to Jack Balshaw, 1680 Kearny Court -expressed concern that landscaping that has been so

3o City Clerk Pat Bernard led the Pledge of Allegiance.
31 PUBLIC COMMENT
32 Jim Schultz of Main Street Association noted there is a hearing on a bill in Sacramento
33 relating to Unreinforced Masonry Buildings - AB-1963. The provisions of this legislation
34 could cont7ict with the proposed State legislation proposed by the City of Petaluma. He
35 asked that the City keep an eye on that legislation and urge that it be amended.

COUNCIL COMMENT
37 Michael Davis, agreed with a suggestion that there be a permit process for tree trimming.
3s Perhaps there should be photographs of "preferred result" and "how not to trim a tree".

i Nancy Read, tomorrow at 8:30 a.lll., the Board of Supervisors will be presenting a
2 "gold" resolution to Vice Mayor Woolsey for her work on the Hazardous Materials
3 Committee.
4 Jack Cavanagh, suggested the Councilmembers look at the recent Legislative Bulletin
5 report on SB-1538 and make their recommendations to the City. The hearing is .this week
6 and the League of California Cities is requesting that member cities send comments to
7 them.
s Bonnie Nelson, she reiterated her request to discuss "subcommittees" at a Council
9 meeting.
io Bonnie Nelson, emphasized the need to leash dogs. She recently watched a jogger (with
~ ~ leash in hand) running with his unleashed dog. Shortly thereafter, the dog ran into the
12 street and was killed by an automobile and the jogger was distraught.
t3 Bonnie Nelson, children will be out of school soon. They often get bored and taunt and
14 molest at the wildlife. She pleaded with the public to encourage the children to leave the
is animals alone.
15 Bonnie Nelson, visited the Rosenberg Building in Santa Rosa which is sheltering
17 homeless persons. Since our Armory closed, our homeless have been taking care of
is themselves. It would be so wonderful if the Armory didn't have to open for them
19 because there would be a year-round location for their shelter. COTS is working to make
20 this happen.
21 PROCLAMATIONS
22 The Mayor presented .proclamations to Sgt. Jim Wesson and Officer Ralph Evans for
23 their role In a rescue in the Petaluma River.
24 CABLE `T'ELEVISION FRANCHISE
25 Viacom has formally noticed the City of Petaluma that it intends to renew the cable
26 television franchise with the City. The notice was submitted within the required 30 to 36
27 month (prior to end of fra~ichise) renewal window. The- franchise expires in December of
2s 1994. Assistant City Manager Gene Beatty recommended the City should invite the
29 public to the, widest extent possible to participate in this decision.

32 Resolution 92-129 NCS initiating franchise review and establishing a Community Cable
33 Advisory Committee. The committee shall consist of:

1 In addition, the resolution authorizes and directs staff to solicit proposals for technical
2 assistance (as well as specialized legal assistance) as deemed appropriate by the
3 committee; and, the resolution authorizes and directs staff to work with Viacom to
4 explore the establishment of anon-profit organization to develop and oversee the public
5 access needs of the community. Assistant Manager Beatty advised that, at this time,
6 Viacom has not offered to participate in the costs of this process.
7 It was noted the technology is changing rapidly, so length of franchise should be
s evaluated very carefully. Viacom will be evaluated for its past performance and for its
9 current service.
to A citizen distributed a letter to the City Council from Ann Englar, of Santa Rosa, who is
11 working with the City of Santa Rosa on their cable television franchise renewal planning
12 process. She offered to share information she has gleaned over the last 13 years. She
13 noted that Santa Rosa Junior College and Sonoma State University have developed the
14 Sonoma County Educational Teleconununication Consortium. She suggested they be
15 asked to participate in the franchise renewal process. Resolution 92-129 NCS was
16 introduced by Nancy Read and seconded by Brian Sobel.

22 ENERGY CONSERVATION PROTECT COMPLETION
23 Resolution 92-130 NCS accepting completion of the Energy Conservation Project for City
24 facilities. Western Energy Management has completed the evaluation of energy needs at
25 the City complex and has installed the necessary energy conservation appliances pursuant
26 to the contract. Tl~e total project cost is $158,014.00, w}~ich is $1,000 under the
27 contract. Representatives of Western Energy Management answered the City Council's
2s questions. It was noted approximately $29,000 will be coming back to the City in the
29 form of Pacific Gas and Electric rebates. The City's energy use has shown a decrease
3o already. Ned Orrett was complimented for having referred the City to this process.

37 TRAFFIC SIGNAL REIMBURSEMENT AGREEMENT
3s Resolution 92-131 NCS authorizing execution of a traffic signal payback agreement .for
39 the modification of traffic signal's at D Street, Sunnyslope Road, and El Rose Street.
4o This was a condition. of Westridge Subdivision approval contained in Resolution 89-11
41 NCS. Condiotti Enterprises has contracted for the modification of the signal. The cost
42 will be shared as follows: City share 90.95891 %, Subdivision portion 9.04109%.

11 HUMANE SOCIETY CONTRACT
12 Resolution 92-133 NCS authorizing a 3=year contract with the Humane Society for animal
13 control services in the City of Petaluma. There was discussion about the possibility of
14 identifying cats with a small computer readable object for feline identification implanted
15 in their ear. The Council requested information on the Santa Rosa feline identification
16 program. Janet Capini, 305 Liberty Street, had been watching the meeting on television
17 and she rushed down to the Council Chambers to suggest this item be continued until she
is could provide the City with a report on the manner in which Rohnert Park manages
19 animal control on the basis of a "no kill" shelter. The Council agreed to look at the
20 possibility of amending the contract with the Humane Society after they have had an
21 opportunity to review the .report offered by Janet Capini. The Council anticipates a
22 report from staff in a month. The second sentence of Paragraph 14 of the agreement was
23 amended by adding the word, "sole"... "this indemnity dies not extend to any loss,
24 damage or expense arising out of the sole negligence or willficl misconduct of the City or
25 the City's employees. " Introduced by Bonnie Nelson, seconded by Vice Mayor Woolsey.

33 Lucchesi Park on July 4, 1992, between the hours of 1:00 a. m. July 4, 1992, until 8:00
34 a.m., July S, 1992. It was noted that school grounds are not an appropriate alternative
35 site for private fireworks. Introduced by Brian Sobel, seconded by Bonnie Nelson.
