Planning. 19 Director Warren Salmons reviewed the proposed schedule with the Councilmembers 20 and reassured.the Council the Committee will be formed in the first half of this year. 21 The minufes -were amended on. Line 27 after ".. review. REGULATIONS The introduction of an .ordinance containing amendments to 'Chapter ' 11.24 of the Municipal Codme e relating to Turning Basin .and Waterways was continued -to February 5 to allow more ti.for the .Chamber. of Commerce River Committee to respond to the specifics of, the proposed ordinance. The Council .requested additional wording, which would .allow light recreational boat launching and staff was asked to review the wording relating -to .continuous occupancy., Marina The Council inquired about development of: regulations and a possible request for proposal for nianagement.of the new Marina. City Manager.John Scharer advised the .Marina regulations are now in :draft 'form and will be presented to the Council. in the near future; andat the present- time,. it is anticipated that- management of the Marina can be accomplished well with current staff. 33 ORD.1786:NCS' 34 LUCCHESI LADE - PROHIBIT ABANDONMENT OF FOWL & DUCKS 35 Introduce Ord. 1786 NCS making :the release: or abandonment of. fish .and/or fowl. at 36 Lucchesi Park a misdemeanor. The City .Council, asked staff to. develop 'a bail. 37 procedure for this ordinance. Introduced by Larry Tencer, seconded by Lynn 38 Woolsey. 39 AYES: Tencer, Woolsey, Cavanagh, Balshaw, Davis, 40 Vice Mayor Sobel, Mayor Hilligoss 41 NOES: None 42 ABSENT: None January 2, 1990 Vol. 25, Page 229 RESO.90-06 NCS NAME MARINA "PETALUMA MARINA" Resolution 90-06 NCS naming the marina, "Petaluma Marina". Introduced by Larry Tencer, seconded by Jack Cavanagh. AYES: 'Tencer, Woolsey, Cavanagh, Davis, Vice Mayor Sobel, Mayor Hilligoss 7 NOES: Balshaw* 8 ABSENT: None 9 * The no vote reflects Councilman Balshaw's feeling that ;Bob McLoughlin, 10 who has worked very hard towards the goal of building a Petaluma Marina for 11 the last 40 years, should be recognized. He asked staff to develop a list of sites 12 in connection with the Marina that the Council may wish to name in honor of 13 persons who were instrumental in development of the Marina. 14 CLOSED SESSION 15 At 4:00 p.m., the Council recessed to Closed Session to discuss litigation with the City 16 Attorney. 17 ADJOURN TO DINNER at Alfreds. 18 7:30 p.m. RECONVENE 19 ROLL CALL 20 PRESENT: PRESENT: Tencer, Woolsey, Cavanagh, Balshaw, Davis, Vice Mayor Sobel, Mayor 21 Hilligoss 22 ABSENT: None 23 Eagle Scout Kevin Baker led the PLEDGE OF ALLEGIANCE 24 There was none. PUBLIC COMMENT 25 COUNCIL COMMENT 26 Lynn Woolsey noted there was a milk spill in the Petaluma River last weekend and 27 the newspaper did not mention the situation., 28 Vice Mayor Sobel noted the successful incident conclusion rate of the- Petaluma 29 Police Department, which is much higher than the national average. 3o Larry Tencer asked if the Planning Department is in the process- of, developing 31 numbers to update the residential development report. He also suggested, the 32 information in that report would be 'helpful to the' public tokeep track of the: growth 33 management system, because it reflects that the City is growing within the parameters 34 of the recently adopted General Plan. He noted the residents are under the 35 impression the City is exceeding its growth limitation parameters. 36 Lynn Woolsey requested the next agenda include a. discussion of evening meeting 37 starting time. She recommends the Council return,to'the 7:00 p.m. starting time. ' 38 John Balshaw received a suggestion from a Kent Street business -person to .paint .the tu. 39 inside of the Keller Street parking garage white because the strucre is dark inside. 40 City Manager John Scharer noted at the design phase painting the walls white was 41 discussed, but it was dropped when the bids came in. Staff will report on the 42 estimated cost. Page 230, Vol. 25 January 2, 1990 1 Mayor Hilligoss read her State,of the City message. 2 PRESENTATIONS 3 Mayor Hilligoss -read a Proclamation from the Santa Cruz Board of Supervisors 4 thanking the Fire Department Strike Team that responded to a request for aid after 5 the. October 17, 1989; earthquake._ :They also sent a brisk complete with an engraved 6 metal pplate describing. the brick's origin as being from one of the collapsed, 7 unreUrced buildings. Fire Chief Krout showed some slides of unreinforced 8 masonry building damage in Santa :.Cruz. He pointed out the similarities between the 9 architectural styles, of downtown Santa Cruz and downtown Petaluma. 