SUBJECT: Introduction(first reading) of anfOrdinapce Approving an Offer to Dedicate
Three Exclusive Utility Easements and-One-Non:Exclusive Utility Easement to
Pacific Gas and Electric Company-for-the Purposes of Installing, Operating and
Maintaining its,Public Utilities within:City Owned Land Known as the Petaluma
Swim Center,:Petalunia CA, 273 O.R. 187, APN:.007-031-004. .
RECOMMENDATION
It is recomrnended,thatthe City Council adopt an ordinance approving an offer of three exclusive
utility easements and one non-exclusive utility easement to Pacific Gas and Electric Company
(PG&E) for the purposes of installing, operating and maintaining;its public utility lines on the
Petaluma Swim Center property, as shown`in the attached Exhibit A.
BACKGROUND 'i
The City Council'previously approved,the environmental impact;report, design review and final
. map for the East Washington Place Shoppingl Center, (Target): Construction of the project is
underway: As part of development,of the site;land the Regency/City/Fairgrounds development .
agreement, PG&E utility lines have been.installed on portions of the swim center property to
serve the East Washington=Place project. PG&E requires the dedication of the four easements
prior to Tactivating the.utility lines. Dedication'of an easement across City property is an-action
requiring'City Council approval.
DISCUSSION .
Utility easements are required by PG&E for newly installed and/or relocated utilities. By
granting the:easements, PG&E will obtain legal rights from the City to operate.and maintain its
utility line infrastructure on the City's,swim center site. In order for the City to grant easements
to another.entity on property it owns, an ordinance must be approved, by the City Council.
Normally; public utility easements are created after:,construction occurs- to avoid having to
abandon and re-establish;an easement if a construction conflict occurs and requires realigning the
utility line from the initial design. Therefore; this easement is being requested after construction

has occurred and the exadt„alignment of the easement is precisely known. Granting of the
easement and installation of the underground utilities will not adversely affect the Petaluma
swim center property and is:required to activate service..
The proposed action meets Council Goal: `Improve and enhance fiscal stability and
sustainability".
FINANCIAL IMPACTS
This action has no impact on-the City's budget. Funding for this project•has been provided by the
developer of the East Washington Place Project, Regency Centers LLC, on a cost recovery basis •
for•staffand`legal time associated with this project.

WHEREAS, the City Engineer and City Attorney have reviewed the easement grant:deeds and
legal descriptions noted as "Exhibit..A" -and have reported them to be in conformity with
applicable City standards and policies, the Subdivision Ordinance and Subdivision Map Act and
such reports have been forwarded toandreviewed by this Council:
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
PETALUMA AS FOLLOWS:
1. That said grant_of easements is hereby approvediandshalibe carried out; and,
2. The City,Manager'is hereby authorized and directed to sign the easement grant deeds
thereby:offeringtherexclusive-utility easements to Pacific Gas-and Electric Company.
