joes who supports banning smoking at the cardrooms. Sarah Richardson, 24 Skylark Ct. -works for Sonoma Joes and likes it there. Urged the Council to ban smoking in cardrooms. Ken O'Donnell, .605 St. Francis -works at McNear's Restaurant -asked the Council to .make level playingfields"" at the restaurant/bar locations. They are surrounded by bars which will be the only ones that allow smoking. Rick Kropp, 55 Maria Drive -North Bay Health Resources Center -there are no .public school laws; what there is on the books is Proposition 98 funding. If they want that money, the schools must- have a "smoke free" policy in fiscal year 1996. Smoke doesn't go away. It is recycled day after day. The Council agreed- to prohibit smoking at bingo games, in cardrooms, and private clubs which allow. non-members to enter. Regarding restaurants/bars they will allow 90 days (August 1), for those .locations to decide how they are going to address the smoking issue: As long as the. business shows they are attempting to comply, there will be no :problem. May 9, 1994 Vol. 28, Page 211 i If a business does not show that it is making progress, staff will pursue the subject with 2 them. 3 Staff will advise the Council if there is any problem with the bingo issue. There was discussion as to whether or not the entire length is of East Washington should be included in the study, or as staff had suggested from the is intersection with McDowell Blvd. westerly to Ellis Street. i6 Staff advised the Council the information utilized in the Rainier EIR for "No Project" is i~ based on up to date criteria and data. It was also noted that the General Plan includes such is ideas as "developing people pockets" and "traffic reduction" alternatives and other i9 "spectacular concepts for the future", such as the more intensive land uses should be built 20 near the areas where transportation is available. Staff agreed they need some education on 2i traffic innovations. z2 Jack Balshaw suggested looking at the construction of a northbound off ramp on the i3 northerly side of East Washington. That would make longer left turn stacking lanes on East za Washington for eastbound vehicles planning to turn northerly on North McDowell. In turn, zs that would reduce the traffic backing up onto the 2-lane eastbound portion of the Highway 26 101 overpass, because that is where the left turn vehicles have to stack .now when they run z~ out of space. Maybe one could evn make the overpass three lanes eastbound. He also zs suggested having the traffic engineers for the shopping centers make some suggestions for z9 traffic improvement. 3o The Council asked whet they will derive from the study, what are they fixing? The Level of 31 Service answer is there are delays of over a minute between 5:00 p.m. and 6:00 p.m. at the 32 intersection of East Washington and McDowell. 33 It was noted that if the Council did make a decision on Rainier, the project will still be 6 to 7 34 years before it is final. 3s Resolution 94-113 NCS approving contract with CSW/St'~ for consulting services to be done 36 on a "time and expense basis" not to exceed $66,368 plus 8% contingency on the East 37 Washington Street corridor between McDowell Blvd. and Ellis Street.
