The resolution was introduced by Vice 27 Mayor Sobel, seconded: by Larry Tencer. 28 AYES: Tencer, Woolsey, Balshaw, Davis, Vice Mayor Sobel, Mayor Hilligoss 29 NOES: None .30 ABSENT: Cavanagh 31 BUDGET HEARING SCHEDULE 32 The City Council concurred with the City .Manager's suggestion that, they set aside the 33 hours of 1:00 p.m. to 5:00 p.m. on Monday, June 11, for their initial' budget 34 considerations. 35 RESO.90-180 NCS 36 AUTHORIZE STORM DRAIN PAYBACK AGREEMENT - HOOT'S ELECTRIC 37 Resolution 90-180 NCS requesting Storm Drain payback agreement- from Hoot's Auto 38 & Diesel Electric located at 501 Lakeville. Street. A requirement :of the' conditional 39 use permit is dedication of a storm drain easement for the future Sonoma. County 40 Water Agency flood control project pipeline. The request is for Hoot's Auto &.Diesel 41 Electric to enter into an agreement with the Sonoma County Water Agency whereby 42 Hoot's would .construct ;the pipeline .now and the Agency would agree to repay the cost 43 of this pipe installation at the time the Water Agency constructs the second phase of 44 the Wilson/Lakeville Street Project'. June 4, 1990 Vol. 25, Page 349 1 RESO. 90480 NCSi - HOOT'S PAYBACK cont'd.. 2 Installation of the facilities at this time will result in a cost saving, for the flood control 3 project. Introduced by Michael Davis, seconded by Lynn Woolsey. 4 AYES: Tencer, Woolsey, Balshaw, Davis, Vice Mayor Sobel, Mayor Hilligoss 5 NOES: None 6 ABSENT: Cavanagh 7 CITY ENGINEER 8 DEPARTMENTAL REPORT 9 City Engineer Tom Hargis presented a portion of his departmental report. At 5:00 10 p.m., the City Council asked that a future agenda include time for him to complete his 11 presentation. 12 Division of Staff Responsibility - He noted that approximately 60% of staff time is 13 devoted to activities related to development, 20% to capital improvement projects, 14 20% to traffic related activities and 10% to water pollution control administration. 15 The department has been short of people for some time, and they are currently 16 recruiting for the two vacant positions. (total time = 110% to represent the overtime committed by 17 staff) 18 Computer Aided Drafting. - He advised the Council the Engineering Department 19 budget request includes the first phase of a five-year program to `implement a 20 Computer Aided Drafting (CAD) system, which will assist the City to evaluate data in - 21 house more efficiently and more accurately. Initially -the system .will allow drafting 22 processes to become more, efficient, particularly when plan modifications 'become 23 necessary. Eventually, the system will -;allow -survey information. ;obtained in the. field 24 to be input automatically. An important parallel City computer system, the geobase 25 utilized by the Planning Department, is compatible with the requested CAD system. 26 Traffic Management - With the Traffic Engineer having been on board, for a while, the 27 computer traffic model software data base is, being fine tuned with data gleaned from 28 recent updated traffic counts. The traffic model software is currently being utilized to 29 assess impacts for development projects, evaluation of environmental impact report 3o data, and to assist with traffic signal coordination. They plain. to • employ ' an intern 31 during the Summer to aid in updating the data base. It was -noted that a traffic project 32 evaluation by the traffic model may take one-half hour for the computer to process_ or 33 it may take several hours, depending on the degree of complexity of the particular 34 traffic point at issue. Relating to the General Plan goal of maintaining Level C at 35 intersections, he posed the philosophical question of whether or not this goal may 36 encourage the use of single occupant vehicles. He noted that many technological 37 changes will be made over the next decade or so and automobiles as we know them 38 now may very well be nearly obsolete. 39 Interdepartmental Coordination - He recommended that as the City continues to 40 grow, that it is imperative to implement new methods of electronic data exchange to 41 improve the vital .process of interdepartmental. article. As departments grow and 42 more and more staff time is drawn towards specific project management, the 43 interdepartmental communication links will continue to weaken. 