GRANTING AN EXTENSION OF TIME TO OWNERS OF THE LANMART
BUILDING (39 PETALUMA BOULEVARD NORTH) AND THE PHOENIX THEATER
(205 WASHINGTON STREET) 'I'O COMPLY WITH CERTAIN PROVISIONS OF THE
CITY OF PETALUMA UNREINFORCED MASONRY BUILDING ORDINANCE
(CHAPTER 17.34 OF PETALUMA MUNICIPAL CODE)
WHEREAS, in 1992 the City Council of the City of Petaluma adopted Ordinance 1882
N.C.S., adding Chapter 17.34 to the Petaluma Municipal Code pertaining to the seismic
strengthening of unreinforced masonry (URM) buildings; and,
WHEREAS, said ordinance assigned identified buildings to one of four groups based
primarily on use and occupant load characteristics; and,
WHEREAS, Group I buildings had until April 1, 2002 to complete all work required by
Chapter 17.34; and,
WHEREAS, the owners of the Lanmart Building (39 Petaluma Boulevard North) and the
Phoenix Theater (205 Washington Street) failed to meet the April 1, 2002 deadline to complete
all required URM work; and,
WHEREAS, following notice from the. City of Petaluma of the on-going violation of
Chapter 17.34 of the Petaluma Municipal Code, the owners of the aforementioned buildings have
subsequently submitted plans for the required URM work and have make commitments to
complete said work in a timely manner; and,
WHEREAS, the City Council of the City of Petaluma held a public hearing on
November 17, 2003, to consider the evidence presented as to a request from the owners of the
Lanmart Building and Phoenix Theater for an extension of time to comply with the applicable
provisions of Chapter 17.34.
Resolution No. 2003-229 N.C.S.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Petaluma, based on evidence in the record, hereby grants the owners of the Lanmart Building
and the Phoenix Theater an extension of time to complete the work required by Chapter 17.34 of
the Petaluma Municipal Code. The granting of said extension is based on the finding that the
owners are working cooperatively with City staff on all outstanding ~URM compliance issues.
BE IT FURT>EIER RESOLVED that should either owner fail complete said work within
the mutually agreed upon time limits established in conjunction with the City's Chief Building
Official, that the Chief Building Official is hereby authorized by the City Council, as provided
for in Section 17.34.050(f) of the Petaluma Municipal Code, to order the building(s) vacated
until such time as all work is completed to the City's satisfaction.
Under the power and authority conferred upon this Council by the Charter of said City.
