MINUTES OF A REGULAR MEETING
PETALUMA CITY COUNCIL
NOVEMBER 21, 1988
ROLL CALL: 7:30
PRESENT: Cavanagh, Tencer, Sobel, Woolsey, Balshaw,
Vice Mayor Davis, Mayor Hilligoss
INVOCATION: The Invocation was led by Rev. Richard. McMillan from the
Hospital Chaplain
PLEDGE. OF ALLEGIANCE The Pledge of Allegiance. was led by Joan
Peaslee
PUBLIC COMMENT Joan Peaslee President of the Board of Directors for
the Petaluma Peoples Service Center presented the Council with the Centers
first Annual Report. A video tape was also presented for viewing during
Council break. On behalf of the Petaluma Peoples Service Center Joan
Peaslee thanked the City Council and Manager for their constant and
continued support for the agency which is the only human service agency for
South Sonoma County.
CITY C®i1NCIL COlVI1VIENTS Lynn Woolsey stated that she would like to
see the subject of the proposed Riverfront Zoning District agendized and
discuss all the alternatives that would prevent us from having to have an
election regarding the zoning.
Councilwoman Woolsey showed concern that Metcalfe Machine Shop had
moved the auto parts sales into the new building without having the results of
the auditors report. Warren Salmons, Director of Planning, stated that the
Metcalfes were under no obligation to report their move to the Planning
Deparment due to the fact that it is a permitted business. If they want to do
something structurally or with the electrical they would have to get a building
permit.
Councilman Balshaw referring to the Metcalfe machine shop feels that if we
spend a lot of time with an applicant and the applicant decides not to go
along with Council's recommendation, he feels the applicant should. tell
Council rather than come back in two years and bring the same issue before
the Council as if it were a new item. As far as Councilman Balshaw is
concerned the Metcalfe's .are still operating under the 50% agreement.
Councilman. Tencer feels that as long as he is on the Council under the
circumstances. if Metcalfe came back in a year or two or three for a machine
shop he would view that as trying to circumvent the use permit process and
would not vote favorably for it.

Councilman Balshaw commented on the appearance of the City. It just does
not seem to look as pretty .as it -can. Regarding landscaping etc. He feels
Council should explore talking with some of the service- clubs about getting
involved and taking over certain areas of the community. Maybe a Garden
Club would like to do flowers at Lucchesi Center, maybe one of the service
clubs would like to adopt a particular park for the amenities. There just
seems to be a basic minimum standard ~on everything. Balshaw would like to
find ways to do more to beautify the city and also realizes the constraints with
money and personnel.
Councilman Davis asked the City Attorney for his interpretation of Measure
G.
City Attorney Joe Forest, stated that Measure G does not prevent the people
by initiative from adopting a utility tax. By making .Measure G a Charter
Amendment means that the City/City Council cannot either impose, levy or
collect a utility tax. Unless the Charter was amended to say that the city can
collect even if people by an initiative imposed a utility tax the city couldn't
collect it because Measure G is a Charter Amendment. Whereas, Measure
H that was on the ballot in June stated if the people had gone out and
imposed by initiative a utility tax, the city still could have collected it.
Measure H did not bar the city from collecting.
Question was then brought up as to whether the people could still pass a
utility tax tomorrow.
City Attorney Forest stated "yes they could".
City Attorney Forest advised Council if the Council proposed a utility tax and
it was passed by the people, the city could not collect the tax without a
Charter Amendment, but it could be collected by a utility company, any
group, organization or company. After collection it could then be turned
over to the city.
Mayor Hilligoss read a Proclamation declaring the week of November 21,
thru the 27, 1988 as 1988 Petaluma Family Week.

MINUTES The Minutes of November 14, 1988 were corrected to read
(GENERAL PLAN POLICY BUILDING DENSITY) There appeared to be
consensus anion the Council that if a re uest is received for reducin a
project's density y a significant change there should' b'e a city review of that
change.

Introduce .Ord. 1744 NCS amending Uniform Fire Code and Uniform
Building Code to require all wood, materials used as roof: covering or
exterior wall covering to have a fire rating of Class "B" or better.

CLOSED BUSINESSES &
NEIGHBORHOOD APPEARANCES
Mike Moore, Principal Planner asked for Council direction on three
potential ordinance additions that could either be part of the
Municipal Code or part of the Zoning Ordinance depending on
Council preference. Thes"e items deal with Neighborhood
Appearance, Closed Businesses and Xeriscape (low water usage
landscape).

