He requested 12 that the Council agendize this matter to discuss how to proceed. The matter was referred 13 to the Assistant City Manager Beatty by the Council. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 MINUTES The Minutes of July 20 were approved as corrected: Page 132, Ord. 1899 NCS Bonnie Nelson made some comments during the discussion that she wished. to have included in the minutes: Add, "There is a double standard here. The schools all have signs which say "NO DRINKING", but the ball players are not required to adhere to that rule. They are abusive, they leave their beer cans at the ball park, and are disrespectfiil to the schools' security guards. These adults are "allowed to do as they please" at the ball parks." The Minutes of July 27 were not included. The Minutes of August 3 were approved as submitted but Lynn Woolsey alerted the Council that she was going to make comments about requiring regional labor forces to be used for the Chateau project. This represents $6,468.76 from Security Pacific National Bank 1o for the Petaluma Multi-Family Rental Housing Revenue Bonds, 1983 Issues A & B. 1 i RESO. 92-212 NCS 12 SPECIAL ASSESSMENT CONTRACT WITH COUNTY 13 Resolution 92-212 NCS authorizing the Finance Director to execute a Special Assessment t4 agreement with the County of Sonoma and authorizing tYie City Manager to execute the 15 agreement with the County for collecting assessments for the City. i6 RESO.. 92-213 NCS 17 ASSESSMENT DISTRICT 14 1s Resolution 92-213 NCS declaring a surplus in the Improvement Fund for Assessment 19 District 14 and authorizing the City to reduce the debt by applying that surplus of 20 $353,700 to the principal owing on that assessment district:. 21 RESO. 92-214 NCS 22 FINAL MAP FOR CADER FARMS PHASE III 23 Resolution 92-214 NCS approving the final map for Cader Farms Subdivision Phase III. 24 RESO. 92-215 NCS 25 WASTEWATER TREATMENT FACILITY PLANNING CRITERIA 26 Resolution 92-215 NCS approving the planning criteria, as discussed at the July 27 Study 27 Session of the City Council, for the new Wastewater Treatment Facility. 2s RESO. 92-216 NCS 29 AMICUS ASSISTANCE 3o Resolution 92-216 NCS in support. of t11e City of Santa Rosa with respect to its position 31 for Writ of Certiorari with- the United States Supreme Court in the case of Steen v. 32 Thompson, et al. This Santa Rosa case concerns a Santa Rosa Police action relating to 33 rapid entry. According to the memorandum from -the City of Santa Rosa, this is critical 34 to every peace officer m the state who serves a warrant under perilous circumstances. 35 * * * * * End of Consent Calendar * * August 17, 1992 Vol. 27, Page 149 CHATEAU PROTECT REDUCTION IN FEES 2 The Council discussed the resolution authorizing reduction in Community Facilities 3 Development Fees to $346.25 per unit and Park and Recreation Land Improvement Fees 4 to $586.52 per unit for the Chateau Senior Housing Project of Petaluma to be located just 5 north of the Plaza North Shopping Center and across the street from the Lucchesi 6 Community Center. This was on the agenda to confirm the Council's action of August 3. 7 Lynn Woolsey asked the developer, Mr. Shelton Baxter, if he was going to hire regional s workers for the Chateau project. He said they do not have a contract with a specific 9 developer at this time, but they will do their best to hire local workers. After much to discussion about the use of local workers, the matter was continued to the September 8 11 meeting to give the developer a better opportl~nity to talk to the construction company 12 they usually use. 13 14 RESO. 92-217 NCS AFFIRMATIVE ACTION GOALS 15 Resolution 92-217 NCS approving goals for the Affirmative Action Plan for Fiscal Year 16 1992-93. The Council concurred that an analysis report of the City's applicants for 17 employment be included with next year's affirmative action proceedings. Before the 18 resolution was introduced, the affirmative action plan was amended to add the words, 19 "over and above the current year's force." Introduced by Lynn Woolsey, seconded by 20 Bonnie Nelson. 