With the completion of the North McDowell Blvd. 11 resurfacing, the curb in front of her business was painted red and her business has 12 suffered as a result of the parking restriction. She said she would appreciate having 13 the 20 minute parking back. City Manager John Scharer said that staff will look at the 14 situation tomorrow. 15 Nancy Chien-Ericksen, 389 Corona Road - Is hoping the Jack-in-the-Box sign will be 16 tasteful because she drives through that intersection regularly. She wants the arch to 17 be in extremely good taste. Regarding the Marina Office Park sign, she said it should ss not be oriented towards the freeway. She asked what is the standard for such signs. 19 Also, she wants a wetlands at the Marina. 20 Jed Clark, 5 Kazen Way -Regarding the sign at the Marina, what are the standards? 21 This is illegal and does not conform to the City's Zoning Ordinance. In response to ther'~- `~~-- 1o made at the Public Comment portion of the meeting, Planning Director Pamela Tuft 11 reported that both the building height and the proposed signing comply with Zoning 12 Ordinance regulations. The developer showed the Council a drawing of the project 13 and the Planning Director pointed to the location of the proposed sign at the cupola. 14 Regarding the orientation of the sign, it is oriented to the Petaluma River because this 15 is a river oriented business. The river and the highway are parallel and it would not be 16 possible to shield the sign from the freeway while allowing full view of the sign from 17 the river. The sign program will be reviewed by the Site Plan Architectural Review 18 Committee. The building height has been modified slightly to accommodate the 19 normal mechanical features of the building. It was noted the Zoning Ordinance 20 contains different formulas for measuring building height; it depends on the zoning 21 district. It was also noted the PCD zone is not a tool to circumvent the Zoning 22 Ordinance; rather, it is utilized to encourage better designing and planning. In many 23 ways the PCD district is a more restrictive zone. This action supersedes the ambulance rates listed in Reso. 89-260 NCS. Introduced by Nancy Read, seconded by Bonnie Nelson. The two projects are to 8 be located at 325 North McDowell Blvd. Project 1 is anticipated to be approximately 9 210 units to be bonded. in an amount not to exceed $23,365,000. Project 2 is 10 anticipated to be approximately 90 units to be bonded in an amount not to exceed 11 $6,500,000. It is the intent that the bonds shall be payable solely from revenues 12 received by the City in connection with this project. This action does not bind the 13 City to incur and debt. Resolutions 88-398 NCS and 90-21 NCS regarding this seniors 14 project remain in effect. The original approvals were for a project called "Chateau" to 15 be developed by PSP Partners, who have sold the property to the above named limited 16 partnership. Mr. Schultz of the Greenbrae Management Company, a principal of the 17 Lynch Creek Limited Partnership, .assured the Council the .project will be for senior is citizens. Introduced by Michael Davis, seconded by Bonnie Nelson. 19 AYES: Read, Davis, Mayor Hilligoss, Nelson 20 ABSENT: Cavanagh, Sobel, Vice Mayor Woolsey 21 RESO.91-368 NCS 22 PARK & RECREATION RIVER ENHANCEMENT GRANT' 23 Resolution 91-368 NCS authorizing application fora $75,000 grant from the California 24 Habitat Conservation Fund to match a grant already obtained from the County of 25 Sonoma. These funds will be used to comply with provisions of an existing agreement 26 with the County of Sonoma requiring the City to construct certain park development 27 in the .area of the Petaluma River dredging spoils site located near Cader Lane. The 2s Council asked Recreation Director Jim Carr to look at that area for a possible dog 29 walking site. Introduced by Michael Davis, seconded by Nancy Read. 30 AYES: Read, Davis, Mayor Hilligoss, Nelson 31 ABSENT: Cavanagh, Sobel, Vice Mayor Woolsey 32 HUMAN SERVICES CENTER 33 STATUS REPORT ON FAMILY SHELTER 34 Grayson James, of COTS, reviewed the operation of the Family Shelter program at 35 the new Human Services Center located at 1'500 Petaluma Blvd. South and which is 36 operated by the Committee on the Shelterless (COTS). Last year a maximum of 17 37 persons per night could use the old shelter located at 27 Howard Street. Now the 3s maximum capacity at 1500 Petaluma Blvd. South is 35 persons per night. At present 39 12 homeless children are attending Grant School. 