It was 26 noted this subject has been, scheduled on the next Traffic Committee agenda. 27 CITY COUNCIL COMMENTS 28 Michael Davis wants a time -line on completion of the section of Maria Drive which is 29 adjacent to Royal Oaks Mobile Home Park. 3o Lynn Woolsey noted the Parks and Recreation minutes for May 16 were unclear 31 regarding the bike path in the Corona Ely area. She emphasized the City Council 32 wants bike paths. 33 John Balshaw asked if the City has electrolysis problems in their water and sewer 34 system. . 35 - He noted the cut-off for in -lieu fees is $120,000 and suggested the City 36 should consider a fee structure which would include more expensive 37 residences. 38 - Regarding a newspaper article appearing in the. Press Democrat. he set the 39 record' straight as follows: "On the turning basin and river work, Mr. 40 Kieckhefer (owner of the Golden Eagle Shopping Center) is not only 41 providing the land, but he will also provide concrete and aluminum ramps. May 21, 1990 1 COUNCIL COMMENTS' cont'd. 7 PROCLAMATIONS 8 Public Works Week May 20th through 26th 9 PRESENTATIONS 10 Presentation of one year Certificates of Appreciation to Child Care Committee 11 members: Gail Calvello, Karen Liebowitz; and Rebecca Winslow. 12 ORD. 1799 NCS 13 1988 UNIFORM FIRE CODE ADOPTED 14 Fire Marshal Clyde Thomas reviewed, the various changes to the current regulations. 15 He advised the sprinkler installation cost estimate per square foo_ t of house is $1.35 to 16 $1.50 or $300 to $500 per house. Charlie Carson, Building ,Industry Association 17 Executive Director, commented about thepotential cost of water damage repairs from 18 accidental discharge incidents (which the Fire Marshal advised is a 1 in 6 million 19 occurrence). 20 Chris Craiker, architect, spoke in opposition to the requirement of sprinklers at target 21 combustion sites in residences located outside of the 4=minute-response zones. He 22 also asserted the sprinkler system can be turned off thus giving a resident a false sense 23 of security. 24 Fire Chief Krout noted the statistics, the 'Fire Service has received from areas that 25 require residential sprinklers, show ,a -dramatic decrease in life and property toss from 26 fires in sprinkled residences. He also noted ,the sprinkler system will be .an integral 27 part of the residential water service, and, if the sprinkler system were to be cut off' the 28 water supply would also not be functioning. 'The vote to adopt Ordinance 1799 NCS 29 adopting the 1988 Uniform Fire Code was as follows: 30 AYES: Tencer; Cavanagh, Balshaw, Davis, 31 Vice Mayor Sobel, Mayor Hilligoss 32 NOES: Woolsey* 33 ABSENT: None * Opposes sale of fireworks. 34 RESO.90-163 NCS 35 CHILD CARE COORDINATOR 36 Resolution 90-163 NCS funding Child Care Coordinator's position. Introduced by 37 Larry Tencer, seconded by Vice Mayor Sobel to authorize a loan from the Child Care 38 Trust Fund and; using that funding source,. proceed as outlined, in the staff proposal. It 39 is the Councit's intent that the money shall be repaid from the successful efforts of the 40 Child Care Coordinator- in.seeking cash grants. May 21, 1990 Vol. 25, Page 341 i It wan noted that some of the grants could be for administration and other grants; 2 could be program specific. In addition, the City Council will look to, the Child Care, 3 Coordinator to suggest other innovative methods of revenue generation for Child 4 Care. This is meant to= -be a one-year, only, demonstration project and will be 5 considered 'for continuaiion only if the Child Care Coordinator's attempts' at 6 generation of revenue are successful. 7. The Sonoma County 13 Transportation Committee has asked their Technical Advisory Committee to study 14 and report on a 2 cent Sales Tax_ ballot measure. He noted that San Jose's light rail 15 cost $30 Millions per mile to construct. Regarding the apparent public support of rail, 16 he noted there should be some emphasis on the cost of 1800's technology and some 17 investigation of more modern fixed "rail" technology such as electromagnetic 18 levitation. 19 20 21 RECESS 8:25 to 8:35 D.M. NIZIBIAN APPEAL RANCHO LINDO ESTATES (MT. VIEW AVENUE) 22 The City Council considered the appeal submitted by Joseph and Raymond Nizibian 23 from the Planning Commission denial of a prezoning -for Rancho Lindo Estates 24 Subdivision, a 10 lot subdivision which includes one lot with an existing house that will 25 remain. The Planning Commission's vote on the PUD Plan was 3 ayes and 3 noes, 26 resulting in defeat of the motion. By virtue of the Planning Commission rules and 27 procedures in Petaluma, this would have completely defeated the application if the 28 appeal had not been filed by the applicant. 