MINUTES OF A REGULAR ADJOURNED MEETING
PETALUMA CITY COUNCIL
MONDAY, JULY 11, 1988
ROLL CALL: 7:00 P.M.
PRESENT: Cavanagh, Tencer, Sobel, Woolsey,
Vice Mayor Davis, Mayor Hilligoss
ABSENT: Balshaw
PUBLIC COMMENT: Tom Gaffey gave the Councilmembers a letter objecting. to the
redevelopment plan, to the map approval and to approval of the resolutions.
COUNCIL COMMENT:
Michael Davis commented that the east-side houses .are the fourth least expensive in the
County regardless of fees and with the fees Petaluma is not the most expensive
housing site in the County, based on figures obtained from the realtors' multiple
listing service.
Jack Cavanagh requested a report on Ellwood Center for July 18.
Lynn Woolsey asked that the Council discuss the flooding problem as it relates to
development fees as soon as possible.
CONSENT CALENDAR: The following items from the Consent Calendar were approved
by adoption of a single motion which was introduced by Larry Tencer, seconded by Brian
Sobel.

ZONING ORDINANCE TEXT' AMEI~NIENTS
CHILD CARE
The proposed Zoning Ordinance text amendments have been developed to
conform with State regulations. The child care day care centers are divided into
three categories, small family day care - up to 6 children, large family day care -
seven to twelve children, child care centers over 12 children..

Small Family Day Care -Municipalities may. not regulate the small family day care
centers in single family zoning districts. Staff recommendation. is not to regulate
this size child care facility in any residential zone.
Large Family Day Care -State law allows municipalities to classify them as a
permitted use in an R-1 zone with no regulation, reviews or standards imposed by
,the City.. Or, anon-discretionary permit (in single family zones) may be used. This
would allow cities to adopt an ordinance listing'the standards by which large family
day care is judged and permits.would be handled. much the same as building
permits. Or, the City may impose standards plus develop a hearing process
wherein there would be a mandatory 100 foot radius notification. This latter
procedure is recommended by staff and the Planning Commission.
The following named persons spoke:
Dr. Kinley -expressed concern about the cost of the proposed fencing requirements.
Carol Stevenson -recommended minor changes and urged approval of the grandfather
clause.
Child Care Association attorney -lauded the City's efforts in support of child care
facilities.
Karen Liebowitz of Caring for Children -discussed the proposed outside play hour
restriction of 9:00 a.m. to 6:OU p.m.
Janet Morris -parent of a 2-year old spoke in favor of a 6 foot fence because a very young
child can climb a chain link fence.
Rosie Guiterrez -said there isn't that much noise from a.large day care facility.
Tina Page, Community Child Care Council -urged the City Councilmembers visit some of
these child care facilities to observe their<operations and noise levels, is concerned
about the. fence cost, and noted there'was no neighbor comment about her six year
old business until the 300 foot notice was mailed to them. She also noted the cost
to start up a facility can be high.
George Castagnola -spoke against any proposal. to haves noticing requirements and leave
the major criteria to the State agencies.

Grandfathering • It was the Council consensus to support a grandfathering clause.
Boundary Barrier - It was Council consensus to require a safety°boundary fence~to be
determined at the description of the barrier to the Director.. of Planning at the time
of the hearing.
Proximity - 300 foot separation between day care facilities was the consensus of the
Council
Drop-offs and pick-up of children shall normally be staggered was the consensus of the
Council
Director of Community Development Warren Salmons reminded the Council that the Ciry
can hold a hearing, and if the facility meets the standards, the permit must be
issued.
Noise -the Council consensus was, if upon one year review the City finds that there are
noise complaints thaC can be looked at and the hours for outside play could be
curtailed.

The facility will .be operated irr a:manner which will not adversely affect adjoining
residences.
Renewals -the Council agreed renewals will be subject to review..
Outside Play-Time Limitations - It was noted that currently there is a day care facility that
has time limitations placed on it. No outside play time limitations were included in
the ordinance.
It was moved by Lynn Woolsey and seconded by Vice Mayor Davis to approve •::,.
revised ordinance text relating Co child care facility regulations. pursuant to Council

BUDGET continued
The Council continued their consideration of the 1988-89 proposed budget. The
Council discussed and approved the proposal to audit the revenue bonding projects
for ,low income housing. Council directed staff to included auditing procedures if a
like project is approved in the future.
The,Council approved the Old Redwood Hi~y Plan Line~EIR and affic
.Master Plan supplemental requests. The Council emphasized these studies are
funded by fees collected from developers and not from the General-Fund.
The Enterprise Funds were reviewed: -Water Utility, Water Pollution Control, Transit,
Parking and Airport. The City Manager advised the°City anticipates the airport
with additional leases in effect to have a positive cash flow in 1990-91 which will
continue to improve in subsequent years.

Risk.Management, Workers Compensation, Dental Program, and Unemployment.

Parks Department - Parks Super'isor Haold Jones requested reconsideration of the
budget item:.Overhaul Well System/McNear We1L The Public Works and
Recreation/Parks`Department will pursue. the well maintenance through the Water
Division. and report: back to he Council as to whether. or not the Water Division
will assume the maintenance, or the General Fund will be charged for the repairs.
The request for a special lift truck for pruning street trees was not approved. The
Parks Department was directed to share the Street Department's boom truck.

ENTERPRISE FUNDS REPLACEMENT EQUIPMENT
Water Pollution Control -staff withdrew the request for the flexible sewer rodder
($28,000)..
TRANSIENT OCCUPANCY TAX
REQUESTS
Wristwrestline -The Council concurred to remove the caveat comparison with the County
funding, thus funding Wristwrestling in the amount of $5,000.
Cinnabar -The Council concurred. with the request to assist them for funding their
Summer Festival. Thee approved funding is $5,500. It was moved by Lynn Woolsey,
seconded by Jack Ca~~~ ~ ~ ~h, to increase the Cinnabar TOT funding to $10,000.

River Festival - It was agreed that the City's assistance to the River Festival would be to
underwrite the early expenses and the City would be repaid from any profit
generated from the event. If there were no profit, there would be no expectation of
repayment to the City TOT fund.
There were no other comments on the TOT funding.
Petaluma. Hospital Emerge~gr Room Emansion -The subjeet of funding this entity was
discussed and rejected because the hospital has its own source of funding. The
Council concurred in not funding the emergency room expansion.
Revenue Sharin¢ -The Council concurred in leaving the remaining Revenue Sharing
monies (approximately $5,000) for a future decision.
NEXT 11ZEETING The final budget documents will be before the Council at the July 1S
meeting.
CLOSED SESSIOhT At _10:33 p.m. the Council recessed to a Closed Session to discuss
personnel.