4o There is a need to accommodate the homeless who work the graveyard shift. At this 41 time the shelter is open only for the nighttime hours. Mr. James reported that 42 additional staff would be required to accommodate their shelter needs. 43 There are a number of people from out of town utilizing the facility.. Mr. James 44 reported that some people appear to be moving from shelter to shelter while others a5 are moving into the area. RESO.91-367 NCS ~ ~ VSa rt ~-(_ December 16, 1991 Vol. 26, Page 469 ~ A family with HIV positive blood (a recursor of Acquired Immune Deficiency 2 Syndrome -AIDS) was not accommodated because of the potential of infecting 3 others. COTS has received so many donations, they have filled all their available 4 storage areas. 5 The Armory is serving 45 to 50 homeless men per night. The highest man-count for a 6 single night last year was 45. Jim Zirkle, St Johns Lutheran, recited the Invocation. 20 PLEDGE OF ALLEGIANCE 21 Frank Gilner led the Pledge of Allegiance to the Flag. 22 PUBLIC COMMENT 23 Mayor Hilligoss noted the Twin Creeks Subdivision is not a public hearing, so this 24 would be the time for comment on that agenda item. 25 Steve Carrigan, 51 La Cresta -regarding the article in the newspaper about the Hansel 26 and Benson delays in construction of automobile dealerships in the Auto Mall, he 27 asked if there were monetary penalties the City could collect. City Manager John 28 Scharer advised there are no construction delay penalty provisions in the Hansel and 29 Benson Disposition and Development Agreements which were entered into by the 30 City's redevelopment agency. 31 Frank Gilner, Petaluma Youth Soccer League -asked for City Council direction 32 regarding the use of City facilities for the 1992 soccer year. The City Council directed 33 him to Parks and Recreation Director, Jim Carr. 34 John M. Cheney, 55 Rocca Drive -Regarding Twin Creeks Subdivision, he opposes any 35 construction upstream until the Army Corps of Engineers report and project 36 information are available. City Manager Scharer advised the report from the Army 37 Corps of Engineers was scheduled for October; but now, according to the Army Corps 38 of Engineers, the current target date is the end of January or early February. 39 Wayne Lewis, 13 Payran -regarding Twin Creeks Subdivision, read the letter he 40 delivered to the City this date. In it he discussed home relocation, criteria for 41 determining a 100-year event, requested clarification of density, runoff, Army Corps 42 project data and other items. _ ~,' Page 470, Vol. 26 December 16, 1991. 1 Irv Piotrkowski, attorney for Twin' Creeks Subdivision - noted: they have worked on the 2 subdivision for several. years. With regard to the allocations which expire this month, 3 he said they are very close to completing the planning process and, therefore, request 4 a time extension on the allotments. 5 They requested authorization to defer construction on certain lots adjacent to the 6 proposed Army Corps of Engineer project until the flood mitigation project 7 parameters are known. However, they asked for approval to reconfigure the 8 subdivision to move one lot to the interior in order to maintain .a financially feasible ~ project. Mayor Hilligoss advised Mr. Piotrkowski that he would be able to speak when 1o the agenda item is considered. 11 David Note, 1321 Chapman Lane, representing Friends of Petaluma -they have input 12 regarding the PUC setback and a letter is coming. 13 RESO.91-369 NCS 14 ORDER RIVER OAKS ANNEXATION -NORTH PETALUMA #9 is This item was carried over to the evening meeting at the request of Vice Mayor 16 Woolsey. Resolution 91-369 NCS ordering North Petaluma Reorganization No. 9 17 (City of Petaluma Annexation 91-1 River Oaks/Petaluma Outlet Village) and 18 detachment from Penngrove Fire Protection District. This resolution includes Local 1~ Agency Formation Agency (LAFCO) conditions relating to the requirement that the 20 City conduct an annexation "sentiment survey" of the property owners and registered 21 voters of the unincorporated islands that resulted from the LAFCO mandate to 22 include a portion of Petaluma Blvd. North in the annexation. Introduced by Nancy 23 Read, seconded by Michael Davis. 