44 Future Wastewater Discharge Requirements Mr. Hargis advised the Regional Water 45 Quality Control Board will impose more stringent controls on the water quality of the 46 City's wastewater. This will require the City to incorporate a higher level of 47 treatment. In turn, the product leaving the various industrial businesses will have to 48 be of a cleaner nature. - The plant may reach capacity in 5 to 7 years. Envirotech 49 estimates plant replacement will take three years. r Page 350, Vol. 25 June 4, 1990 Engineeriag Department 'Report to be! Continued - At .5:00 p.m., half of his. report was completed. The City Council asked that the, remainder of his report be ,scheduled for a future meeting. They request some relief -,from the room use fee of $1;000.; Sandy Fahrerifeld, 1023 Rancho •Lind' Drive; and the following list of students from St.. Vincent School - her daughter-; Mary Reynolds, Engle Sartori; Jennifer Boden -and John 'Kingsbur_y. requested the City Council authorize the Police Department to present the drug . awareness program called DARE to their students. City Manager John Scharer advised the City Council he has ,responded to the school stating the City Council.will consider..the request.during budget hearings. CITY COUNCIL COMMENTS ,Lynn Woolsey suggested .that non sworn Police: personnel and/or Police personnel on light duty be trained to make the DARE presentations. Michael Davis - wants.students to {Sit periodically as a City Council and..that the Parks and Recreation, Commission should -oversee the, process. 1 - wants the City' to purchase an electric car as an example .for others to use towards"improving air quality. - suggests that if water heaters were placed closer to the hot water faucets, there would be a:great deal of water- coriserved. there is. 'a' process to recycle baby diapers into, usable products and he would like Sonoma County "to look at a consortium to begin reprocessing locally (Lynn Woolsey suggested .he compose a letter to the Sonoma County Land Fill Commission- making this suggestion) - there was an article about electromagnetic transmissions in. Macworld. The article indicates there is exposure to emissions from the screen of computer monitors, ,.and there is even ,greater exposure from the sides :of computer monitors. He suggested that people who. use. computers on ,a daily basis sit 28 inches away from the front of the computer monitor screen and even farther away from the side of: the screen Vice 'Mayor, Sobel - supports offering the DARE -program to all students Larry. Tencer - :asked .about the expiration of the Humane :Society animal control service :contract. (The City Manager noted this is a two-year agreement, .and he will present the Council with. a report.) John Balshaw, - supports DARE.presentations at: all the schools - requested there be a review of. the parking garage on a future agenda. He is particularlyiiiterested in the.light use of the second level, improvements to the lighting, the ,prior suggestion to paint the walls :a lighter color' - asked when'the Council will receive the requested report on electrolysis in the water and sewer pipes June 4, 1990 Vol. 25, Page 351 1 PROCLAMATIONS The Mayor read the following proclamations: 2 - 1990 Jack London Education Award of Excellence to Mike Thompson 3 - National Safe Boating Week June 3-9 GROWTH MANAGEMENT SYSTEM 5 Staff and the City Council reviewed possible amendments to the Growth Management 6 System. The thoughts expressed by the Councilmembers include the following: 7 - Concern about the potential that a developer will assume allotments are 8 tantamount to approval, and the Council has no intention to make the 9 allotments "cast in concrete" 10 - Want it clear to developers that submittal of documents for the allotment 11 process does not trigger the Statutory time limits for development 12 processing 13 - Does the Council have the discretion to re -award forfeited allotments with 14 findings 15 - Do not wish to reallocate forfeited allotments 16 - Perhaps the 45 in -fill count should be eliminated, then utilize the forfeited 17 allotments, to absorb the in -fill unit count 18 - Establish certain criteria (such as affordability) recognizing that there may 19 be unique circumstances whereby construction should be able to proceed, 20 and to include this criteria in the Development Objectives for each year 21 - Develop a second pool category for unused allotments. This pool could 22 have certain limits for reallocation. 