Balshaw -Regarding the 5-year Capital Improvement Program for signals,. he feels 19 the businesses in the area of B Street and Petaluma Blvd. are very concerned about the 20 potential of losing about 14 parking spaces if additional left turn lanes are required for the 21 traffic signal improvements. PIIASE 1 27 Resolution 93-137 NCS approving the fi nal map for Country Club Estates Unit 2, Phase 2s 1. 29 * * * * * End of Consent Calendar 3o RESO. 93-138 NCS 31 PURCHASE POLICE RADIOS 32 Resolution 93-138 NCS authorizing purchase of 15 portable radios from North Bay 33 Communications for a purchase amount of $27,214.97. This was removed. from the May 34 17 agenda..for further staff research on the bid submitted by Empire Communications 35 showing a 20% discount. Police staff advised the Council that although. this would make 36 the Empire bid the lowest bid; however, the bid did not include the required 37 microphone/headsets. In addition, the radios are of a size larger than Police 3s specifications. Therefore, the Police Department recommends purchase from North Bay 39 Communications. The Council thanked Officer Long for refining .the staff report. This project 13 includes highway corridor improvements, widening and channelization, signal 14 interconnect, and coordination, pedestrian and bicycle enhancements and bus stops. The 15 Federal Intermodal Surface Transportation Efficiency Act funding maximum will be 16 $480,000. Total estimated costs are $1,174,000. It was noted this project has a very 17 tight time line and it is hoped that CALTRANS will assist in meeting the needs of the is City. It is hoped the work will be complete in time for the factory outlet opening in late 19 1994. This 4-acre site is 31 the specific section of the Corona-Ely area which has been set aside for manufactured 32 housing. 33 Future Lot Line Adjustment - In addition to the affordable housing site ownership 34 change, there will be a lot line adjustment which will bring a'triangle of 17,465.46 square 35 feet located between the reconfigured Ely Road and the subdivision into the Wisteria site, 36 and a second triangle equalling 2,626.75 square feet of the Wisteria site will go to the 37 neighboring Gatti land. Those who spoke were: 5 Lakeville Highway Shirley Probst, 1292 San Rafael Drive -She .requested that the sound 6 wall on Lakeville Highway be extended three hundred (300') feet up Casa Grande Road :~- 7 for residents' relief from traffic sounds. s Cherry Street Robert M. Hunt, 271 Cherry Street - He has submitted a letter outlining 9 his view of hazards on :Cherry Street, He suggested the half barricade. at the crest of the io street is dangerous and a. full barricade should replace it. 11 Washington .and McDowell Intersection Terrence Finn, Washington Square Associates - 12 Expressed concern that the Rainier Overcrossing of Highway 101 will not improve the 13 bevel of Service at the Washington and McDowell intersection. He asked- why not 14 improve the Washington and McDowell intersection. Mr. Finn was referred to the 15 factory outlet environmental impact report for the most current estimate on that 16 intersection's level of service. 17 Washington and .McDowell Intersection Stan Felix, representing the Plaza, the .Plaza 1s North and Washington Square. He supports the Rainier Avenue Overcrossing, but feels 19 that will. not be of value to the merchants. at the three sites he is representing tonight 20 because the level of service at the Washington and McDowell Intersection will not be 21 improved. He asked what impact the Santa Rosa Junior College traffic will have on the 22 Washington and McDowell intersection. He noted there is right-of--way already given to 23 CALTRANS for the purpose of ,improving the Highway 10.1 access and. egress.. He 24 offered his assistance to the City, to meet at any time and to help with what ability they 25 have to alleviate the Washington and McDowell intersection bottleneck. 26 Caulfield Lane between Highway 10.1 and McDowell Andy Akelman. ll$5 Lombardi 27 Avenue -Said the noise and debris thrown from vehicles impacts their backyards. 2s Caulfield Lane between Highway 100 and McDowell Ray Handyside, 1333 Lombardi 29 Avenue -Bus passengers wave at him in his house, profanity is often heard from the 3o sidewalk, .people- tear off pieces of his picket fence, he found a homeless man sleeping in 3~ hisba~kyard (the man apologized for being. there, and fixed the fence as he left), this has 32 lowered the value of `his 'home. 33 The staff report was continued to the next regular Council meeting on June 21. 34 RESO. 93-140 NCS. 35 CDBG -INDEPENDENT ENTITLEMENT STATUS 36 Resolution 93-140 NCS authorizing application for independent entitlement status with 37 the Department of Housing and Urban Development for the Community Development 3s Block Grant program. If. this "independ'ent entitlement'° status is granted, use of available _ 39 funding will be' under .local control (within CDBG guidelines). With this new status, 4o there is a limit for use of CDBG funding to assist with administration costs. June 7, 1993 Vol. 27, Page 355 CDBG - coat' d. 2 After adding wording that indicated the Council's intention was to continue the funding 3 for the Committee of the Shelterless through utilization of sources of income other than 4 CDBG money, the resolution was introduced by Jane Hamilton and seconded by Lori 5 Shea. 6 AYES: Nelson, Read, Shea, Hamilton, Mayor Hilligoss 7 NOES: None 8 ABSENT: Barlas, Vice Mayor Sobel (Councilwoman Barlas was attending 9 the Sonoma County Transportation Authority meeting in Santa 10 Rosa) 11 CL®SEI) SESSI®N 12 The Council went into closed session to discuss potential exposure to litigation. 