Resolution 90=40 NCS directing staff to commence abatement procedures on an
illegal, non -conforming; free-standing° 4646ot pylon sign at, the Exxon Gas
Station at 5153 Old Redwood Highway. The resolution also calls for execution
of an agreement which indicates the intent and provides assurance :for the
removal of the pylon sign within 24 months. Introduced by Vice Mayor Sobel,

FIREWORKS
DIRECTION FOR BALLOT MEASURE
Fire Chief Krout reviewed prior Council discussions regardiri&.whether or not to
continue to allow sales of fireworks. ' There was discussion about _placing the
question on the ballot for the,voters to eitheradvise the Council. or to adopt an,
ordinance on the subject. It was moved by Lynn Woolsey and seconded by Vice
Mayor Sobel to place .the question :in the -form of an ordinance on the November.
ballot.

BUS ADVERTISING
The resolution awarding a contract for transit bus advertising was continued to
the next meeting.
ALARM SYSTEM ORDINANCE
The, Council discussed 'the introduction of a proposed ordinance amending .
Chapter 6.40 and adding Chapter 6.50 to the Petaluma Municipal Cbde
regarding :Burglar Alarm Systems. Police Captain Dave Long advised that the
number of false alarms- has increased and the Police Department recommends
the City Council amend the City's regulations to authorize the Police
Department to charge for false alarms. Since the staff had completely retyped
the, Municipal `Code sections without indicating which parts of the language were
new and which are currently in force, the City Council asked staff to come back
with an itemization of the proposed changes to the .Municipal Code along with a
report on how other communities deal with the false alarm situation and a
report from the City Attorney on the legality of withholding service. This was
continued to February 20.
TRANSPORTATION COMMITTEE REPORT
Vice Mayor Sobel gave the City Council an update on the proposed county -wide
sales tax referendum relating to funding U. S. Highway 101 Corridor
transportation improvements. He noted the Board of Supervisors opposes the
inclusion of Petaluma Hill Road as a parallel reliever route for U. S. Highway
101 between Petaluma and Santa Rosa. He also noted the growth management
component has few municipal followers. The Vice Mayor will continue to
submit his timely reports regarding the issue.

Scott Hess, 1709 Spring Hill. Road, thanked the City Council for their support of
Earth Day, 1990. -
CITY COUNCIL COMMENTS
Larry Tencer - Thanked the Planning staff for the report on the development
and housing activities. He commented on the newspaper articles about "runaway
growth" and emphasized the City has reduced the numbers of allowable new
dwelling units from 5% of the current housing stock, which would be
approximately 750 houses per year, down to 500 houses per year.
Regarding the Sonoma Mountain Parkway alignment, he has received a goodly
number of comments regarding the alignment and the possible impact on
residences. He asked'if the City would schedule a meeting on the east side with
representatives of the Santa Rosa Junior College and City staff to give the
concerned public an opportunity to ask questions and discuss alternatives
regarding the alignment of Sonoma Mountain Parkway.

Vice Mayor Sobel asked for cost and result information,on,the soils investigation

roject at. old Fire Station 2 (Ellwood Community Center):
He noted that the Casa Grande High School scholastic team placed First in a
recent 'Sonoma County Academic Decathlon, and the Petaluma High School
team placed Fourth. He asked that time be set aside at ,a future meeting to
congratulate the team members .personally.
Mayor Hilligoss asked the. City to complete the, beautifieation. of the lowef;.end'
of;Western Avenue at. Water Street and the Five Corners traffic island.

UPHOLDMAMILTON.APPEAL - VAN BEBBER PROJECT
Resolution 90-42 NCS upholding Jane Hamilton's appeal of the Planning
Commission action,on Van Bebber Bro"s. conditional use permit for a warehouse
expansion of an existing steel fabrication facility. The appeal had been
continued from January 2 to allow the interested parties to meet with
representatives of the Council (Mayor Hilligoss and Vice Mayor Sobel) and
members of ;staff to reach a common understanding on the subject of a public
access along the. westerly Mis,
of the Petaluma. River. Councilmember Balshaw
suggested, and tf`e!u churred with the addition of the following wording
to the resolution,
The City Council expressed, concern that this action would .be precedent setting.
It was emphasized that. each application,for City approvals -along this stretch of
the Petaluma River should stand on its own and should be treated separately on.
a case,by-case.basis:

Speakers were:
Patrick Glenn, 14 Alma Court, encouraged the Council to grant the Use Permit
without the requirement of a land easement for a future "River Walk" path on
this property and suggested the Council obtain input from the users of the
Petaluma River and look closer at the real concerns of the River.
Jane Hamilton, 110 G Street, appellant, said- the river access is a General Plan
goal. The proposed non -development agreement for the 25 foot setback
basically is requiring something from Mr. Van Bebber that is already required in
the Zoning Ordinance. The proposal falls short of achieving the balance
between private and public needs. She encouraged the Council to form a
citizen's advisory board for the river, to ask State Lands to survey the riverbank,
suggested the river access plan be done by a given deadline.
Mayor Hilligoss noted -her surprise by the appellant's stand, because at the end
of the meeting on the 22nd of January, Ms Hamilton told the Mayor she had .
been very pleased with the proposed conditions. Ms. 'Hamilton responded that
she wasn't`very pleased.
Bill Kortum, encouraged the Council to continue to work towards this path.
Melissa McDonald; 31 Howard Street, supports the pedestrian river access.
Connie Peabody, 148' Petaluma Blvd, represents the °children and supports public,
access. -

Bob Martin, 171 Payran, asked if flood control has been thought of. He
suggested the river access would also be useful for maintenance purposes.
Resolution 90-40 NCS upholding the appeal received from Jane Hamilton from' -
the Planning Commission- approval of a use permit for building expansion by
Royce Van Bebber and approving the use permit with the additional language
proposed by Councilmember Balshaw. Introduced by John Balshaw, seconded

REQUEST STATE LANDS SURVEY RIVER
There is a question where .the boundary is between the lands under title of the
State Lands Commission and the Lands of Royce Van Bebber and other
property 'owners along the Petaluma River. It was moved by Michael Davis and
seconded by John Balshaw to, request staff to -ask the State Lands Commission to
survey. the River in order to determine theboundaries between public and
private lands; and to begin the river plan. (State Lands has estimated this survey
will take from six to twelve months.)