23 - If a special circumstance project comes along, amend the regulations at 24 that time to fit the situation, rather than try to anticipate all possible 25 alternative special• circumstances. 26 - When the development potential estimate is made for any acreage, the 27 figures do not take into consideration the "loss" of potential units as a 28 result of the space taken for streets and sidewalks. 29 - We should develop criteria for starter homes. 30 31 ABAG LAND USE POLICY FRAMEWORK COUNCIL DIRECTION 32 It appears there is a movement by the State Legislature towards the creation of a 33 strong level of governmental bureaucracy to control, regional issues. This would 34 replace Association of Bay Area Governments (ABAG), Metropolitan Transportation 35 Commission (MTC), .Air Quality Control, and 'all the other regional control agencies. 36 If this comes to pass, it was agreed that Petaluma should be proactive in the birthing 37 of this regional bureaucracy. The Council also agreed there should .be regional 38 growth control and members of the Association of Bay Area Governments should 39 look into the "Minnesota model' for local tax sharing. The creation of new municipal 40 corporations in southern Sonoma County was opposed by Councilmembers. 41 42 Vice Mayor Sobel noted . the next meeting is 43 several transportation funding ballot measures 44 success or failure of these issues will have 45 Transportation Committee direction. The calculations of these revisions 'is not yet 8 complete and the hearing was continued to allow ;sufficient time to complete the 9 calculations and revised mailing to the property owners. Resolution 90-182 NCS .certifying, the' environmental impact 19 report; for Twin Creeks Subdivision. The, Planning 'Co,mmissio-nresponded to the EIR 20 recommendations regarding mitigation measures which would necessitate a .major 21 project redesign -by approving .the EIR, denying the rezoning and the Planned .Unit 22 Development Plan and recommending that the 'City Council deny the tentative map.._ 23 Staff noted the project as presented to' the Planning Commission reflects several 24 inconsistencies with the - City's General Plan. The applicant,, ,H -Y -H Corporation, 25 appealed the rezoning denial in order, to bring the issue to the City Council. They 26 requested another continuance which, according to California Statutes, is not legally 27possible. Staff noted the neighbors expressed their concerns about,the effect on future 28 flooding and circulation to the' Planning Commission. After staff review, 'the public 29 hearing was opened. Speakers were Iry Piotrkowski, counsel; Michael Hitchcock, 30 Planner; Norm Hansh, Engineer; and Carolyn Mills, Mills Associates, spoke on behalf 31 of the applicant. There were differing 'points of view'between staff and the applicant 32 regarding the ,applicant's :response to staff advice as to project design and its lack of 33 consistency with the General ,Plan. They asked for an opportunity for additional time 34 to address the mitigation measures outlined in the .EIR and for a continuation of the 35 project's allotments beyond their _June, 30 forfeiture date. The,, City was advised: the 36 applicants received a communication from, the Army Corps of 'Engineers stating their 37 hydrologic design_ is .expected, to be out in July. Relying on past experience, .City 38 personnel were, doubtful the Army Corps' report would .be ready that soon. The 39 applicant stated the policy of "no rief fill" is maintained by the project design. It was 40 noted this .land is in the Bernard Eldredge School District. There was no comment 41 received from that School. 42 Other speakers were:. Wayne Lewis, :Payran Street resident, and Bob Martin, 171 43 Payran Street,, who had concernsabout environmental effects, pro ect design, privacy,. 44 anticipated housing sale pricey open space loss and increased traffic. REZONING, PUD cont'd. 2 The Council discussed the question of extension of allotments. This will be addressed 3 at another Council meeting. Commission determination. The denials 13 are without prejudice. The PUD and tentative map were discussed. 30 The Council added a condition that the buyer be required to sign a document stating 31 they acknowledge the fact they know that an assisted housing project is being 32 constructed adjacent to this subdivision. The related legislation will be acted on June 33 18.
