He would like to iz put off Rainier until we have a new Council member in place. We should pick a date 13 when we will decide on the process. is Vice Mayor Read -agreed. is Lori Shea -agreed. 16 Mayor Hilligoss -feels that Rainier should be discussed now. i~ Vice Mayor Read -Petaluma is concerned with gangs and crime, according to the Press is Democrat. We have an opportunity to look at an anti-graffiti ordinance. She suggested 19 the City should limit the purchase of spray paint cans and markers and look at something 20 to eradicate graffiti. There are not enough food dollars in Petaluma to support this store. Traffic ~ will be bad. It is too large for the site. Feels this violates 10 General Plan policies. This a will bring in~Chuck E. Cheese and others. 9 Ron Stornetta, 1239 Kresky Way (Lucky's employee)- this project will cause a io bottleneck. He, counted the employees at Rohnert Park - 50 people. He thinks employees ~i of Food 4 Less will park in the Lucky's lot across the street. Is concerned- about traffic. iz Joe Daly,. represents V.F.C.W. Union -Lucky brought in good jobs, Food 4 Less will 13 tear that down. Too many of Zs us have to leave town to shop. 'The applicant has complied and is doing everything z9 correctly. Purchasing at Food 4 Less .has saved him money. What he has bought at Food 30 4 Less cost $66 whereas at Lucky it would have cost him $$1 31 Michael Mulhern, Architect for Food 4 Less -spoke about how they have improved the 32 turning radius at the driveway entrances: and exits at Food 4 Less by making them much 33 larger and easier to utilize, he noted the proposed traffic signal. at Lindberg will result in 34 more safety for .ingress and egress from both Lucky's and Food 4 Less. They have 3s planned for 3 delivery docks and they a lot of delivery truck stacking room. The parking 36 is entirely 10 feet by 20 feet, larger. than the City standard of 9 feet by 19 feet,. and ,there 37 are no compact parking spaces. There are 180 parking spaces. To determine normal 3a parking counts at a Food 4 Less, they checked the Rohnert Park Food. 4 Less store which 39 had 108 to 13.4 vehicles parked there between 5:00 and 5.:30 p. m, from March 7 to ao March 13. That is the busy time for local grocery stores. He showed the elevations for ai all sides of the store. Apri125, 1994 Vol. 28, Page 197 i Michael Hooper, the applicant - he explained about the Fleming Company .franchisee z, stores and that the Vacaville store is not Fleming, rather it is under Ukiapah management, 3 a Fleming competitor. He felt the reason for the appeal by the Lucky's manager, Carl's a Market, by Hagstroms and by the Union 'is a competition based appeal. He described s Food 4 Less as a warehouse designed to minimize costs through sale of large volumes of 6 grocery products and less service than the normal supermarket. The stock a limited ~ product range and there are no baggers at the check-out stand. They have 100 to 150 a employees who work shifts of 10 to 35 at a time. They usually have fewer truck 9 shipments than the normal stores. The size of this store would be 48,600 square feet as io opposed their other markets which are 50,000 to 51,000 square feet. The parking spaces ii are at 3.7 spaces per 1,000 square feet. They receive 6 days a week mostly between 4:00 i2 a. m. and 9:00 a. m. , although some deliveries ate somewhat later, and the Fleming trucks 13 come in at about 10:00 p.m. It is their plan to move the`trucks through the delivery cycle 14 as quickly as possible. If drivers find a certain delivery time to be a problem, they alter is the time so that it works out well for them. Although in super markets some of the i6 delivery truck drivers pack the shelves with their products, this is done mostly with Food i~ 4 Less employees. is Regarding traffic the Level of .Service between Caulfield. and Lindberg is Level B. He 19 said they do not cause the Level of Service to deteriorate because of the traffic ao improvements they will put in. Zi The Land Use is consistent with the General Plan, is consistent with the Zoning 22 regulations and they are not impacting the wetlands. In fact they are cleaning up the 23 wetlands that are adjacent to the area. z4 He concluded repeating the consistency with the General Plan and with Zoning, this has is been endorsed by SPARC and recommended by the Planning Commission and by staff. z6 The project exceeds City standards. It meets industry standards, it benefits Petaluma and z~ a majority of Petalumans wish to have a Food 4 Less. He handed the Mayor a petition Za with 433 signatures of Petalumans who wish to have Food 4 Less in town. 29 Recess 8:50 to 9:00 p.m. 3o Bill Smith, Landscape Designer of Food 4 Less -reviewed the landscape design plans for 31 the store. He noted that this is 3 parcels of land put together for this use. They plan to 3z plant about 90 trees. He estimated there would be one acre of landscaping on a 4 acre 33 site. 34 Charles Patterson -biologist retained by the City -there will be no impact of wetlands. 