A leiter will also be forwarded to Supernsor Harberson and the Chairman of the. Board of Supervisors to invite them to attend :a session at Wilson School.. Applauds the City Council. effort to go forward with control of assault weapons. ViewAvenue - Regarding the °~roposed Country :Club 'Estates subdivision; There were 'T02 signatures of~ area residents who. were coneemed about drainage when the:, subdivision ..was before the Council: in December, :1-986, when the Council approved Resolutions 86-336; 337, and 338 NCS on the development:- ;At that time, a representative of the developer tated (and the Council concurred) the developer will, do corrective drainage work, off site in an .amount equal to and in lieu of the storm drainage mitigation fees due by this subdivision.. It is Iv1r. Ham's contention that this pronused off-site drainage work has ,not been, constructed. and City crews have had to clean up .the run=off residue from this ,property. Mi. Ham also suggested the environmental' review' be updated with regard to downstream drainage, traffic and cumulative impacts. He~ also requested wntten; notification to the landowners that could be affected' by the project, not just the landowners in' the area. If' tfie Council: changes to 2-way it cuts his. options in half.. .Maryann: IVllne - a lifetime resident- supports helmets for motorcyele~:riders. but feels that. should not be a requirement. She .disapproves of .that ,being mandated: Tom Knudsen, ~Sunnyslope-Road - He has spent 12 years in the motorcycle industry and supports statewide mandate ofh helmets required for all riders. The. overwhelming number. of. accidents occur in the first six months of ownership before Graining .to ride motorcycles safely. -.-~ _~ February 21, 1989 Vol. 24, Page 307 CITY COUNCIL COMMENTS Brian Sobel poke to reassure the audience the Council is not planning to unilaterally ban guns. Larry Tenter would be heartened if the NRA went on record to ban assault rifles. Lynn Woolsey -her respect for the NRA is waning because she has always felt they supported guns for hunting and recreation and that they didn't support assault weapon ownership. 89-48 NCS Resolution 89-48 NCS authorizing agreement with U.S. Army Corps of Engineers for feasibility study. He reviewed the few channel. changes Viacom is making. The basic. rate will' be increasing by $1.00 -per month and outlets will be increased by $:25 per .month. There was a great deal of discussion,~about -the. seasonal water=course - located between house. rows. The -lower portion ~ of the creek is under City ownership now, and this phase of Country Club .Estates will keep"ownership of ~ ' ' the drainage way. Regarding slope stabilization, the developer's representative Robert Abbott advised it is not the developer's intention to do, soil stabilization and leave a terraced hill. It is their intention o maintain as much of the existing contours as can be done. They- agree Ghat retaining, walls should be shown on the tentative map; however, those walls that may be necessary to achieve buildable lots. With the custom home subdivision,,,the final lot usage design is not known until building plans are in process. .-Exact. driveway' 1'ocations and potential retaining walls are not known at tls time. The developer requested the conditions be amended to require SPARC review° of the -individual site and grading plans prior to individual grading permit, similar to the Phase 1 process. Planning Director Salmons suggested that inserting a condition requiring leaving the site m the same topographic condition minus the landslide; with the rolling appearance and preservation. of vegetation may respond to the concerns. He° recommended a requirement that every wall-they are~:going to put on in order to make the public improvements work, and lot line retaining walls shall be prohibited until there- isreplanning and a mechanism to determine responsibility of lot line-retaining walls. He went on to say that staff has concern about the potentially vastness of the lot coverage and site impacts of just the garages and driveways, alone, of large custom homes that are proposed for this site considering the grades and topography that exist. The developer said they anticipated no lot line :retaining walls and request relief from identifying driveway site. Regarding fees, the developer is questioning the legality of the traffic mitigation fee and. the Council asked if in-lieu of low income housing construction fees should be included `in the conditions of approval. Gordon King speaking on behalf of the developer. advised the Council .they have requested a response from the City Attorney on the 'City's :authority to impose the traffic mitigation fee. He mentioned their attorney, Mr. McInerny has advised the developer regarding certain State Statues that he interprets to require cities to identify the purpose of such a fee and the developer is following up on that advice. The EIR was approved in 1981. Page 310, Vol. 24 February 21, 1989 Joe Harn of Mt. View Drive addressed the, Council regarding the neighborhood concern about drainage and other impacts.. At the recommendation. of City Manager John Scharer,, to continue ,the: item and ask staff to' bring back.:more information, on souls, .traffic;, :and.. hydrology' and the Council asked staff what additional information can be gleaned. from any .focused traffic study, from anything dealing with drainage, erosion and. those' sorts of things with the goal .of ` detertiumrig what `;additional reports may be necessary. as a condition of the. tentative.