29 The City Council, reiterated their prior direction that homes in custom lot subdivisions 30 not be subject to Site Plan Architectural Review Committee (SPARC) review, rather 31 the City shall require that the entire project meet predetermined guidelines with 32 regard to style of fencing, et cetera, and SPARC's time shall not be taken up reviewing 33 individual homes. SPARC should approve the design aspects and concepts of the 34 entire project. 35 There was considerable discussion about the matter of hillside construction and the 36 potential of neighbors being able to see into adjoining back yards. 37 Planning Director Warren Salmons reminded the Council the proposed conditions, as 38 set forth'.in the staff report that is before them, have not been acted on by the Planning 39 Commission. The Planning Commission action on the matter ceased the minute their 40 first vote resulted in the tie which defeated the entire project, .unless there was a 41 subsequent appeal. Because the agenda did not specifically state the various 42 legislation connected with the subdivision, no formal action could be taken at this 43 time. View Road, are .concerned a'bout,.the 5 - use of the most westerly easement for construction vehicle access.. This 6 is in a, drainage swale and wet weather access would be. practically 7 impossible. They also asked that the_construction access not be used on 8 weekends. The vacantroperty is owned by a person of diminished 9 capacity who is a ward of the State. The easement egress to Mt. 10 View is too close to Purrington. Mrs. ,Marshall does not wish to be 11 annexed into the City because she understood it would cost them 12 $409000 -to do so. They also,oppose sidewalk construction On "Mt. View. 13 - Julia Hoch, 1039 Rancho Lindo, said to tear the house down at 1541 14 Mt. View and make the road there. She doesn't -want any additional 15 :residents, from the proposed 9 new .houses using her street. Says not to 16 improve Mt. View with curbs except for, the new subdivision.: - .17 - Len Svinth, '1541 Mt. View, has, as lived therefor 20 years and has no. plan 18 to tear his house down for a street. He is conservator for Irving 19 Rasmussen and opposes use of ,the easement for construction access. 20 - Belford Fahrenfeld,.1023, Rancho Lindo, they have corresponded with 21 the City before :this time about the sidewalks in the subdivision. 22 (according to staff -the subdivision plans called for the sidewalks to be 23 built as they currently exist). People walk in the streets. 24 - Dennis Hansen, Rancho Lindo Drive. - asked that there be .restriction 25 of construction working hours and prohibition of loud construction 26 activity,on,weekends. 27 - Sandy Fahrenfeld, 1023 -Rancho Lindo,. Rancho Lindo should be closed, 28 to construction traffic until the subdivision is complete. 29 - Shirley Wilson, owner of the pfoperty on which 'the _Nizibian-. brothers 30 have an option to purchase. She noted that. as -part of their 31 ,planning process, they interviewed. approximately 10' different developers, told 32 some of the neighbors if they had any concerns or input to contact 33 them. None of the neighbors contacted the Wilsons. - Some of the 34 various developers suggested uses of the land included construction of 35 12 - 16, houses, construction of duplexes-, and a town and country, retail 36 shopping center. The Nizibians were the ones who suggested the 10 -lot 37 alternative which .is befor_ e the Council. at this time., The first 38 communications from thel neighbors 'came ;after the hearing notices '39 were mailed. The Wilsons understand some of the concerns express by 40 the..neighbors because they are going to build on one of the top lots as 41 are some. of the Nizibian children_. It is their intent to arrange their 42 house in such a way, that they cannot look into someone, else's yard. 43 The ' easement from Mt. View onto their .property goes with the 44 property. Trucks have used it in .the past. The Wilsons, have allowed 45. the neighbors to use theirproperty for such activities as swimming pool 46 construction. There being no one else wishing to speak,. the hearing 47 was closed. 48 The City Council asked 'that Lot 7 be left undeveloped as long as possible 'in order to 49 allow construction vehicle- access by way of the westerly easement. Rancho Lindo will 5o be blocked off in such a way that a only Fire .Department vehicle could pass through 51 when necessary until the first house is occupied. The lease may be renewed by" the Government from year to year through September, 2010. There is no monetary consideration. The purpose of this light system is to provide visual descent guidance' -information .during landing approaches to Runway 29 on a 24-hour basis. When a -pilot is on the proper approach path, he will see lower light bars as white and upper light bars as red. When below the proper approach path, the visible light bars are red and when he is above the proper approach path, the visible light bars are white.