21 AYES: Read, Davis, Woolsey, Vice Mayor Cavanagh, Nelson 22 NOES: None 23 ABSENT: Mayor Hilligoss, Sobel 24 ORD. 1901 NCS 25 ~ TEMPORARY APPROPRIATIONS 26 Mayor Hilligoss arrived at 4:20 p. m.. Introduce and adopt urgency Ordinance 1901 NCS 27 appropriating funds to operate for an additional 60 days to October 31. It was noted that 28 the ordinance supercedes Ord. 1890 NCS adopted on June 29. It really should be spread some because there still are 13 persons who cannot afford to purchase a house here. It was agreed that, although she 14 was in touch with Bonne Gaebler in the Housing Department already., she should. write is Mrs. Gaebler a letter for the Council's Housing Subcommittee to act upon. t6 Peter Rodda, 23 Meadowglen Drive -That traffic light, that the City plans to install on 17 Petaluma Blvd. South as soon as the McNear Hill developmena is built, should. be built 1s sooner for traffic safety. Tom Hargis will develop a report for the City .Council on t9 various ways to pay for that over $.100,000 signal. 20 CITY COiJNCIL COMMENTS 21 Michael Davis -spent two weeks at the Eagle Lake area with cows and people in the 22 same area, It reminded him of the Lafferty Ranch. He was advised there wilf'be a report 23 to the Council soon. 24 Lynn Woolsey -asked for a report from Police Chief De Witt on the use of radar- guns. 25 She thinks the City should join the other municipalities that have put their radar guns 26 away until there is some resolution to the question whether or not the guns give police 27 cancer. 2s Bonnie Nelson -her Yugoslavian student has arrived and she hopes the .student does well 29 this year. 3o Mayor Hilligoss -said thanks to the people who put on the River and Old Adobe 31 Festivals last weekend. 32 PRESENTATIONS 33 The Pedestrian Safety Award for 1991 was presented to the Police Department from the 34 California State Automobile Association. 35 APPOINTMENTS August 17, 1992 Vol. 27, Page 151 1 PLAN1~lING COMMISSION 2 The following persons had applied for appointment to one seat to be vacated by Dan 3 Libarle on the Planning Commission: 4 Beverly Alexander Jay Lucien Beverly Bond T. No vote was taken because there were five openings. 4 s Walter Kuttner 6 Mary Lopez de Abascal-Hildebrand 7 Annette McElroy 8 Kathy Paradies 9 Tracy Tomasky 1o RECESS 8:45 - 8:55 P.M. 11 HIV NONDISCRIMINATION ORDINANCE 12 The City Council reviewed an HIV (Human Immune Virus) Nondiscrimination Ordinance 13 which has been adopted by some Sonoma County Cities and the Board of Supervisors. 14 Deamon Doss (Petaluma HIV Education Task Force), Pat Kuda (Sonoma Public Health 15 Department), Jeff Doutt (Chairman of the County AIDS Commission and Dean of the 16 School of Business & Economics at Sonoma State University), Karen Howard (Member 17 of County Aids Commission), Reed Bruce (is infected with the virus), and Jim Spahr is (Volunteer for the HIV group) spoke on behalf of asking the City to adopt such an 19 ordinance. 20 It was introduced by Lynn Woolsey, seconded by Brian Sobel, to direct 21 staff to prepare such an ordinance for the Council to adopt. 22 AYES: Read, Davis, Woolsey, Vice Mayor Cavanagh, Mayor Hilligoss, Sobel, 23 Nelson 24 ABSENT: None 25 NOES: None 26 RESO. 92-219 NCS 27 WASTEWATER TREATMENT FACILITY COMMITTEE APPOINTMENTS 2s Resolution 92-219 NCS appointing the Wastewater Treatment Facility committee. DEC. 11 CHATEAU SENIOR HOUSING PROTECT PUD AMENDMENT 12 Approving negative declaration for the Chateau Senior Housing Project located on North 13 McDowell across from the Lucchesi Community Center and approving PUD 14 Amendment for Chateau Senior Housing Project were continued to the next Council 15 meeting by Council consensus. 16 CHATEAU PRO.IECT REDUCTION IN FEES 17 It was agreed that this item from the afternoon meeting would also be carried to the next is meeting. 19 20 ORD. 1902 NCS PARK PLACE III PUD AMENDMENT 21 Introduce Ordinance 1902 NCS amending Park Place III PUD to permit garage 22 conversions in single-family dwellings. After some discussion, the ordinance was 23 introduced by Lynn Woolsey, seconded by Nancy Read. 24 AYES: Read, Davis, Woolsey, Vice Mayor Cavanagh, Mayor Hilligoss, Sobel 25 NOES: Nilson 26 ABSENT: None 27 ORD. 1903 NCS 2s SUBDIVISION AMENDMENTS 29 Introduce Ordinance 1903 NCS making Municipal Code amendments to Section 30 20.16.320 regarding setback lines and elevations and deleting Section 20.24.200 building 31 setback lines to be shown on the map. Introduced by Brian Sobel, seconded by Vice 32 Mayor Cavanagh, 33 AYES: Read, Davis, Woolsey, Vice Mayor Cavanagh, Mayor Hilligoss, Sobel, 34 Nelson 35 NOES: Nona 36 ABSENT: None 37 SEWER RATES INCREASE 38 The Council continued the resolution approving a sewer rate increase by 30% for 39 residential from $10.00 to $13.00 per month, and the non-residential rate to the greater of 40 $13.00 per month or $1.3673 for each 100 cubic feet per month, whichever is higher. 41 The former non-residential rate is $10.00 per month or $1.0518 per 100 cubic feet, 42 whichever is higher.
