MONDAY, JUNE 6, 1988

PUBLIC COMMENT: There was none.
INTRODUCTIONS: Recreation Director Ann McGowen introduced Don Phoenix, the
new Recreation Supervisor.
COUNCIL COMMENTS: Michael Davis said he is looking forward to the refuse
company's start of collection of recyclables this month.
MINUTES: The May 16 minutes were amended as follows:
Page 81, Ord. 1722 NCS, 5th line, amend effective date to, "...30 days from adoption
date."; Page 85, Reso. 88-150 NCS, 9th line down, sentence beginning in middle of line
should read, '"I'he Edith Street site is not in the flood plain.."
Page 87, Adjourn, amend sentence to read, "...the meeting was adjourned to Mav 25 at
4...,,
COMMISSION APPOINTMENTS
The Council established June 22 as the deadline for receipt of letters of
application for the annual commission term-expiration/reappointment process.
Monday, June 27, will be the date the Council interviews the applicants.

of a single motion which was introduced by Michael Davis and seconded by

Adopt Ord. 1722 NCS adding Section 17.04.060 to the Petaluma Municipal Codf
~ requiring the installation of ultra-low flow flush toilets for new construction o,
remodeling of existing facilities. This ordinance amends the Uniform Plumbing
C Code Title 24, Section,5-1001(a) by adding the requirement that tank-type water
closets shall use no more than one and five tenths gallons of water per flush.

Reso. 88-159 NCS approving agreement with the Petaluma Valley Baptist
Church for development at 1181 Ely Blvd. North. This agreement is a follow-up
of Council action adopting Reso. 87-3~ NCS. approving payment of
development fees in installments. Upon recording with the County Recorder,
the unpaid fees will become a lien on the property.

Vice Mayor Woolsey stepped away from the dais to avoid a ,possible conflict. as
Sonoma Woodworks 'hasbeen ~a client of her firm. George Weiner, through his
attorney; has requested that the Council consider abandonment of that :portion
of Madison that is not improved. The .matter was continued so taff could do a
title search of that portion of Madison to determine whether it is'an easement or
owned. outright by the City. In addition, staff was asked to submit a report of

Reso. 88=160 NCS authorizing the City Manager to enter into an agreement for
professional consulting services with Economic and ~ Planning Systems of
Berkeley. ~ to prepare a financing plan that will. ,be key to implementing the
Corona/Ely Specific Plan. The :contract amounts ao 523,~~ and is to be paid
from the Community Facilities, Fees monies. Introduced by John Balshaw,

GRAND OPENING IDEIDIC~ATION
Lucchesi Community Center construction is expected to be completed by
October. Ann McGowan, Recreation Director,. asked for- Council direction
regarding the type of activity they wish to schedule! fo; the dedication of the
building. Suggestions 'include: an all-day affair, with tours of active recreation
classes,- live music, balloons, activities to bring the community to the park and a
dance in the evening. 'The Recreation, Music and Parks subcommittee will.
develop a proposal with those pazameters for submittal to the Council for

C06JNCIL COMNiEN'I'S:
Vice Mayor Lynn Woolsey distributed a proposal for amendments to Center Park
design. This is the result of a cooperative effort by the youth who use the park
and the neighboring business people. Another meeting of the ad hoc committee
has been scheduled for Wednesday, June 15, between 5:00 and 6:00 p.m. in the
Recreation Conference Room.
Mayor I-iilligoss reminded the Council that the First Annual Miss Petaluma Pageant
will be held June Yl at the Valley Inn located at McDowell Blvd. and East
Washington.

Reso. 85-161 NCS upholding the appeal received from the Spahr Insurance
Services relating to the decision of the Planning Commission to deny a home.
occupation permit at 147 Westridge: Drive. Cynthia Hunt represented the
appellant. The. applicant had applied for a buyer's permit at a Santa Rosa
wholesale house which. insisted that he furnish a business license to prove that he
was in business. He was; advised by the City that although a business license is
not required for his business; a home occupation permit is required. Reso. 88-
160 NCS upholding the appellant's request for a home occupation permit for
one year, unless` there are complaints from the neighbors. This is based on the
fact there is a lot of parking space ,available, this keeps people off of crowded U.
S. Highway 101. Vice Mayor Woolsey and Brian Sobel opposed the action
because they felt it was precedent setting and the time extension was too long.
John. Balshaw spoke in favor of the resolution saying. if you cannot. see it, hear it
or smell it from the sidewalk and is~ not bothering the neighbors, it should be
acceptable. Introduced by Larry Tencer, seconded by Michael Davis.

The Planning: Commission referred the question to the City Council and Jane
Hamilton appealed to the Council to deny the application for an auto parts store
to be located at Second. and G Streets (location. of former Coca Cola Bottling
Plant; then Eraser's Candy supply). The basic question is: Does the Metcalfe's
business do 51% or more of its business in the retail sales of auto parts (not
including the parts used in their machine shop)? If 51% or more of their
business is in retail sales, then the business.. is a 'permitted ,use' in this zoning
district (Highway-Commercial)... If the machine shop portion of the business is
the major source of revenue, then the use comes. under the category of
'conditional use' and must go through the planning permit process.
The speakers were:

Ernie Jensen, 99 Pepper Lane • property owner'of proposed business site. If this
application is not approved, he asked what kind of business could go in
that building.
Barry Parkinson, attorney -spoke :on the. Metcalfes' behalf:
John Hogue; 201 GStreet,- opposed location of business, and he spoke on
behalf of Eileen Valere, opposed.
Harold Metcalfe, his-son Larry Metcalfe, and, his som all spoke.
Jane Hamilton,110 G Street - (appellant) and representing the.'Second Street
:Homeowners' group.
Constance Griffith - realtor -.suggested her client could put an artist supply store
there.
After much discussion, Larry. Tenter introduced Iteso.88-162 1vCS directing
staff to have an accountant. look at the.1lRetcalfes' books for the .last six months;
and, if the out-the-door auto ;parts average monthly ;gross retail sales has been at
least 51% of the

business, it is determined that Metcalfe Auto Parts is a permitted use at th~
proposed location (2nd and G Streets) and the appeal submitted by Jane
Hamilton is denied. Michael Davis.. seconded the resolution.

The Council -heard the appeal of an administrative decision to grant two
additional outside water services for athree-lot split of a 7.4 acre parcel located
at 2715 Western Avenue. Speakers were the owner, Charles Page; his neighbor,
George Sprayens, who opposes the water permit; Alberta Jacobson, 2662
Western Avenue, did not support suggestion of the water line users spending
money to improve the lines -for additional users; Jane Guerni, supported Mr.
Page's outside water request; residents located at 2600 and 2828 Western
Avenue stated the water pressure is very low. The City Engineer noted the
water pressure could be increased by changing to newer pipes to eliminate
sediment that is present in older pipes and pressure could be increased by the
use of storage tanks.

water permit was introduced by Vice Mayor Woolsey and seconded by Michael
Davis.

1989 ALLOTMENTS
The Council discussed the...proposed 1989 allotment list .and. expressed concern
about the number of units that.can be built without further City~approvals. The
subject was continued to the next meeting to allow staff to develop more
detailed. information. 'Van Logan suggested that the Council. consider allotting
50 units per proposed development in the Corona~Ely azea for `the 1990 yeaz to
enable developers to obtain financing commitments.