3s The applicant will clean up the wetlands that exist. The project has received approval 36 from the Army Corps of Engineers and Fish and Game. 37 Adam Loveall, union .spokesman -you declared tonight wasn't about economics. This is 3a about economics. Food 4 Less is unfair competition. This will cause alay-off of 39 workers. The petition may not be objective. . - ao Lloyd Cole (works for Albertsons) - he has lived here 25 years. There is too much ai traffic. a2 Judy Allewelt, does not work for a grocery store -shops in Petaluma -problems exist 43 here: There are problems at the Gateway Shopping Center, there are problems at the 44 Payless Shopping Center; at the exit from the Big 5, at Eastman Video at Back to Basics. Put this near the factory outlet. This is a gateway to Petaluma. is The pie is only so big and. he hates to see another .grocery store come in to town. This is 16 going to cause gridlock. The outside storage will show. i~ At 9:55 p. m. the hearing was closed. is In answer to Council's questions, Planning Director Pamela. Tuft said this the best 19 possible design for this site. The Council talked about the parking space numbers, asked Zo about the storage, of pallets and boxes behind the site, asked if there is any way to avoid u the trucks drivrng through the parking, lot, discussed the 17 employee parking; spaces and Za asked where the rest were going to park,. the Level of Service of the various streets in the z3 area with and without the project. The speed on Lakeville with the traffic improvements z.a would be what? is Staff responses included: The Level of Service at Caulfield and Lakeville with no project 26 is LOS. B and with the project is LOS C. The left turn: from Lindberg to Lakeville is 2~ currently LOS E. or F. The Highway 101 interchange will be improved as part of the Zs Lakeville widening. The traffic signal being required at Lakeville and Lindberg will 29 improve traffic flow in the area. There are sufficient parking spots to allow employee 3o and customer parking. With the traffic lights coordinated, traffic will move at a different 3i traffic flow. The conditional use is' not for temporary businesses, rather it is to facilitate 3z public participation. 33 Council comments included: The size of the lot seems too small for the. project. This is 34 too large a building for this site. There is not .enough parking.: This is intensification of 3s use on Lakeville. This is a land use issue. There is no overflow for employee parking. 36 This is an accident waiting to happen. We have an .opportunity to say no. 37 I think if we are going ,to approve a Food 4 Less, the next time we will have a Chuck E 3s Cheese. Regarding competition, if: the Food 4 Less were bringing something that we 39 really truly need to Petaluma like a hundred head of household jobs with benefits, then I ao would be willing to go out on a limb and take a risk, sinceā€¢ it's not and is actually ai threatening some jobs that we ,already have here I am not willing to work with such close a2 margins in the parking lot, traffic count. Apri125, 1994 Vol. 28, Page 199 1 When Lucky's came down the road we took testimony that said Lucky's was the straw 2 that broke the camel's back, and as we sit here tonight, Lucky's is again talking about 3 putting in something that will have a very onerous affect on people's jobs. We can no a more regulate stores of this kind, than any other kind of store. s This project fails on the following set of issues: the site plan for safety, for efficacy, or 6 anything that would make me believe that this is a great use for the site. The concerns ~ expressed about the rear of the .store will probably happen. The 17 parking spots being a reserved for employees where delivery trucks pass, knowing that truck drivers may cut 9 corners when they are in a hurry. Lakeville Highway is not necessarily improved by this to use. The garbage at the rear and the trucks will cause problems. There are major 11 concerns for the entrances to the City. There is concern about the trash and the backing- 1z up. 13 It was moved the appeal be approve the appeal thereby denying the conditional use la permit. There was no vote taken. Staff will come back on May 16 with legislation to is confirm Council's action. 16 MAI' 9 MEETING 17 The Council agreed to an evening meeting on May 9 to discuss the Council vacancy, 18 introduce the smoking ordinance and discuss the scope of work for the engineering 19 consultant for North McDowell/Washington.