Essentially a neighborhood appearance would govern appearance in
the public view that could be applied to the whole City or parts of the
City. A copy of San Leandro's Neighborhood Appearance Ordinance
was included for Council review to be considered the model for the
Bay Area community. This ordinance shows the process of a typical
abatement if it were to reach- Council level.
The ordinance refers to the appearance of property in the public view
such as driveways and front yards. The question of staffing and the
City's philosophy of abatements need to be considered carefully by the
Council as does the question of whether the City wants to include
neighborhood involvement not. only in the designing of the ordinance
but also to use San Leandro again as an example having a
Neighborhood Appearance Committee where people would come
with their concerns at which time the committee would then
determine if a recommendation should be made to the Council.
After a lengthy discussion it was the consensus of the Council for staff
to develop a Closed Business Ordinance and include those things that
staff thinks are important, then if Council wants to add or delete to
that list .rather than go through a survey it would be brought back to
the Council within a 30 day period..
It was, also the .consensus of the Council to encourage the community
to het involved in creating guidelines, and standards for a City wide
Neighborhood Appearance Ordinance by forming a committee to
work with staff.
The Xeriscape ordinance came as a result of discussion at the Site
Plan Architectural Review Committee level when a presentation was
. done by a consultant for the Sonoma County Water Agency.
Mike Moore, Principal Planner asked. Council if they would like to see
the same.~resentation. The 1Vlayor agreed that Council should see the
presentation.
City Manager .John Scharer advised the Council that the Sonoma
County Water contractors will put in funds to employ a xeriscape
consultant who has worked up plans for the entire county which
includes education,, material etc.

1988-89 ALLOTMENTS
After agreat-deal of discussion it was the consensus of the Council to
bring thrs .item back for discussion on December 5, 1988.

ABAG HOUSING PROJECTIONS
Reso. 88-378 NCS acknowledging ABAG ~ Housing Projections
through 1995. The total projections through 1Q95 for Petaluma's
housing; is 2,774 units. 694 are projected to be very low income, 472
should be for.household of low income, 610 for moderate income and
998 for above .moderate income.
Concerns were shown regarding other Counties needs in determining
growth. Solano County is the only other County shown to have any
significant growth in resrdential units over the next 7 years.
Percentage wise compared to the population in that County, it is
greater than Sonoma County. The difference being, Solano County
.has Highway I-80 and that is an interstate route that is receiving
federal funds: Our Highway 101 Corridor is not even on the "SIP. list
for state. funds -for the next five (5) yearn. This is what. is wrong with
the type of projections that go on to 'say we want to encourage- more
building and yet we will not have the irifustructure, at least the
transportation portion to support it.

Motion was made by Councilman Sobel and seconded ~by Vice Mayor
-Davis to have the Planning Commission meetings' televised.

HIGHWAY 101 .
Councilman Tencer reported the following summary of the last
meeting of the Sonoma.. County representatives and staff. He also
proposes that Council send a letter to Supervisor Rudee who is the
Vice Chairmari of the Highway 101 Action Committee supporting the.

L` Support the widening of Highway 101. from 4 to 6 mixed flow lanes
. from Petaluma to Windsor. :. .
2. Upgrade Highway 101 to freeway and add 'two high occupancy
vehicle lanes between Novato and Petaluma if -the jurisdiction in
Marin County revise their Land Use Plans to provide additional
`housing to go along with the new conunercal and office development
. in the County.
`~'3: "Preserve the Northwestern Pacific right-of-way in Sonoma County
for possible future transit use after .the year 2005 including the
possible extension. of passanger rail service from Marin County to
Santa Rosa or Healdsburg after the year 2005.

Councilman `I'eneer would .like to see thi's agendized for the first
meeting in January for further discussion.
TRAFFIC. ENGINEERING
City Manager John Scharer, reported on. Traffic Status Report. The
Traffic 'Engineer will spend 75'% of his time updating the model from
the data base in 1985 to reflect the land use decisions Ghat have been
made since then and the developments that have ggone in. When that
is complete his work ,.program will be such. that he will be spending
40% of his work week on traffic modeling work that maybe necessary.
If there is no work to be done he vial. be spending:. it on other things
related to traffic and engineering.
