PRESENT: Cavanagh, Tencer, Sobel, Woolsey, Vice Mayor Davis, Mayor Hilli~~~ss PLEDGE OF ALLEGIANCE The Pledge of Allegiance recitation was led by Fire Chief Terry Krout. PUBLIC COMMENT Bob Martin, 171 Payran Street, read a letter to the Council questioning the effectiveness of detention ponds, the flood control mitigation measures and alleging the City is not in conformance with its general plan. Vince Landof, 12 Cordelia Drive, agreed-with Mr. Martin's comments and said this has been studied to death and the City is passing the buck to studies to stall for tune. The City Manager noted the above questions would be addressed during the meetin~~. MINUTES The Juiy 11, 19.88 were approved as submitted. Introduced by Vice Mayor Davis, seconded by Jack Cavanagh, AYES: Cavanagh, Tencer, Sobel, Woolsey, Vice Mayor Davis, Mayor Hilligoss NOES: None ABSENT: Balshaw FLOOD CONTROL DISCUSSION The .following items relating to flood control were discussed: Page 188, Vol. 24 August 8, 1988 - Current policies and mitigation .measures Planning Director Warren Salmons reviewed the Zoning and General Plan policies regulating, development in flood plain .zoned areas which regulations are more stringent than. Federal mandate. He also reviewed the 'zero net fill' requirement for construction projects which allows fill only if the amount of fill balances with a like amount. of soil removed, and he reviewed the .storm water runoff detention ponds. Also mentioned were the City's erosion control regulations. - Status of EIR and project~alternatives study Planner Kurt.. Yeiter advised that Wesco (Western Ecological Services Company). is studying the impacts identified in the Master Drainage ..Plan, rechecking hydrology assumptions and doing. a cost benefit analysis to determine the feasibility of suggested mitigation projects. The data gathering phase is expected to be completed' in December. Property owners in the study area have been contacted and a few have not authorized access to their land for reasons such as `cattle control'. - Status of U S Corps of Engineers reconnaissance report The U. S. Army Corps of Engineers (ACE) has :dropped some of the proposed projects from their study plan. The .ACE has said it would not work on their study in conjunction with the City's study, they work singly. Currently it looks promising that. they will be developing mitigation fora `50-year" event. (That refers to the probability that -the severity of a given storm would be `occurring ~ one time within a 50 year span of time'.) Regardng'the `benefit/cost' ratio, the ACE's premise is there should be more proven benefit to the. community than the project improvements would cost.. At the present time, it is estimated that construction improvements to protect from a `40 year' event will cost approximately $6 Million. That would include the ~ City itself replacing both the Payran Street Bridge and the Lakeville Street Bridge. The ACE has advised the City would be required to bear the additional, cost of any mitigation project. to provide protection for anything more than a `40 year' event. The ACE takes 9 to 18 months to do a feasibility report. If needed appropriations are $5 Million or less, the .ACE approval. `is handled by their district office. If the amount of greater than $5 1Viillion, the approval must go through their Washington, D.C, office.. The City Engineer estimated the process will take another three years at the minimum. The bridges would represent more than one-half of the project cost, making the City's share a little over $3 Million for the bridge- replacement. The ACE report is expected in September. The first phase of the Payran ~ Bridge replacement is replacement of the sewer pump station project which is scheduled for award in September of this year. The ACE participation is close to $3 Million including the railroad structure improvements. It was suggested the: City pursue the suggestion of supporfiing: the Army Corps of Engineers hiring outside consultants to hasten the process. August 8, 1988 Vol. 24, Page 189 - Report on State legislative efforts - AB 4400 _ Assemblyman Filante and State Senator Keene have sponsored a bill in the State Legislature. The bill,. AB-4400, would identify the State `Resources Agency' (which consists of the:.Departments of Conservation, Fish and Game, Forestry; Boating and Waterways, Parks and Recreation, Water Resources, California Conservation Corps, Colorado River Board, Coastal. Commission State Coastal Conservancy and Bay Conservation and Development Commission) as the Lead Agency in the State for flood control projects in Petaluma. - Discussion o financing mechanisms , - ~ ~ _ City Manager John Scharer noted the Army Corps of Engineer reconnaissance report was ,supposed to be done in April. It was rescheduled for August, then rescheduled again to September. Utilizing an assessment district would result in assessments higher than the land value in some cases. Don VanDyke of California Public Financing Services Corporation addressed the Council./Commission and answered questions. He described how tax allocation funding works through the redevelopment law. STATUS REPORT ON RAINIER AVENUE The City Engineer reported that CALTRANS' general rule for spacing freeway interchanges is that they be separated by at least 1 mile. If such structures are closer, certain. conditions need to be met. The distance between the Washington Street interchange and the proposed Rainier interchange is .85 mile. Environmental documentation must be completed prior to CALTRANS consideration of other questions relating to interchange approvals. Council asked that this be brought back on an agenda with information to enable the Council to discuss the project utilizing redevelopment funding along with discussion of flood mitigation and funding. I-IIGIIVVAY 101 CORRIIDOR Larry Tencer, liaison to the U.S. Highway 101 Corridor Committee, reported that committee is looking at the bus/highway and rail/highway transportation alternatives. It appears that a one cent sales tax in Marin County and a one\half cent sales tax in Sonoma County may be sufficient to fund a viable transportation alternative for the future improvement on the Highway 101 Corridor between Sonoma County and San Francisco.
