2 ORDER NIZIBIAN ANNEXATION (ADJACENT TO RANCHO LINDO)
3 Resolution 90-417 NCS ordering annexation for the Nizibian Subdivision located on
4 McNear Avenue adjacent to Rancho Lindo Subdivision. The Local Agency
5 Formation Commission approved the annexation subject to inclusion of approximately
6 900 feet of McNear Avenue. Introduced by Michael Davis, seconded by Vice Mayor
7 Jack Cavanagh.

13 GROUND LEASE - EMPIRE GOLF - E. WASHINGTON NEAR AIRPORT
14 Ordinance 1835 NCS authorizing the City Manager to enter into a 40 year ground
15 lease (plus a 20 year option) with Empire Golf, Inc., to develop a minimum 6,200
16 yard, 72 par golf course on City owned land adjacent to the airport. At the end of the
17 lease term, all improvements, plus an additional 33 acres to be obtained by the lessee,
18 shall become the property of the City.
19 The green fees shall not exceed the average fee computed by surveying five courses:
20 Peacock Gap, Windsor, Mt. Shadows North, Indian Valley and Oakmont West golf
21 courses. City residents shall receive a 20% discount off any published green fee,
22 resident seniors (over 62) and juniors will receive an additional 10% green fee
23 reduction. If the course were in operation at thig time, using -the foregoing formula,
24 thegreen fees would be $20 weekday and $28 weekends for non-residents, $16
25 weekdays and $22.40 weekends for residents, and .;$,14:40 weekdays and $20.,16
26 weekends for seniors and juniors. It was noted the newly renovated Sonoma. National
27 Golf Course green fees are at the $60 level. The Council asked that the specific
28 benchmark golf courses used to establish the green fee beevaluated every five years to
29 determine if there are other similar public use courses that could be brought into the
30 calculations. It is hoped that high school golf teams will be able to: have free play on
31 this course.
32 Regarding the girls softball fields, City Manager John Scharer advised the Counci
33 that staff has been working on this issue and he is confident there will be °`+
34 girls softball fields constructed in the area.
35 Mr. Scharer recommended that a working committee of 2 Recreation Commissioners,
36 2 Airport Commissioners, and 2 Councilmembers be established to work with the golf
37 course architect so the community interests are looked at and dealt with. It was
38 suggested the City look at placing an Open Space Overlay Zoning District on the golf
39 course. Also suggested were the continuation of jogging paths for public access from

46 The proposal to contract with Western Power Management Company (WPMC) of
47 Santa Barbara, Ned Orrett - local representative for an energy audit was continued
48 until staff is able to obtain additional information whether or not there are other
49 businesses performing this type of service.

3 Resolution 90418 NCS establishing .a .policy .for use of road undulations on streets in
4 the City of Petaluma: Upon recommendation of the Traffic Committee, staff
5 developed the following policy for Council concurrence.
6 A. Local Streets riot exceeding 40 feet in width;
7 Traffic counts between 1,500 -and 3.000 vehicles per day
8 B. Speed limit 25 to 35 mph
9 C. 2/3 of .the residents support installation of undulations

1 PUBLIC COMMENT
2 `Vince Landof, 12 Cordelia Drive, asked why the City can find .money to build golf
3 courses and marinas and no money for the flood fix. City Manager John Scharer
4 advised the public the City has money set aside for the flood fix, the problem at this
5 time is *the process that must be followed in order to receive U. S. Army Corps of
6 Engineers approvals. The Mayor noted the U. S. Army Cors of Engineers was
7 planning to do a "40 -year event" level of protection and the City wants a "100 -year
8 event" level of protection. Brian Sobel noted the bottom line is the U. S. Army Corps
9 of Engineers will not fund if the City does anything at all towards the -flood mitigation
10 prior to completion by the U. S. Army Corps of Engineers of their design and
11 approval process.
12 Skip Rigby, Stillson Drive, asked the City to install low flow toilets. The -
13 Councilmembers were pleased to advise him that ultra low flow toilets are required in
14 all new construction.

18 John Balshaw - expressed concern about the Sonoma County Sheriff Department high
19 speed chase through the City of Petaluma several days ago. A policy should be
20 developed that addresses this issue.
21 Michael Davis - there is a recycling program in Washington State whereby the lawn
22 clippings and the like are composted and distributed to residents for fertilizer. This

26 Brian Sobel - spoke to retiring Councilmembers John Balshaw and Larry Tencer in
27 appreciation of their countless hours of untiring dedication and hard work towards the
28 best interests of the community.
29 Larry Tencer - expressed his appreciation for the opportunity to serve the City as
30 Planning Commissioner and Councilmember adding that he has gained more from the
31 experience than he felt he has contributed to the City.
32 Mayor Hilligoss - having worked with Councilmembers Balshaw and Tencer for many
33 years, she has learned to respect them. Everything they did was for the best of the
34 City.