13 AI)J®UItN 14 The meeting was adjourned to Carrows for dinner. 15 ROLL CALL 7:00 p.m. 16 PRESENT: Nelson, Barlas, Read, Shea, Hamilton, Mayor Hilligoss 17 ABSENT: Vice Mayor Sobel 18 IMPORT IF'ItO1VI CL®SED SESSION 19 The City Attorney stated that it has recently come to the attention of the City that a 20 member of the State Assembly has requested an opinion from the Attorney General on the 21 issue of whether or not it is permissible for a County Board of Supervisors to have an 22 invocation at the beginning of board meetings. He stated that the Attorney General's 23 Office has indicated that it is in the process of reviewing and researching the issue and 24 will be preparing and issuing an opinion in the near future. 25 Pursuant to an individual's indication at prior meetings that he would sue the City should 26 the City pursue its opening ceremony policy, the Council met in closed session under the 27 appropriate provisions of the Brown Act and made a decision in this regard. Due to the 28 pending review of the issues by the Attorney General's office, the Council has decided at 29 this time, that for a reasonable period of time while awaiting the Attorney General's 3o Opinion, it will hold in abeyance its opening ceremony except for the pledge of 31 .allegiance. 32 PLEDGE OF ALLEGIANCE 33 Ross Parkerson led the Pledge of Allegiance. 34 PUBLIC C®NIlVIENT 35 Paul Lauterjung, 1755 Spyglass Road -spoke in support of continuing the invocation. 36 He quoted several documents written in the 1600's and 1700's when this country was 37 taking its cultural form. 3s Irv Sutley, P. O. Box 174, Glen Ellen -said the Parks and Recreation Department is in 39 violation of Article 16 relating to churches (renting Lucchesi Community Center to 4o churches). Under New Business this afternoon the City introduced an ordinance 41 authorizing transfer of property to Northbay Ecumenical Housing; he asked the City 42 Attorney if this also violates the constitution. He referred to a recent Utah Supreme 43 Court action on the subject. `.r. . Page 356, Vol. 27 June 7, 1993 1 Vince Landof, Cordelia Drive - read a letter opposing. the stand of Mr. Sutley and 2 supporting continuation of the City Council's Invocation. 3 COUNCIL COMMENT 4 Carole Barlas -noted there is a Sonoma County Transportation Coalition on Monday, 5 June 14, from 6:30 to 9:00 p.m. in the Santa Rosa Library Forum Room to which the 6 public is invited. ~ Bonnie Nelson -took exception to a letter that. a member of the public wrote to the Argus s Courier. The letter .spoke in opposition to Mrs. Nelson's actions in connection with 9 McNear Park, and: it stated that Mrs. Nelson lived near the park. As a member of the to Recreation Commission, as a Councilmember and. as a resident. of the City, the 11 Councilwoman expressed her right to be attentive to such City matters even. though she 12 does not live near the park. 13 Nancy Read -noted that the Novato City Council wishes to continue the dialogue with 14 this Council and suggested that a meeting be scheduled to be held in Petaluma. 15 Nancy Read -noted the State Legislature is continuing to develop statewide smoking 16 regulations. 17 Nancy Read -there is a .need to agendize the Viacom situation regarding which television 18 stations they will carry. There has been some concern on the part expressed to her that 19 KTEH and C-SPAN coverage will be eliminated or changed. 20 Jane Hamilton. -wishes the Council to discuss the goal,of the General .Plan to have a teen. 21 center in -Petaluma.. Kenilworth was discussed as being that -site. She asked for a staff 22 report and for a Council brain-storming session. 23 Mayor Hilligoss -reported she attended activation of the 223rd .Battalion on 'Sunday 24 morning in Petaluma. They are linguists who speak 14 or more languages and are sent 25 all over the world to translate. They came from as far as Eureka. 26 RESO. 93-141 NCS 27 STREET' TREE LIST' 2s Resolution 93-141 NCS approving the list. of trees acceptable for planting adjacent to 29 public streets and sidewalks m the City. That will be an average cost of $3,521 per 12 house. In response to the question posed by Charlie Carson of the Northern California 13 Building Industry Association regarding when the resolution would be effective, he was 14 advised it is effective immediately. It was noted that the fee is calculated at the time the 15 final map is approved; therefore, any map that comes to the Council subsequent to this 16 action will reflect this new parkland fair market value. Mc Near Peninsula 2s 2. Alman -Van de Wark property which is adjacent to the Marina 29 area 30 3. Holmberg property which is located off of Lakeville Street where it 31 crosses the railroad tracks and behind 610 Petaluma Blvd. North 32 The grants must be met with a 50% match from the City. It is staff's understanding that 33 the local grant match may come as improvements to the property, administrative costs, 34 monitoring and maintenance over time.