10 PEDESTRIAN OVERCROSSING STUART TO KENILWORTH 11 U.S. HIGHWAY 101 12 The City Council considered a letter from Ronald Miller regarding the problems the 13 Stuart Street area residents experience in connection with persons using the 14 pedestrian crossing between Kenilworth School and Stuart Street. Several years ago . 15 the- school district asked the. City to close the pedestrian crossing of U. S. Highway 16 101 because there were juvenile and adult miscreants frequenting the structure for 17 antisocial purposes. Recently, a .couch was been ,found. on, the structure. Entrance° is 18 gained by destroying case hardened chain and locks, by cutting the cyclone fencing, by 19 cutting .the .entry support posts and other means. 20 Mr. Miller elaborated about the problems that continue toL plague the neighborhood_. 21 Ten to twenty- persons at a time `party' on the structure. All attempts to permanently 22 barricade the walkway have been torpedoed by these persons.' Mr. Miller requested 23 the City's help in'resolving the issue. 24 Police Chief. DeWitt .urged the Council to keep the walkway closed at both ends, and 25 urged .citizens toL telephone the .Police Department when they see this type. of activity. 26 CALTRANS has, agreed to trim the trees adjacent to the walkway accesses. 27 Assistant City Manager. Gene Beatty noted the structure cost nearly $100;000 to 28 construct. The walkway was built as a result of parent petition for a safe way for 29 students to reach Kenilworth Junior -High School from the ,east, side of the, freeway. 30 There- was no walkway on East Washington at that time.- The .cost estimate to remove 31 the'walkway .is $300,000. and CALTRANS has stated they do not have the funds to 32 accomplish such a ,demolition: 'The matter was -referred to staff for recommendation 33 and report'back to the Council. M1 '34 VAN BERBER APPEAL 35 At the_request of staff, the: appeal was,. continued. to, February 5 to allow more time for 36 the interested parties_ to meet with staff. 37 DEVELOPMENT AGREEMENTS 38 ' CORONA/ELY AREA 39 At `the request of staff the discussion ;of the ordinances approving the Corona/Ely 40 development agreements wcontinued to January 16. The developers are, working 41 on,the Council's request to, ians clude affordable housing in the developments. January 2, 1990 Vol. 25, Page 231 RESO.90-07 NCS ORDERING CORONA/ELY ANNEXATION. 3 Reso. 90-07 NCS' ordering detachment from Penngrove Fire Protection District and 4 annexation to the City of Petaluma that annexation known as Corona/Ely and 5 declaration of the City's intention not to succeed to the several Williamson Act 6 contracts. All property owners of record within the proposed boundary of the 7 ' annexation had been notified of the hearing by mailed notice more than 15 days prior 8 to the hearing. The public hearing was opened. 9 Marcia Hopkins, 598 Corona Road, (outside of the annexation boundary) said the 10 only City contract she had was a survey questionnaire early in the process. Both the 11 Council and staff noted that those who expressed their desire to remain 12 unincorporated were not forced to participate, although it they had wished to do so, 13 there was heavy coverage of the entire planning process by both the Argus Courier 14 and Press Democrat. A benefit district will be established, so that those parcels that 15 wish to annex into the City at a later time also pay a portion of the initial assessment 16 district costs. Tim Taffe, Marsha Hopkins' husband, (outside of the annexation 17 boundary) said he has attended all the meetings and feels this is not the right 18 development of the area. There was no one else wishing to speak and the hearing 19 was closed. The resolution was introduced by Larry Tencer and seconded by Michael 20 Davis. 21 AYES; Tencer, Woolsey, Cavanagh, Balshaw, Davis, 22 Vice Mayor Sobel, Mayor Hilligoss 23 NOES: None 24 ABSENT: None 25 GRANT APPLICATIONS 26 Principal Planner Kurt Yeiter discussed proposed grants from the Department of 27 Water Resources for L ch Creek clean-up/revegetation and Washington Creek 28 Sediment Basin work (75,000) and from the Coastal Conservancy for Petaluma 29 River Enhancement Plan .