APPEAL
16 The City Council .devoted over three hours to the appeal received from Shell. Oil
17 regarding the Planning- Commission denial of a use permit for complete renovation of
18 the station located at Petaluma Boulevard' North and Payran into a self-service station
19 and car wash (continued from the. 10/15, 11/5, 12/10 meetings). Planning staff
20 reviewed the application,. Traffic Engineer Allan Tilton reviewed'. his "traffic study:. The
21 hearing was opened, and Attorney Derek Simmons, Consultant Greg Freitas, Traffic
22 Engineer Art Brooks, consultant Jim•Triforst and Dick Blankenship of Shell Oil. spoke
23 for the applicant. The following persons spoke about the application -:John Quinn of
24 2318 Magnolia, 'Dave Viviani of 26 -Payran, Bob Martin of 171 Payran, and David
25 Gunn, questioned. the traffic impacts to Payran Street and Petaluma Blvd: North. and
26 questioned the circulation on site.
27 Larry Dahl ,of 23.03 Marylyn Circle, who was required by the City. to install .more
28 'landscapingat his. Jiffy Lube than the Shell plan, showed, urge the Council to require
29 more landscaping.
30 There' was a great deal ,.of discussion about all. types of automatic car, washes.. (full
31' service to a no -prep wash. and air dry), whether or .not there would be. someone wiping
32 the cars as they exited, the car wash ,(it was :agreed no towel drying is to, be: allowed),
33 the number of employees to .be 'on site at any time (it was agreed the maximum shall
34 be 2 employes), the parking:requiremerits for employees '(it -Was agreed. 4 -spaces will.
35 be required), whether or not there would be a pass through to 'the Luck Stores
36 parking lot (applicant is required to agree on the access - Lucky will be dealing with
37 that issue when -they request apiprovals to 'remodel); degree of off-site traffic .impacts
38 (City Traffic Engineer says minimal). Also discussed were Shell car wash operations
39 in other cities and how they might compare in traffic volume and impact , with a
40 renovated station at this site.
41 The applicant revealed a proposed site plan (not previously shown to the City).which
42 they said addressed all the City staff s concerns. Shell Oil alleged .the station :at this
43 site, after improvements, will generate a lower volume of gasoline or car .wash
44 business than 1s 'generally the case with this type of operation. Staff noted there is no
45 collision data on .record relating to vehicular ingress, or egress at the station., It was
46 noted that the trafficengineer created, his, report on a "worst case" scenario.
47 At 9:45 the Council recessed to 10:00 p.m. and then resumed the hearing.

1 The Shell Oil representative said they agreeto °all the conditions of the traffic report,
2 to the dedication of a portion of the corner for improved street turning movements, to
3 prohibition of mini -mart retail service, to prohibition of exiting. vehicle towelling
4 service and to the other items listed in the Planning staff report. All public comments
5 havingbeen submitted, the hearing was closed -at 10A0 p.m. Resolution 90-421 NCS
6 authorizing issuance of a negative declaration of environmental impact was 'introduced
7 by John Balshaw and seconded by Brian Sobel pursuant to information made available
8 through the various Planning Staff reports and the hearing processes.

15 Resolution 90-422 NCS upholding the appeal received from Shell Oil from the
16 Planning Commission denial of a use permit for a car wash at Payran and Petaluma
17 Blvd. North, and approval of a conditional use permit pursuant to findings and
18 information received through hearings and as recommended by the Planning staff in
19 their September 11, 1990, staff ,report and the mitigated plan provided at this meeting.
20 There will be no towel drying, vacuuming or other ancillary car wash services
21 performed by Shell and/or its lessee. Two employees will be on site. Landscaping
22 will be subject to SPARC approval. Only four parking. spaces will be constructed on
23 the site on the easterly side of the site adjacent. to -the Lucky Stores parking lot. Retail
24 sales will be limited to vending machines. Standard Fire Marshal requirements will

42 (CEQA) Guidelines, which were adopted by Resolution 87-339 NCS, to provide for an
43 environmental impact mitigation monitoring process. When conditions are imposed
44 on a project to mitigate significant .adverse impacts, the City shall adopt a monitoring
45 plan for that project prior to the actual project approvals. Introduced by Michael