24 AYES: Read, Davis, 25 Vice Mayor Woolsey, Mayor Hilligoss 26 NOES: Nelson 27 ABSENT: Cavanagh and Sobel 28 DISCi7SSION OF DOG EXERCISE AREAS 29 Director of Parks and .Recreation Carr noted a few jurisdictions have had success in 3o reducing the amount of dog deposits in their communities through peer pressure. 31 Those towns which have leash free areas, often enclose them with cyclone fences. 32 Staff is continuing to collect data from various sources and will make additional 33 information available to the Council in 3 months. In the meantime, the Police Chief 34 advised that the Animal Control officers will begin to monitor the school and park 35 areas in the early morning hours when dogs are usually let loose for their morning 36 constitutional. It is hoped the additional enforcement will discourage the shortsighted 37 dog owners from leaving their animal's feces where it has been deposited. 38 COUNTRY CLUB III ALLOCATIONS 39 Staff reported that the developer for Country Club III is working on resubmital of 4o their plans prior to the expiration of the allocations. 41 RESO.91-370 NCS 42 TWIN CREEKS ALLOCATION EXTENSION Cared y n 43 ~r Mills, Environmental Impact Report consultant, and Dave Harlin, Engineering 44 consultant, reviewed the environmental impact report and hydrology study findings. December 16, 1991 Vol. 26, Page 471 1 The proposed bridge will. have a center pier and was designed so the channel will be 2 large enough to accommodate the .river flow even with the snagging of a certain 3 amount of debris. There is a triple box culvert just upstream which will catch the 4 larger pieces of flotsam. 5 In planning the subdivision, they consulted the Army Corps of Engineers to determine 6 what would be the their most land consumptive river improvement project; the 7 subdivision was designed with that information at hand. It was noted the Sonoma 8 County Water Agency has advised they will not permit any landscaping on the vertical 9 portions of the riverbank. There was a great deal of discussion about hydrology. 1o Irv Piotrkowski completed his presentation (see the Public Comments portion of these 11 minutes). He said they would be willing to coordinate the establishment of a crossing 12 guard program at McKinley School. 13 Recess 9:15 to 9:25 p.m. 14 Mr. Vander Vere, hydrologist, described the drainage and river related design criteria. 15 The drainage system has been designed so that runoff will be directed within Twin 16 Creeks Subdivision and will not impact other residential areas. 17 Irving Schwartz, Civil Engineer, noted a soils engineer will certify all compaction. is They requested a portion of the planting strip along the perimeter street be eliminated 19 in order to accommodate a full width walkway. 20 Planning Staff will prepare responses to comments and bring the amended legislation 21 back to the City Council in January. 22 Resolution 91-370 NCS approving extension of Twin Creeks' Allocations to January 23 31, 1992. Introduced by Vice Mayor Woolsey, seconded by Michael Davis.. 24 AYES: Read, Davis, Vice Mayor Woolsey, Mayor Hilligoss 25 NOES: Nelson 26 ABSENT: Cavanagh, Sobel 27 TWIN CREEKS RELATED ACTIONS 28 The remaining actions on the Twin Creeks Subdivision were continued to January, 29 1992. 30 CITY COUNCIL COMMENTS 31 Vice Mayor Lynn Woolsey asked about the electrical repairs that are needed for the 32 house at 27 Howard Street. Assistant City Manager Warren Salmons advised the 33 Council that staff has determined the repair needs and identified a funding source for 34 upgrading the electrical system. 35 Vice Mayor Lynn Woolsey also asked that the Council look at the time that is 36 required to study their Council meeting packet materials. For the major issues that 37 were on the agenda this evening, they should have had the materials two (2) weeks 38 ahead of time rather than the Thursday night prior to the meeting. Page 472, Vol. 26 December 16, 1991 1 Mayor Hilligoss asked. staff to come back with a repor-t detailing what possibilities 2 there are for early distribution of packet materials. and what. drawbacks there would be 3 for altering the existing City Council packet schedule. Currently the Council packet is 4 delivered to the Councilmembers on Thursday evenings with some additional Friday s evening packet deliveries. ~ Bonnie Nelson agreed that earlier delivery of Council packets would be helpful since 7 she works weekends. ~ AD.T®UIt1V ~ Mayor.