($100,000). The City Council concurred to apply for the 30 Department of Water Resources grants (application deadline January 31, 1990) and 31 noted that staff will have appropriate legislation submitted to them at the January 16 32 Council meeting. 33 The Coastal Conservancy grant application deadline is July 1, 1990. Specific 34 legislation will be brought forward to the City Council at a later date. Regarding the 35 Coastal Conservancy Pegluma River Enhancement Plan grant application, the 36 Council agreed an aloe River Committee should be appointed, if the grant is 37 awarded to the City. One subject the Committee will not be charged with is flood 38 control and hydrology. If a committee is created, their task will not include 39 duplication of studies and planning that has already been done with public money. A 40. Council definition . of `Enhancement' relating to this grant is "to increase the 41 utilization in a ,utilitarian .manner, something. that will make the river more useful to 42 the residents." Staff will prepare a work program for this grant application for 43 Council consideration when the item is scheduled for consideration next time. Page 232, Vol. 25 January 2, 1990 1 RESO..90-08 NCS 2 DEVELOPMENT.OBJECTIVES 3 Resolution 90=08 NCS establishing 1991 Residential Development objectives. The 4 objectives are: 5 Priority 1. Developers, are encouraged to provide some portion, of � their 6 commitment to affordable housing ;in the form of on-site units or dedication .of1aa'nd ' 7 for construction of affordable housing by others instead of. in4ieu 'fees. 'The number 8 of units provided on-site should be consistent. with Program 12 of the Housing 9 Chapter of the General Plan (10 to 15%); however, projects providing less 4han, the 10 minimum percentage.will also be expected to pay a balance of in=lieu -fees to fulfill it their obligation. 12 The following are of equal priority: 13 2. Provide housing affordable to households earning 100 percent or less of the 14 County median income, including alternative housing such as self-help; cooperatives, 15 et cetera. 16 3. Westside development 17 4. Mixed use or high density development proximate to commercial services and 18 transit and smaller sized units. 19 Introduced by Vice Mayor Sobel, seconded by John Balshaw. 20 AYES: Tencer, Woolsey; Cavanagh, Balshaw, Davis, 21 Vice Mayor Sobel, Mayor Hilligoss 22 NOES: None 23 ABSENT: None 24 IN -LIEU LOW INCOME.HOUSING 25 SUMMARY REPORT 26 The Planning "staff presented a summary of the utilization of in -lieu (of low income 27 housing) revenues. 28 SET DATE FOR 29 GOAL SETTING MEETING 30 It was agreed February 3 would be the date scheduled for the annual goal -setting 31 session., The Council subcommittee on Personnel will schedule a meeting soon to 32 develop the agenda for the goal setting_ session. 33 LIAISON - U.S. HIGHWAY 101 34 Vice Mayor Sobel reported on the County Transportation Committee activities. 35 There is a- possibility that a 1/2 cent,. a 3/4 cent and/or 'a 1 cent sales tax, override 36 measure(s) will. be submitted to the voters in November., The committee is working 37 on broad parameters to determine which,,of the Cities transportation improvement 38 needs are shared in common. Councilman ,Cavanagh noted a statewide gas .tax 39 increase is scheduled for the June ballot. k N January2, 1990 Vol. 25, Page 233 1 There was a strong sentiment among the Councilmembers that growth management 2 along the entire transportation corridor (U.S. 101) must be addressed as part of any 3 mitigation plan. Larry Tencer, liaison to the U. S. Highway 101 Corridor Committee, 4 reminded the Council that a 1/2 cent sales tax override would not improve the level 5 of service of Highway 101, it would only maintain the current level of service, at best, 6 because by the time the highway widening would be completed the new capacity 7 would be filled. s The Vice Mayor asked that future agendas list this item early in the evening so the 9 public will have more opportunity to learn more about this transportation fund, raising 10 process. 11 TRANSPORTATION SEMINAR 12 The Council approved participation in the February. 2, 19.90, Transportation Seminar 13 at the Lucchesi Community Center in the amount of $250. 14 LEGISLATIVE REPRESENTATIVE 15 Vice Mayor Sobel noted Lyle Deffenbach would like to meet individually with 16 members of the Council between January 15 and 17. 17 ADJOURN is At 10:05 p.m., the meeting was adjourned. /liz� ? 19 M.