PLANNING LIAISON
CLARIFICATION OF COUNCIL. DIRECTION RE RIVER AREA PROJECT
APPROVAL:
CouncilmanBalshaw 'requested' clarification of Council policy .on approvals in
the. River area, since this action applies only to the Van Bebber property. He
advised the. City Council that at a. recent meeting, the Planning Commission
approved a project for Walter Haake; and , included in. that approval 'is a
condition, that whatever solution the Council came up with for the Van .Bebber
property will be applied to the Haake property.
It was Council consensus the language of, the Van Bebber, approval applies only
ao `the; Van- Bebber use permit and to the of,
project (warehouse for storage),
but, toy nothing else.
"Regarding the Haake property, the Planning Director will -include A- condition
thattwould say°Whatever land, on. that, lot which lies between the existing building
and the river;, to the extent of 25 feet, would have the conditions as applied here
this evening to the Van 'Bebber parcel. The :Planning Director noted than Mr.
Haake'& statement to City is the building is built to the rear property line. If the
that is the case, there is literally no, private property, on which :to apply these
conditions. 'If there is any. land betweenthe building and the rear, of the Haake
property, ,this condition will be applied to that land.
John -Balshaw suggested '. the Council discuss requesting the Planning
Commission to address Program 11 .under the River- Chapter of the General
Plan. This Program .requires a building located on the river to have its
orientation -towards the river as well as towards the street on which it is, located.

SELF STORAGE - 945 PETALUMA BLVD..'NORTH
Resolution, 90-43 NCS approving .a Mitigated Negative Declaration .for the
Petaluma Se1f-Storage to be located. at 945 Petaluma Blvd .N.: Tliere was a long
discussion about the project as amended since the hearing. The Council added
the requirement that "esthetic impacts including ,' age and color are to be
considered by SPARC:"
The Council asked for an explanation of Finding .Paragraph 3 of the mitigated
negative declaration, "The project; as conditionally approved, does not have
impacts, Which are. individually limited, but cumulatively' -considerable."
It was noted that the plan before the Council at this meeting -is different from the
rendering the Council had. before- it, at the public hearing. Concerns - and
m
coments were 'made about the following items:' the three .story. mass of the -
proposed structure as presented at this 'meeting;. preference for the previous
rendering; and the differences that often exist between the proponents'
renderings at approval time and.the actual finished product.
The Council direction to SPARC was to minimize the stair -step massing and
maximize the buildout ' or area footage potential of the. building. Planning
Director Warren. Salmons advised the City Council the side'-of'the project that
shares a property line with the City's Police `facility will be. approximately 27 feet
tall, a very large; very blank wall which will, . not be in any way enhancing to the
public property.

The Council was assured at the hearing on January 16, that the places :indicated
on the rendering that looked like glass will be real glass and not painted like
mirrored glass.. The earlier rendering also showed trees which will probably take
a number of years to reach similar proportions.
While there was some discussion about relying on SPARC to determine the
scale/mass of the building, there was also comment that SPARC has not always
acted as some Councilmembers would have preferred.
Architect Bill Kirsch said they intend to install 36 inch box plants rather than 24
inch. He quoted the landscape architect as 'saying the original renderings show a
5 year growth of plants. Regarding the glass that was discussed, it is a mirror -
not a real window. However, it will be framed like a window.
Eleanor Mitchell, the team planner, addressed the five foot setback that staff
requested on the south .side of the project, contiguous with the existing building.
Her concern is this will create a dark alleyway.. which will collect trash.
Regarding maintenance of the building exterior, any repairs that may be
required to the proposed siding would be accomplished within the property and
there will be no need to obtain access from either. adjoining property owner.
The proposed siding on the south wall will be a flouro-polymer which has a
twenty year warranty. If it were necessary to paint portions of the wall, scaffolds
could be dropped off the roof. She offered to change to a maintenance free
concrete wall if the Council would prefer that. Councilman Tencer spoke in
support of the concrete wall.
Speaking of the wall on the Police Department side, Architect Kirsch said they
would cut five feef�t3`€h� building so there wouldn't be a problem. Regarding
the south side wall, since the adjacent building is built on the property line, the
wall is probably going to have to be a four-hour fire wall, which would make it
concrete.
The mitigated negative declaration resolution was introduced by John Balshaw,
seconded by Michael Davis.

Resolution 90-44 NCS upholding. Eleanor Mitchell's appeal from the Planning
Commission denial of a Conditional Use Permit for Petaluma Self -Storage to be
located at 945 Petaluma Blvd N.. With the change in Condition 1B of two story
rather than stepping down to one story, including SPARC review of signage and
color, Condition 2 was amended to delete the five feet setback and to require
concrete as the wall material, with zero lot line, the resolution was introduced
by John Balshaw, seconded by Larry Tencer.

Bruce Allington; who owns the Nina, commented that he doesn't feel only the
rich people should own boats and the costs and restrictions are ,onerous. Frank
Prim said the commercial vessels utilize the shelter of the river'between October
and May. The ordinance was introduced by John Balshaw, and' seconded by
Lynn, Woolsey.
